HomeMy WebLinkAbout1985-06-26June 26, 1985 Special Heet lng The BOARD OF APP~ held a special meeting on Wednesday evening, June 26, 1985, at 7:30 p.m. in the Selectmen's Meeting Room with the following members present and voting: Frank Serio, Jr., Chairman, Alfred E. Frizelle, Esq., Vice Chairman; Augustine W. Nickerson, Clerk; William J. Sullivan; Walter F. Soule; and Raymond A. Vivenzio, Esq. PI;BLIC Varrichione, Andrew - Variance - #averlyl~ad Again, the applicant was not present. MOTION: by Mr. Frizelle to deny the variance as requested SECOND: by Mr. Soule VOTE: Unanimous - motion carries DECISIO~ Columbia Laity Trust - Variance - Col~-hia Road/Sutton Street MOTION: by Mr. Soule to grant the variance as requested, subject to the condition that only a single-family dwelling be placed there with a driveway for the parcel entering from Columbia Road to the existing 3-stall garage. SECOND: by Mr. Frizelle VOTE: Unanimous - motion carries ~oolid~e Construction - S~ecial Permit - Dale Street MOTION: by Mr. Frizelle to grant the special permit under Section 4, Paragraph 4.133 of the Zoning By-Law subject to the following conditions: The dwelling be reduced to 28' by 44' and the driveway be located in the front of the dwelling and not on the East side as shown on the Plan. It is the intent not to show a "dog leg" type drive, but a direct entrance to the dwelling from Dale Street. The sewer line on Dale Street must be installed and completed with certification from the Board of Public Works that all work for the sewer line to the dwelling has been completed prior to the issuance of a building permit for the proposed dwelling. 3. The Plan be revised to show the conditions set forth herein. SECOND: by Mr. Vivenzio NOTE: Mr. Vivenzio replaced Mr. Sullivan as a voting member on this item. VOTE: Unanimous - motion carries Cyr Engineering - Variance - Pleasant Street MOTION: by Mr. Frizelle as follows: Lots 56, 58, and 59 - to deny the variance requested and to order that the foundation be removed forthwith; that the land be returned to their condition which existed prior to construction by seeding with grass and be fertilized with non-chemical fertilizer, and that the plans be revised to show said changes. Lots 10 and 60 - to grant the variance requested to permit a driveway within the Watershed District 250-foot "No Construction Zone" on the lot as shown on the plan accompanying the petition, subject to the condition that no trees along the property line of the lot on Pleasant Street be cut to allow installation of the driveway; and subject to the condition that the foundation on lots 56, 58, and 59 be removed and the land be restored as aforesaid; and that the plans be revised and recorded prior to the reissuance of the building permit for lots 10 and 60, or lifting of a stop work order relating thereto. SECOND: by Mr. Vivenzio NOTE: Mr. Vivenzio replaced Mr. Sullivan as a voting member on this item. VOTE: Unanimous - motion carries MacMiff Development - Special Permit - Salem Street MOTION: by Mr. Frizelle to deny the special permit as requested. It was stated that the provisions of Section 10.31 were not satisfied, specifically, that the site is not appropriate because of the lack of a town sewer. The provisions of Section of 4.133 (1) also were referenced and the grant of the permit would not protect the public health and welfare. The Board also took note of the action of Town Meeting, prohibiting construction around the Lake and pending study of the Lake. SECOND: by Mr. Sullivan VOTE: Unanimous - motion carries Daniel - S~ecial Permit - French Farm Road MOTION: by Mr. Nickerson to grant the special permit as requested, subject to the following conditions: 1. The premises be occupied by Cecile Micka. 2. The special permit shall expire at the time Cecile Micka ceases to occupy the family suite. The special permit shall expire at the time the premises are conveyed to any person, partnership, or corporation. The applicant, by acceptance of the Certificate of Occupancy issued pursuant to the special permit, grants to the Building Inspector or his lawful designee the right to inspect the premises annually. SECONDED: by Mr. Fritzelle VOTE: Unanimous - motion carries Palumbo, ~o~ert - Special Permit - Flagship Drive MOTION: by Mr. Fritzelle to grant the special permit as requested subject to the condition that there be no access to the land from Marion Drive. SECONDED: by Mr. Nickerson VOTE: Unanimous - motion carries PLANS SI~NED The following plans were signed: Miele Realty Trust Hetherington, James Kelley, Kenneth Toye, James MINUTES The minutes of May 13, 1985, and June 10, 1985, were unanimously approved as submitted.
