HomeMy WebLinkAbout1985-11-13November 13, 1985 The Zoning Board of Appeals held its regular meeting on this date in the Town Building at 7:30 p.m. The following members were present: Frank Serio, Jr., Walter Soule, Alfred Frizelle, Augustine Nickerson and associate members John Simon, Ray Vivenzio and Anna O'Connor. DECISION Michael S. Holland - Variance - 217 Waverly Road Mr. Simon stated that lot is smaller by 13 to 14% of bylaw and we should stay with 5,000 ft. bylaw. We should stay consistent. Mr. Serio said he felt that two houses on that lot would be too crowded. Lot A would consist of 4,860 sq. ft. and Lot B would consist of 4,383 sq. ft., making both lots undersized. MOTION: by Mr. Frizelle and seconded by Mr. Simon to DENY this variance. VOTE: To deny - Mr. Alfred Frizelle, Frank Serio and Augustine~Nickerson. To grant - Mr. Walter Souls Motion by Mr. Soule and seconded by Mr. Frizelle that the minutes of the October 15, 1985 meeting be accepted as read. DISCUSSIONS Cyr Engineering - Pleasant Street - Variance The foundation in question has been taken down according to Mr. Simon. The building permit has been issued but other conditions stipulated in the granting of this variance have not been met and no recording made, per Mr. Simon. Letter will be sent to the Building Inspector requesting an update on this variance. Coolidge Construction Motion made by Mr. Frizelle and seconded by Mr. Souls that a letter be sent to the Board of Selectmen requesting indemnification for attorney fees, services and damages on account of the legal action by Coolidge Construction for parcel of land on S. Bradford Road and Great Pond Road, and Michael Kettenbach for land on Osgood Street. VOTE: Unanimous DISCUSSION HELD ON LEGAL DECISIONS: Mr. Soule stated that legal decisions should be given to the Zoning Board of Appeals as they are decided. This should be done by the Town Counsel. Ail actions should be recorded. Motion made by Mr. Frizells and seconded by Mr. Soule that a letter be sent to To~n Counsel requesting an update of all pending litigation and request that a quarterly report be made to the Board for the next meeting, December 10, 1985. VOTE: Unanimous PUBLIC HEARINGS: Min Yong Lee & Young Ja Lee - Variance - 223 Forest St. Motion made by Mr. Frizelle and seconded by Mr. Soule that this hearing be continued Page 2 (cont'd) umtil the December 10, 1985 meeting since no representative present. VOTE: Unanimous Letters read by Chairman from Board of Selectmen regarding meeting with the Steering Commission. The Board will attempt to attend the Steering Commission's meeting on December 11, 1985. Form A from the Planning Board regarding Heritage Estates.
