HomeMy WebLinkAbout1983-08-22August 22, 1983 Special Meeting The Board of Appeals held a Special Meeting on Monday evening, September 22, 1983 with the following members present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice Chair- man; William J. Sullivan; and Augustine W. Nickerson. The purpose of the Special Meeting was to render a decision on the petition of Thompso~s Restaurant, Inc., requesting a variance and Special Permit on Andover Street. Chairman Serio read a letter from Attorney Richard Asoian, dated August 16, 1983. A discussion followed with the Board, Attorney Asoian, and Stuart Thompson regarding the parking and razing the garage on the property. Mr. Thompson explained that the garage will be removed but he does not know when. MOTION: by Mr. Frizelle to grant the variance from the provisions of Section 8, Par. 8.1, which will allow 86 parking spaces in place of the required one space for each three seats; a variance from Section 8, Par. 8.1 (6) to vary the size to allow 8' x 18' parking spaces. Each of the above 8.1 and 8.1 (6) are subject to the condition that the parking plan will become effective upon the termination of the written lease with Andover Interiors, Inc., which is 90 days after written notice to Thompson's Restaurant, Inc. Also, a variance from Section 7, Par. 7.3 and Table 2 for setbacks is granted; and, specifically, a variance from footnote 1 of Table 2 for the 100 foot setback from Route 114. The variances granted are subject to the condition that the garage shown on the plans be razed or removed prior to the issuance of an occupancy permit from the North Andover Building Inspector. In addition, a Special Perm/t under Section 9, Par. 9.1 and 9.2 is granted. SECOND: by Mr. Sullivan VOTE : Unanimous - motion carries. The meeting adjourned at 8:30 p.m. ChairT~n ' ~ Secretary
