HomeMy WebLinkAbout1984-06-06r June 6, 1984 Special Meeting The Board of Appeals held a Special Meeting on Wednesday, June 6, 1984 at 7:50 p.m. in the Town Office Meeting Room with the following members present and voting: Frank Serio, Jr., Chairman; Alfred B. Frizelle, Esq., Vice Chairman; Richard J. Trepanier, Esq., Clerk; Augustine W. Nickerson; Walter F. Soule; Raymond A. Vivenzio, Esq.; and Maurice S. Foulds. DECISIONS Joyce, Ralph - Request for Reconsideration of Denial of Variance Sitting: Serio, Frizelle, Trepanier, Nickerson, Soule The Board denied Mr. Joyce a variance to allow the construction of a dwelling on a lot in the R-2 zoning district containing 21 feet of frontage where 150 feet is required. A letter from Mr. Joyce dated 6/4/84 requesting a reconsideration of the Board's decision was read and placed on £ile. MOTION: SECOND: VOTE : by Mr. Trepanier to reconsider the petition of Ralph Joyce. by Mr. Frizelle In favor - 3 (Frizelle, Trepanier, Soule) Opposed - 2 (Serio, Nickerson) Motion fails MOTION: by Mr. Frizelle to reconsider the reconsideration. SECOND: by Mr. Trepanier Discussion: Member Frizelle said that the reason for is motion is that he was not present at the last meeting and the petition was denied because the vote was three to one and the motion to grant the variance did not carry. It seems to him that the variance was not denied for a specific reason but because the motion did not carry. It would be in the petitioner's best interest for the Board to reconsider the motion since the five members are here tonight. Member Trepanier agreed with Mr. Frizelle. Member Soule added that only four members should have voted because Mr. Frizelle was not present at the continued public hearing when further testimony was accepted. Mr. Nickerson felt that the petitioner had a fair hearing. VOTE : In favor - 2 (Frizelle, Trepanier) Opposed - 5 (Serio, Nickerson, Soule) The motion fails and the petition is not reconsidered. The #illows - Special Permit o Willow/Turnpike'Streets Sitting: Serio, Trepanier, Nickerson, Vivenzio Member Vivenzio pointed out that it has not been two years since the Board previously denied a Special Permit for a heliport and that the Board must find that there have been changes since the previoius petition. The Board felt that the change in the proposed location of the heliport allowed this petition. NOTION: by Mr. Nickerson to deny the Special Permit. SECOND: by Mr. Vivenzio VOTE : Unanimous - motion carries - petition denied. Landers~ ¥incent - Variance - Osgood Street Sitting: Serio, Nickerson, Soule, Foulds MOTION: by Mr. Nickerson to grant the variance subject to the following conditins: 1. A green barrier~ consisting of a minimum of 4' high hemlocks, spaced 4' on center, be planted and main- tained starting $0' back of the N~ lot line and ex- tending 136.78 ' to the point at the end of land N/F of Chepulis, notwithstanding any fencing required under the provisions of the Zoning By Law. 2. The plan be revised to include a Board of Appeals signature block. SECOND: by Mr. Foulds VOTE : Unanimous - motion carries - petition granted.
