HomeMy WebLinkAbout1980-08-11August 11, 1980 - Monday Regular Meeting The BOARD OF APPEALS held & Regular Meeting on Monday evening, Augms~ 11, 1980 aS 7:30 P.N. in She Town Office Meeting Roce~. The following members w~re present and voting: Frank Serio, Jr., Chairman, Alfred E. Frizelle, Esq, Richard J. ~epanier, Esq., William J. Sullivan, and Maurioe S. Foulds. PHILLIP J. COPPOLA - The clerk read the legal notice. Atty, Stephen Duly spoke for the applicant. He stated that Mr. and Mrs. Ceppola purchased the property located at 2~4 B~entwood Circle in July, ~980 from Jea-~e D. Rich. They are u~able to comHlete the passing of papers because the garage on the premises is 8" short of the side set back regulation. He noted that a building permit was issued to Ms. Rich and it wasn't until Mr. Coppola purchased the proper~y that the problem was foumd. He stated that the granting of the variance will not derogate from the intent of the Zoning By-Law. G~orge Schruender spoke in favor of the applicant and there was no spposition. Paul Thorn, Brentwood Circle, questioned how this kind of an error could occur. Charles Foster, Building Inspector, gave him an explanation that now plot plans are being required by the Board. 0~ a motion by S~_llivan and seconded by Trepanier, it was voted unanimously to grant the variance. In other business, Mr. Frizelte nominated Mr. TrepamAer for the posi~n of Clerk for the Board amd Mr. Sullivan seconded the motion. The vote ~as Mr. Serio read the letter from Thomas McEvoy on Mr. Noble. ARLINGTON T~UST CO. - No petitioner or representative from the ATC showed up at She meeting. The hearing was re-scheduled for I~ptember 15, 1980. Mr. Sullivan raised the question on ATC hearing --does the Board h~ve enough time to delay that motion? The members read the ~lans and' the legal notice was read by Mr. Trepanier. O~ a motion by ~rizelle aud~seco~ded by Mr. Trepanier, it was voted unanimously to continue the hearing for ATC until the next meeting.
