HomeMy WebLinkAbout1981-08-10August 10, 1981 Regular Meeting The BOARD OF APPEALS held a regular monthly meeting on Monday evening, August 10, 1981 in the Town Office Meeting Room with the following members present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice Chairman~ Richard J. Trepanier, Esq., Clerk~ Walter F. Soule; and Raymond A. Vivenzio. PUBLIC HEARINGS Callahan, K__evin - Special Permit - Middlesex Street The Clerk read the legal notice. Mr. Callahan was present and made the following points; - He wishes to convert a third floor attic into an apartment. - There will be no exterior changes. - There will be two means of ingress/egress. - A one-bedroom unit is proposed. - There is ample space for 6 cars. - There are other multi-family dwellings in the neighborhood. Following a discussion between Mr. Callahan and the'Board members, it was determined that a variance is needed on the property as part of the Special Permit request, Mr. Callahan withdrew his petition without predjudice for a future submission in correct form. Edward Variance ~ Sawmill Road The lerk read the legal notice Atty Joseph Mahoney was present for the applicant and made the foll,~win? points: A error was made by the engineer which led to the placement o the house 10 feet too close to the lot line. he second error was that the wrong petitioner was before the oard last month (the engineer - not the owner). f the variance is not granted, Mr. Plugis, the owner, will uffer a hardship. - he house is almost complete. August 10, 1982 Regular Meeting Plugis - continued Mr. Plugis owes the bank $80,000 and the bank will not renew the loan with the cloud on the property. It would cost between $30,000 and $35,000 to move the house. This is a situation where, since plot plans are required, it is quite common to receive a variance. The granting of the variance will not derogate from the intent of the Zoning By Law. The error was discovered several months a~o and construction ceased at that time. A land swap is not possible because the house next door would then be in violation. No one spoke in favor or opposition to this petition. MOTION: SECOND: VOTE : by Mr. Trepanier to grant the variance as requested. by Mr. Frizelle Unanimous - motion carries. Chairman Serio left the meeting due to illness and passed the chair to Vice Chairman Frizelle. Boston Hill Ski Area Earth Removal Permit Because the Building Inspector is not present, the Board tabled for futJre discussion. Follansbee, Scott Earth Removal Permit Cont'i-nued from July 31, 1981 Sharpner's Pond Road A discussion took place on the assignment. Member Frizelle wants the original assignment from V. Scott Follansbee and William Kon- stantinokas to the Town of North Andover. He instructed the secretary to talk to the Town Treasurer and the Town Accountant.
