HomeMy WebLinkAbout1981-10-13October 13, 1981 Regular Meeting The BOARD OF APPEALS held a regular monthly meeting on Tuesday evening, October 132 19B1 in the Town Office Meetin9 Room with the following members present and voting: Alfred E. Frizelle, Esq., Vice Chairman; William J. Sullivan; Augustine W. Nickerson; Walter F. Soule~ and Raymond A. Vivenzio, Esq. Associate Member Maurice S. Foulds was also present at the meeting but not sitting on the public hearings. Buildin§ Inspector Foster was present also. PUBLIC HEARINGS Sullivan, Vera (Estate of) - Variance - Bradstreet Road Member Vivenzio ~read the legal notice. Mr. Thomas Sullivan was present, representing his mother's estate. His points were: The garage is 11 feet from the boundary. The property was purchased in 1949 by Mr, Sullivan's parents. A recent plot plan required by the bank for the sale of the property revealed the violation. No one spoke in favor or opposition to the petition and there was no correspondence. MOTION: by Mr. Sullivan to take under advisement. SECOND: by Mr. Nickerson VOTE : Unanimous - motion carries. Whittaker, Richard Variance Greenhill Avenue Member Vivenzio read the legal notice. Mr. Whittaker was present and made the following points~ - He wishes to add an additional 18 feet to the existing garage which is now 14' x 22'. - He will only have a 9 foot setback. - The addition is needed for his car, truck, and children's toys. - The present garage would remain the same. - There is currently 80 feet between the houses. October 13, 1981 -2? Regular Meeting Whittaker - continued - The addition cannot be located elsewhere because of a finished patio. No one spoke in favor of the petition. Three neighbors spoke in opposition. MOTION: by Mr. Sullivan to take under advisement. SECOND: by Mr. Soule VOTE : Unanimous - motion carries. OTHER BUSINESS Mr. John Gallagher, President of Delta F. Corporation, asked to speak to the Board. He is aware of a piece of property on Route 114, which does not meet the requirements of the Zoning By Law. He asked for an informal discussion on the variances needed and Member Frizelle informed him that the Board does not conduct informal discussions nor does it give advise. Mr. Gallagher then presented an existing decision on the pro- perty and said he is confused on whether front or rear variances are needed. Member Frizelle emphasized the 100 foot set back requirement on Route 114 to Mr. Gallagher. DECISIONS Sullivan - Bradstreet Road MOTION: by Mr, Nickerson to grant the variance SECOND: by Mr. Soule VOTE : Unanimous - motion carries. Whittaker - Greenhill Avenue MOTION: SECOND: VOTE : by Mr. Sullivan to deny the variance by Mr. Vivenzio Unanimous - motion carries. October 13, 1981 -3- Regular Meeting OTHER BUSINESS Building Inspector Charles Foster asked the Board to sign an Earth Removal Permit for Mr. Robert W. Dunn of the Boston Hill Ski Area. The Board reviewed the case with Mr. Foster and a discussion followed on a question of whether the earth he has removed so far should be counted in the 5,000 cubic yards. Member Frizelle recommended that the Board sign the permit. Note: The permit calls for the Chairman's signature. The Vice Chairman signed in the Chairman's absence.
