HomeMy WebLinkAbout1970-04-13Monday - April 13, 1970 Regular Meeting & Hearings The BOARD OF APPEALS called a meeting for Monday evening, April 13, 1970 at 7:30 P.M. in the Town Office Building. The follo~-ing members were present: Arthur Drummond, Chairman; Philip Arsenault, Esq. and Associate Member James A. Glynn. Mr. O'Leary was ill, Mr. Scott was on an assignment for the government and Mr. Leonard was out of town on business. There were 15 people present for the 3 hearings. Since there was no quorum, a meeting could not be held. It was decided that the meeting and hearings will be held on Tuesday evening, April 215 1970 at 7:30 P.M. Tuesday - April 21, 1970 Meeting & Hearings The BOARD OF APPEALS held their regular meeting on Tuesday evening, April 21, 1970 at 7:30 P.M. in the Town Office Building. The following members were present and voting: Arthur Drummond, Chairman; Daniel T. O'Leary, Secretary; Philip Arsenault, Esq., Donald J. Scott aud Associate Member James A. Glynn sitting in place of member Leonard. There were six people present for the hearings. 1. HEARING: Salvatore Fichera. Mr. O'Leary read the legal notice in the appeal of Salvatore and Frances Fichera who requested a variance under Section 6.31 and 6.62 of the Zoning By-Law so as to permit the combination of six lots presently having a 50-foot frontage, into four lots each having a 75-foot frontage and to decrease front depth to 20 feet, on the premises, located at the north side of Shawsheen Road at the corners of Inglewood and Jetwood Streets. Atty. Charles W. Trombly, Jr., represented the petitioners since his father was unable to attend the meeting. He explained Mr. Fichera's request to combine the six lots into four lots, each being 75 x 100. This same petition had been filed and refused in 1966. At that time it was feared that there would be flooding from the Shawsheen River. Nothing has happened and they now feel that the land can be divided. It is presently vacant land. If homes were built it would add to the tax base. The land would be filled in and it would improve the neighborhood and would not derogate from the Zoning By-Law. Mr. Paul Timony, Harwood Street, an abutter, spoke in opposition, say"lng such small lots would overcrowd the area. Mr. Trombly said there are many lots in the area of the same size. He believes there is also sewerage there. Mr. Timony complained about alot of homes having water in the cellars. ~Lr. Scott made a motion to take the petition under advisement. Mr. O'Leary seconded the motion and the vote was unanimous. 2. HEARING: Joseph B. O'Connell. Mr. O'Leary read the legal notice in the appeal of Joseph B. & Carol J. O'Connell who requested a variance under Section 7.21 of the Zoning By-Law so as to permit the erection of a 2-car garage on the premises, located at the April 21, 1970 - cont. east side of Marian Drive, known as 116 Marian Drive. He also read the refusal from the Building Inspector who refused a building permit because the proposed garage would be nearer the lot line than the Zoning By-Law allowed. Mrs. O'Connell spoke on her own behalf and stated that the garage could not be placed on the lot in any other way and that the variance was necessary because it would be coming 16 feet from the sideline adjacent to the lo$ of Joseph Winning. Joseph Winning, an immediate abutter, spoke in favor of the.variance, and ex- plained the O'Connell's problem more fully. He said his home would be 76 feet away from the garage which is a sufficient distance and he had no objections whatsoever. There was no opposition. Mr. O'Leary made a motion to take the petition under advisement; Mr. Glynn seconded the motion and the vote was unanimous. 3. HEARING: Frank C. Gelinas. Mr. O'Leary read the legal notice in the appeal of Frank C. Gelinas who requested a variance under Section 7.21 of the Zoning By-Law so as to permit the erection of a porch and garage to the existing dwelling on the premises, located at the south side of Gray Street, approx. 50 feet from the corner of Boston Street and known as No. 56 Gray Street. He also read the refusal from the Building Inspector who refused a building permit because the proposed construction would be nearer the lot line than the Zoning By-Law allowed. Mr. Gelinas spoke on his own behalf and stated this was the only way the garage could be added. The other end of the house is the bedroom area. He needs the extra room for his growing family and he would like to remain in his present home because he likes the neighborhood. Emily Kwet, an immediate abutter, spoke in favor of the variance. There was no opposition. Mr. Glynn made a motion to take the petition under advisement; Mr. Arsenault seconded the motion and the vote was unanimous. WATSON GRAVEL PIT: A report was received from the Building Inspector relative to the operations and inspection he had made of the Watson gravel pit. The Board had requested this inspection after receiving a letter from the ~onservation Commission relative to the conditions there. The report stated he is conforming with the regulations of the Board of Appeals. Mr. O'Leary made a motion to renew the permit. There was no second. Mr. Arsenault thought that the area should be covered with loam as he goes along with the operation, such areas as are practical. After more thorough discussion the members decided they would view the area and report at the next meeting. DECISIONS: 1. Fichera: the motion. Scott - no. Mr. Glynn made a motion to grant the variance. Mr. O'Leary seconded The vote was Glynn and O'Leary - yes and Drummond, Arsenault and The variance is therefore denied. They feel there is no hardship.
