Regular Meeting & Hearings
The BOARD OF APPEALS held their regular meeting on Monday evening, Sept. 21,
1970 at 7:30 P.M. in the Town Office Building. The following members were present
and voting: Arthur R. Drummondt Chairman; Daniel T. O'Leary, Secretary; Donald J.
Scott, J. Philip Arsenault, Esq. and Associate Member Joseph A. Miragliotta, Esq.
Regular Member Donald J. Leonard has resigned because he moved to Indianapolis.
There were 18 people present at the meeting.
1. HEARING: Charles J. Adams.
Mr. O'Leary read the legal notice in the appeal of Charles J. Adams who re-
quested a variance under Section 7.23 of the Zoning By-Law so as to permit the
erection of a two-car garage on the premises, located at the north side of Greene
Street; at the corner of Douglas Road and known as 183 Greene Street. He also
read the Building Inspector's refusal of a building permit because the garage would
be closer to the side lot line than is allowed.
Mr. Adams spoke in his own behalf and explained that he has owned the property
since 1948 and that this proposed location is the only way the garage could be
placed. The proposed garage would be 7 feet from the side lot line, and Mr.
Hertrich, the immediate abuttert told Mr. Adams he would be in favor of it. The
garage would cost $3,000 to build and would be in keeping with the neighborhood.
There are other garages in the area that come closer to the lot line than his pro-
posed garage; one garage is 4 feet and another is only'3 feet from the lot lines.
No one else spoke and there was no opposition. Mr. O'Leary made a motion to take
the petition under advisement; Mr. Miragliotta seconded the motion and the vote
was unanimous.
2. HEARING: Mangano Realty Trust.
Mr. O'Leary read the legal notice in the appeal of Mangano Realty Trust who
requested a variance under Section 6.&l of the Zoning By-Law so as to permit the
erection of a bank on the premises, located at the east side of Chickering Road
at the intersection of Chickering Road, Pleasant Street and Bunkerhill Street.
He also read the Building Inspector's letter of refusal of a building permit because
the petitioner didnot have the re~t~ed areal or a lot ina General Business area.
Andrew F. Coffin spoke for the petitioners, four of whom were also present. Mr.
Coffin and Mr. Santo Mangano stated that a reputable bank was interested in estab-
lishing a bank in this location. They are asking for a variance as to the area to
Allow a lot of 15,900 square feet instead of the 25,O00 square feet as is required
for a lot in a general business area. The building meets all of the setback re-
q,,i~ements. They stated that they could erect a building on the land as it is
without having to come before the Board fer~'a variance but the b~uk wants an option
to purchase the land and it would have to be divided in order to do this. There
would be approximately 30 parking spaces provided; access would Be from Chickering
Road and egress would be onto Bunkerhill Street.
Several abutters in the Bunkerhill and Camden Street area were opposed to the
granting oft he variance because of an existing traffic problem and the hazardous
conditions there now and they also felt the area was not large enough to provide
adequate parking for the bank customers.

Mr. Scott made a motion to take the petition under advisement; Mr. O'Leary
seconded the motion aud the vote was un~!mous.

A letter was received from Atty. John J. WAll4-~ advising the Board that he
and Atty. Fenton have negotiated a settlement concer~ the variance which the
Board granted to Mr. Welch so that no further action or consideration ~ill be
necessary by this Board.
DECI SIOMS:
1. CH~RT.~.~ J. ADAMS:
Mr. O'Leary made a motion to GRANT the variance; seconded by Mr. Scott and
voted unanimously by the Board because the petitioner ~ould suffer substantial
hardship, financial or othereise; it would not materially affect the general
character of the neighborhood and will not substantially cause derogation from the
intent and purpose of the Zo~4-~ By-Law.
2. MAN~ANO REALTY TRUST:
Mr. Scott made a motion to DENY the variance~ seconded by Mr. Miragliotta
and voted unanimously by the Board. The Board feels there is no hardship in-
volved since a building could be erected without requiring a variance from the
Board of Appeals and the variance they are seeking for an area of 15,900 square
feet instead of the req,,~ed 25,000 square feet is too great a deviation to be
allowed from the Zo~-g By-Law.
Due to the holiday on Monday, October 12th, the next meeting ~ill be held on
Monday evening, October 19, 1970.
The meeting adjourned at 9:00 P.M.
