My client, E &F Builders, has an agreement to purchase two separate but adjoining pieces of property from one seller, The Bilodeau Realty Trust. The first piece of property is Lot 36, Martin Avenue, Assessors Reference Map 45G, Block 36 which consists of approximately 9,000 square feet and is recorded at the Essex North Registry of Deeds at Book 4072, Page 142. The second piece of property is Lot 20, Martin Avenue,Assessors Reference Map 45G, Block 20 which consists of approximately 9,000 square feet and is recorded at the Essex North Registry of Deeds at Book 4072, Page 141. The properties described above are vacant and have no structures on either site. As shown in the Application for Building Permit submitted to your office and on the Plan prepared by Frank S. Giles II, titles Plan of Land, Location, Lots 147-150 Martin Avenue, North Andover, MA Drawn for Scott Follansbe, the Builder/Applicant is desirous of constructing a two family duplex on the above properties. The Zoning District is Residential 4 for these properties. A review of the zoning code for this location reveals that by utilizing both properties, the proposed structure meets or exceeds the minimum zoning requirements set forth for an individual lot, including the lot area, structure height, street frontage, front, side and rear setbacks. However, as we discussed, the proposed structure would require a special permit from the North Andover Zoning Board of Appeals only because we are seeking to construct a two family structure. It is my understanding that a single family structure would be allowed as a matter of right. I would like to make the following comments regarding the proposed structure to be built. • In the letter to Mr. Brown dated July 9th, 2010,and to this Board dated July 13th, it states the property as being "two separate but adjoining pieces of property" however, as shown on the Building Permit Application, it is a merged lot,2 lots to 1 lot. This is one buildable lot. As I understand it, in order to make 2 lots,the Planning Board would need to approve a subdivision of the lot, and there is inadequate lot size to do this. • According to the Special Permit, Plan of Land,Section 10A Section III,this is considered a Major Project because the building area is greater than 2000 square feet. Therefore as stated on the Special Permit"Major Projects shall require that plans must show detailed utilities, soils and topographic information". Where is this information shown on the plans submitted? It would appear that this application is incomplete without this information. • Also in the letter dated July 13th to the Zoning Board of Appeals, it states on page 2, number 2,that the immediate adjacent property is a two-family structure. The applicant"believes that the proposed structure compliments and reinforces the design features of this neighborhood". Stating that"this proposed structure is consistent in size, structure and appearance with other homes in the immediate vicinity". In 1981,the structure at 40/42 Martin Ave was constructed, as you can see by the photos,this was similarly built as a 2 family on one lot of land. It is a monstrosity, and is completely out of character with the neighborhood. This is exactly what the neighborhood is trying to prevent from happening once again. This proposed structure absolutely is NOT consistent in size, structure and appearance with other homes in the immediate vicinity.The neighborhood is lined with single family homes with yards, not 2 and 3 family structures taking up the entire buildable area of the lot. This proposed structure is over 148 feet in length along Martin Ave. NO other home in the neighborhood even comes close to this. • The July 13th letter also states in#5 states that the proposed structure is in harmony with the purpose and intent of the Zoning By-Law and the neighborhood presently is made up of a combination of single family dwellings, two-family, and three family dwellings. This is furthest from the truth. Attached are pictures of the surrounding homes. • Additionally,the Zoning Bylaw states that the Zoning Board of Appeals may approve a special permit for a proposed use of a building, dwelling or structure provided by Section 4.122.14.A.b.,4.122.14.6 or 4.122.14.0 upon finding that the application complies with the purpose of this Bylaw,and is consistent with the use of the site for the purpose permitted within the Residential 4 District.The ZBA shall consider the following criteria in addition to those listed in Section 10.31: "Achieve compatibility with the established pattern of uses in the district. The residential 4 District consists primarily of single-family dwellings near the Stevens Memorial Library Area and OFF OF MASS AVE,AND MORE COMPACT NEIGHBORHOODS WITH A MIX OF RESIDENTIAL USES TOWARD WAVERLY ROAD. NEW CONSTRUCTION OR SUBSTATIAL ALTERATION OF BUILDINGS MUST COMPLIMENT AND REINFORCE THE DESIGN FEATURE OF THESE NEIGHBORHOODS". This proposed structure does not compliment and reinforce the design features of the neighborhood! This property is zoned for a single family home and that is what should be allowed to be built. I would encourage you to drive through the neighborhood to see for yourself the single family homes which currently make up the neighborhood.
