HomeMy WebLinkAbout1995-05-15 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES May 15, 1995 CALL TO ORDER: John P. Savastano, Chairman, called the meeting to order at 6: 00 PM. ATTENDANCE: The following were present: John P. Savastano, Chairman; Kenneth C. Crouch; Kevin Foley; John Leeman; (Donald Stewart not present) ; James P. Gordon, Town Manager; Kevin Mahoney, Director of Finance & Administration. LICENSING: The Board of Selectmen approved 4-0 issuance of a one-day liquor license from 5 - 8 PM at Stevens Estate for May 18, 1995. APPOINTMENTS: Division of Public Works - The Board of Selectmen approved the Town Manager' s appointment of Jerome Welch, John D'Aoust and Kurt Gaffney to the vacant positions of Water Treatment Plant Operator. Additionally, the Board approved the Town Manager appointment of Keith Sequin and David Horan, as laborers in the Division of Public Works to fill two vacant positions. DALE STREET - RIGHT OF FIRST REFUSAL: (Lot D) . The Board voted 4-0 to not exercise its right of first refusal for the purchase of the above referenced lot. PROCLAMATION - EMERGENCY MEDICAL SERVICES WEEK: The Board of Selectmen voted to proclaim the week of May 14 - 20, 1995, as Emergency Medical Services Week. POLICE DEPARTMENT - ACCEPTANCE OF GIFTS (TWO BICYCLES) : The Board voted to accept the gift of two new Trek Bicycles from Sports Events Unlimited. STILLWELL CLAIM - REIMBURSEMENT: The Board voted to direct the Town Manager to reimburse Mr. Charles Stillwell for his $ 500 claim in connection with the property damage he sustained to his car when a tree limb fell on it. Additionally, the Board directed the Town Manager to request Town Counsel to address this issue with MIIA. BOND ISSUE - MASS. WATER POLLUTION ABATEMENT TRUST: The Board approved the Bond Sale, Mass. Water Pollution Abatement Trust, as proposed by Kevin Mahoney, Director of Finance & Administration, and voted the following actions: VOTED: 1. That the Town shall issue a bond or bonds in an aggregate principal amount not to exceed $ 2, 422, 745 (the "Bonds") pursuant to Chapters 29C passed May 7, 1987 (Article 37) as reaffirmed October 5, 1989, (Article 6, May 4, 1992) (Article 8, and May 4, 1993, (Article 7 items 23 and 31) , for construction of sewers and other water pollution control facilities (the "Project") ; 2. That in anticipation of the issuance of the Bonds the Treasurer is authorized to issue an interim loan note or notes (the "Notes") from time to time in an aggregate principal amount not to exceed $ 2, 422, 745; 3. That each Bond or Note shall be issued as a single registered security, and sold at the Massachusetts Water Pollution Abatement Trust (the "Trust") at a Board of Selectmen Minutes May 15, 1995 Page 2. price of not less than the principal amount of the Bond or Note, less the Town' s allocated share of the costs of issuance of the Trust' s bonds; 4. That the Treasurer is authorized to determine the date, the form, the maximum interest rate and the principal maturities of each Bond and Note, and to execute a Loan Agreement or Agreements with the Trust with respect tot he sale of the Bonds and Notes, such date, form and maturities and the specific interest rate or rates of the Bonds and Notes to be approved by a majority of the Board of Selectmen and the Treasurer and evidenced by their execution of the Bonds or Notes; 5. That all action taken to date by the Town and its officers and agents to carry out the Project and its financing, including the execution of any loan commitment or agreement by the Treasurer, and hereby ratified, approved and confirmed; and 6. That the Treasurer and the other appropriate Town officials are each hereby authorized to take any and all actions necessary and convenient to carry out the provisions of this vote, including execution and delivery of the Loan Agreements and the Project Regulatory Agreements relating to the Project. INTERIM TOWN MANAGER APPOINTMENT - KEVIN MAHONEY: The Board voted 3-1 to appoint Kevin Mahoney, Director of Finance & Administration to the position of Interim Town Manager to become effective upon Mr. Gordon' s effective date of retirement. TOWN MANAGER SEARCH: The Board discussed at length a process for moving forward with the Town Manager search. The Board decided to schedule a work session, at which time a definitive process will be established. Clerk
