HomeMy WebLinkAbout2003-05-22 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES MAY 22, 2003 CALL TO ORDER: Rosemary Smedile called the meeting to order at 4:15 PM at Town Hall. ATTENDANCE: The following were present: Rosemary Smedile, Chairman; James Xenakis; Donald B. Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. Note: Wendy Wakeman was absent. NEW BUSINESS: Temporary Construction License: Massachusetts Electric Company. Massachusetts Electric Company requested permission for a Temporary Construction License and Permanent Easement off Foster Street for the purpose of placing guys and anchors on town-owned property to provide utility services to customers in the Town of North Andover. Due to the fact that the easement requested is over land held by the Town under the care and custody of the North Andover Conservation Commission, Town Meeting approval, special legislation approved by the Massachusetts legislature, and approval of the Conservation Commission and the Board of Selectmen is required before the permanent easement may be granted. Therefore, Massachusetts Electric is requesting a temporary license in order to be able to proceed immediately with the project, as it is likely that legislative approval of the special legislation authorizing the easement may take some time. In consideration of the grant of the Temporary License and Permanent Easement, Massachusetts Electric has agreed to pay to the Town the amount of Thirty Thousand Dollars upon the execution of the Temporary Construction License. This amount will be deposited to the General Fund. Massachusetts Electric has also agreed to provide the sum of Twenty Thousand Dollars toward the purchase of a specific item to be selected by the Town. James Xenakis made a MOTION, seconded by Donald Stewart, to approve the request of Massachusetts Electric Company for a Temporary Construction License and Permanent Easement on town-owned land off Foster Street. The Board of Selectmen also accepted the funds donated to the Town in consideration of the grant from Massachusetts Electric Company. Vote approved 3-0. Note: Mark Caggiano arrived at 4:20 PM Property on Rea Street—Chapter 61A The Town Manager said the Board voted at a previous meeting not to exercise the right of first refusal on a parcel of land on Rea Street. A letter was sent to the owner with the Board's intent. There is also a legal "Waiver of Right of First Refusal" on the Rea Street property that the Board must sign as a formality. As the Board signed the document, the Assistant Town Clerk notarized it. Proclamation: Sean R. Gallagher Day. On Memorial Day the Town will be honoring the memory of Cpl Sean Gallagher. Twenty years ago on October 23, 1983, Cpl Sean Gallagher USMC was killed in a Terrorist attach on the Marine Barracks in Beirut, Lebanon along with 240 fellow Marines. The North Andover Patriotic Observation Committee respectfully request the Town of North Andover recognize the dedicated sacrifice made by Cpl Sean Gallagher, by proclaiming October 30, 2003 (Date of Birth) as Sean R. Gallagher Day. James Xenakis made a MOTION, seconded by Donald Stewart, to recognize and observe October 30, 2003 by proclamation, Cpl Sean Gallagher Day. Vote approved 4-0. Board of Selectmen Minutes May 22, 2003 2 Future Dates for Selectmen Meetings. Town Manager Mark Rees suggested additional meetings to discuss Bond Anticipation and the NESWC Contract on Monday, June 16, 2003 and possibly Monday, June 30, 2003. Due to a conflict the June 2, 2003 meeting would be changed to Tuesday, June 3, 2003. ADJOURNMENT: Mark Caggiano made a MOTION, seconded by Donald Stewart, to adjourn the meeting at 4:45 PM.
