HomeMy WebLinkAbout2004-12-20 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES DECEMBER 20, 2004 CALL TO ORDER: Rosemary Connelly Smedile called the meeting to order at 7:00 PM at the Stevens Memorial Library. ATTENDANCE: The following were present: Rosemary Smedile, Chairman; Wendy Wakeman; James Xenakis; Donald B. Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to take out of order New Business Recognition —Oaks Station Trading Company. Vote approved 5-0. John Dodson introduced his antique business, Oaks Station Trading Company located at 75 Main Street. The Board of Selectmen thanked him for locating his business in town and presented Mr. Dodson a certificate of appreciation. EXECUTIVE SESSION: Wendy Wakeman made a MOTION, seconded by Donald Stewart, to move into Executive Session to discuss Real Estate and Pending Litigation. Vote approved 5-0. The Board of Selectmen was individually polled and each voted to move into Executive Session. Donald Stewart yes; James Xenakis yes; Mark Caggiano yes; Wendy Wakeman yes, and Rosemary Smedile yes. Vote approved 5-0. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT: Appointments by the Board of Selectmen Wendy Wakeman made a MOTION, seconded by Rosemary Smedile, to approve the following appointments recommended by the sub-committee. Vote approved 5-0. Brenda Pierro Savary, Commission of Disability Issues, 3 year term Deidre Edwards-Reid, Council on Aging, 3 year term Bonnie Wolstromer, Local Arts Council, 3 year term Susan Hoffman, Local Arts Council, 3 year term Olien Lu, Youth Services Board of Directors, 3 year term Appointments by the Town Manager The Town Manager recommended John F. Watters and Alberto Angles to the Merrimack Valley Planning Commission. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve the Town Manager's recommendation to appoint John F. Watters and Alberto Angles to the Merrimack Valley Planning Commission. Vote approved 5-0. CONSENT ITEMS: Massachusetts Highway has approved a reduction of the posted speed limit signage on Foster Street and Summer Street as requested by the Town. Mass Highway recommended additional signage be erected on the subject roadways and requests the Board's approval. James Xenakis made a MOTION, seconded by Wendy Wakeman, to approve the additional signage and sign the regulation document. Vote approved 5-0. Board of Selectmen Minutes December 20, 2004 2 LICENSING COMMISSIONERS: Wendy Wakeman made a MOTION, seconded by Donald Stewart, to move into Licensing. Vote approved 5-0. Note: James Xenakis excused himself from the meeting. 2005 License Renewals Licensing Chairman Donald Stewart recommended that the Board approve the renewal licenses but authorize the Chair of Licensing to withhold issuance of a license until such time as a few businesses come into compliance with town regulations. Stewart commended the Assistant Town Clerk Janet Eaton for her outstanding performance associated with license regulations. PUBLIC HEARINGS: Massachusetts Electric Pole Petition &Verizon New England Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve the following petitions from Mass Electric and Verizon New England. OLD BUSINESS: New Police Station At their last meeting the Board requested the Police Building Committee do additional work to reduce the overall cost of the proposed new police station. The committee trimmed the cost of the station by $1.7 million by cutting $265,000 in construction cost; $141,000 on communications equipment, computers and furniture; $70,000 in savings of moving expenses and miscellaneous items; and $135,000 by changing the material planned for part of the building's exterior. The bulk of the savings calculated into the new estimate comes from the sale of the old police station and adjacent land. The town estimates realizing $900,000 on that real estate, and selectmen suggested the town may be willing to change the zoning of that parcel. This brought the new figure to $7.3 million. Voters at Town Meeting will be asked to appropriate $8.2 million for the project until the current police station is sold. The Town Manager said that if the Board of Selectmen decide to go forward with this proposal, the Board must vote tonight to schedule a Special Town Meeting on February 7, 2005, open the warrant, and include the two articles, and close the warrant. Selectmen discussed whether a special town meeting in February had to be held or if the matter could hold until the Annual Town Meeting in May. By holding a Special Town Meeting first, voters have the chance to have all their questions answered including the amount of the override and then head to the polls informed on March 29, 2005. Voters would be voting for a Proposition 2 'h override to fund the new Police Station. Board of Selectmen Minutes December 20, 2004 14 Selectmen Donald Stewart said many would see $2,500 as wasteful and the Special Town Meeting would only attract those specifically invested in the police station. Stewart predicted the override would fail. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to hold a Special Town Meeting on February 7, 2005. Vote 4-1. Donald Stewart opposed. Article is as follows: To see if the Town will raise and appropriate $8.2 million for constructing, originally equipping, and furnishing a new police station, including any necessary additional architectural services, construction management services, demolition and site improvements and to meet this appropriation the Treasurer, with the approval of the Board of Selectmen, is authorized to borrow$8.2 million under Chapter 44 of the General Laws, provided, however, that no expenditure shall be made, and no debt may be incurred, unless the town has voted at an election to exempt the principal and interest costs from the provisions of Proposition 2 %, so called, and furthermore, should the Town sell all or part of the land and buildings where the current police station is located, that the proceeds from that sale be used to defray the debt service of the new police station and that this appropriation be expended under the direction of the Town Manager who shall be authorized to take any other action necessary to carry out this project or take any other action relative thereto. TOWN MANAGER'S REPORT: The Town Manager will be representing the Town at the Merrimack Valley Chamber of Commerce Mayors and Town Managers Breakfast forum held on January 14, 2005 at Andover Country Club. The Board of Selectmen has been invited to attend this breakfast as well. Please notify Adele if you plan on attending. On Friday, December 10, 2005, Deputy Fire Chief William Martineau, Police Lt. John Carney and DPW Director Bill Hmurciak and Mark Rees attended a meeting of the North East Homeland Security Regional Advisory Council. This council, similar to four other regions in the state, was established to enhance regional emergency preparedness. Fire Chief William Dolan and Communication Supervisor Richard Boettcher sit on the Council. The Revenue/Fixed Cost Committee has been meeting on a regular basis preparing their recommendations for FY06 revenue projections and fixed costs. Their report should be issued early next week. With the successful testing of the new elevator in the renovated town hall, the town can now begin to hold public meetings at this location. As such, the January 10, 2004 Selectmen's meeting will be held in the Selectmen's meeting room. Board of Selectmen Minutes December 20, 2004 15 Assistant Town Manager Ray Santilli reported that the public auction brought in revenue of$17,200, which would be deposited in the Town's General Fund.
