HomeMy WebLinkAboutBOS Min 11-01-04 BOARD OF SELECTMEN MINUTES NOVEMBER 1, 2004 CALL TO ORDER: Rosemary Connelly Smedile called the meeting to order at 7:00 PM at the Senior Center. ATTENDANCE: The following were present: Rosemary Smedile, Chairman; Wendy Wakeman; James Xenakis; Donald B. Stewart; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. Mark Caggiano was tardy. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to take out of order Communications, Announcements and Public Comment Item IVA, Salem Five Savings Bank Recognition. Vote approved 4-0. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT The Board of Selectmen welcomed Ms. Lois McGinnes, Branch Manager of Salem Five Savings Bank to the Town of North Andover and presented her with a Certificate of Appreciation. Mark Caggiano arrived at 7:05 PM. CONSENT ITEMS: Wendy Wakeman made a MOTION, seconded by Donald Stewart, to take out of order Consent Items VA and VB Veterans Day Parade and Acceptance of Donations for Support the Troops program. Vote approved 5-0. Wendy Wakeman made a MOTION, seconded by James Xenakis, to approve the request by Ed Mitchell and the Patriotic Observation Committee to conduct a parade and ceremonial services on November 11, 2004 in commemoration of Veterans Day. Vote approved 5-0. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve the request by Ed Mitchell, Director of Veterans Services to accept donations for the Support the Troops program and to establish a new budget line item for the purpose of mailing packages to the troops stationed in Afghanistan and Iraq. Vote approved 5-0. EXECUTIVE SESSION: Wendy Wakeman made a MOTION, seconded by James Xenakis, to move into Executive Session to discuss real estate matters. Vote approved 5-0. The Board of Selectmen was individually polled and each voted to move into Executive Session. Donald Stewart yes; James Xenakis yes; Mark Caggiano yes; Wendy Wakeman yes, and Rosemary Smedile yes. Vote approved 5-0. APPROVAL OF MINUTES: Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to approve the minutes of September 20, 2004, Executive Session as written and Open Session as written. Vote approved 5-0. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT: Festival Committee The Festival Committee's representative Joan Heafy, requested the board's permission to solicit businesses in North Andover for donations toward the 4th of July Fireworks Fund. Butcher Boy Market's owner Tom Yameen has begun giving financial support to the Festival Committee through fundraisers at his place of business. Mr. Yameen has offered to work with the Festival Committee in this fundraising effort. James Xenakis made a MOTION, seconded by Wendy Wakeman, to approve the Festival Committee to solicit and accept donations for the 4th of July fireworks celebration. Vote approved 5-0. Board of Selectmen Minutes November 1, 2004 2 Boston Red Sox Proclamation At the request of the Chair, Rosemary Smedile the Town Manager drafted a Proclamation honoring the recent accomplishments of the Boston Red Sox Baseball Club. The Town Manager asked the board to sign the proclamation and send it to the owner of the Red Sox and local newspapers. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to approve the Proclamation to the Red Sox. Vote approved 5-0. CONSENT ITEMS: Santa Parade The Festival Committee and the Police Association of North Andover requested permission to conduct their annual Santa Parade on November 27, 2004. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve the annual Santa Parade on November 27, 2004 subject to favorable review by the Fire, DPW and Police Departments. Vote approved 5-0. LICENSING COMMISSIONERS: Wendy Wakeman made a MOTION, seconded by Donald Stewart, to move into licensing. Vote approved 5-0. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to approve a one-day beer and wine license for St. Gregory's Church Armenian Apostolic Church on Saturday, November 13, 2004 from 7:00 PM — 10:00 PM for a Comedy Night Fundraiser. Vote approved 5-0. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to move out of licensing. Vote approved 5-0. PUBLIC HEARINGS: Massachusetts Electric Pole Petition. Plan #J53/483—Place new JO pole 1355-50 with anchor for underground service to 316 Johnson Street. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve Plan #J53/483. Vote approved 5-0. OLD BUSINESS: The Town Manager presented the board with a revised FY06 Budget Policy Statement. He asked the board to adopt the preliminary document as required by Town Charter at their meeting tonight November 1, 2004. Wendy Wakeman suggested making a few corrections and changes on the FY06 Budget Policy Statement. Mark Caggiano made a MOTION, seconded by Donald Stewart, to approve the FY06 Budget Policy Statement. Vote approved 5-0. Machine Shop Village Committee and Charge. At the May 2004, Town Meeting, $22,000 was allocated from the Community Preservation Act funds for the purpose of developing streetscape designs for the Machine Shop Village historical district. It is recommended that the board establish a committee in order to properly disburse these funds consistent with Town Meeting approval. The board is asked to approve the resolution letter and five members appointed by the Board of Selectmen consisting of two residents, two business owners within the village, one member of the Community Preservation Committee and the Town's Director of Community Development and /or the Town Planner serving as an ex officio member of the Committee. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve the charge for the Machine Shop Village Committee. Vote approved 5-0. Board of Selectmen Minutes November 1, 2004 3 Wendy Wakeman made a MOTION, seconded by Donald Stewart, to approve the following members to serve on the Machine Shop Village Committee: Liz Fennessy, 77 Elm Street; Adele Gaulocher, 9 Pleasant Street; Dianne O'Brien, Crumpets Tea Room; Andy Gilman, Pastor, Trinitarian Church; and Ron Headrick, Community Preservation Committee member. Vote approved 5-0. Order of Taking, Land next to Water Treatment Plant. Town Counsel advised the Town to issue a confirmatory Order to Taking for the recently acquired land next to the water treatment plant. The purpose of this voluntary order is to eliminate any potential for unanticipated title issues. Mark Caggiano made a MOTION, seconded by Wendy Wakeman, to issue the confirmatory Order of Taking in connection with the acquisition of Great Pond Road adjacent to the water treatment plant. Vote approved 5-0. NEW BUSINESS: Conservation Restriction, Edgewood Farm. Kristin Abati from Choate, Hall & Stewart represented Mr. Samuel S. Rogers, owner of property located on Osgood Street in North Andover. Mr. Rogers intends to donate a conservation restriction affecting roughly 9.98 acres of Edgewood Farm, including pastureland and two historically significant barns, to the Trustees of Reservation, a nonprofit conservation organization. The Director of the Division of Conservation Services in the Executive Office of Environmental Affairs has approved this transaction. This must now be approved and signed by the Board of Selectmen of the Town of North Andover. James Xenakis made a MOTION, seconded by Mark Caggiano, to approve and sign the Conservation Restriction for Edgewood Farm. Vote approved 5-0. Winter Parking Ban. The Town Manager asked the board to approve an all-night winter parking ban effective on December 1, 2004 to March 31, 2005. Donald Stewart made a MOTION, seconded by Wendy Wakeman, to approve the Winter Park Ban for 2004-2205. Vote approved 5-0. TOWN MANAGER'S REPORT: The Red Cross has invited the Board of Selectmen to attend their Annual Salute to Veterans Breakfast to be held on Monday, November 8, 2004, at 7:00 AM at the Wyndam-Andover Hotel. Due to the efforts of Heidi Griffin, Community Development Director, the Town has been issued the annual renewal to Housing Certification under Executive Order 418. This certification, which is necessary to receive certain state grants, demonstrates that the town is making progress in meeting its affordable housing goals. Notices have been distributed to town boards informing them of the November 10, 2004 workshop on the state ethics laws, open meeting law and public records laws. The Division of Public Works will be picking up leaves only, in paper bio-degradable bags, curbside, from Monday, November 8 through November 19 on the resident's recycling day. The Board of Selectmen reminds everyone to vote on Tuesday, November 2, 2004. ADJOURNMENT: Mark Caggiano made a MOTION, seconded by Donald Stewart, to adjourn the meeting at 9:00 PM.
