HomeMy WebLinkAbout2005-10-03 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES OCTOBER 3, 2005 CALL TO ORDER: Rosemary Connelly Smedile called the meeting to order at 7:05 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Rosemary Smedile, Chairman; James Xenakis; Donald B. Stewart; Mark J.T. Caggiano; Thomas Licciardello; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. EXECUTIVE SESSION: James Xenakis made a MOTION, seconded by Mark Caggiano, to move into Executive Session to discuss pending litigation. Vote approved 5-0. The Board of Selectmen was individually polled and each voted to move into Executive Session. Donald Stewart yes; James Xenakis yes; Mark Caggiano yes; Thomas Licciardello, yes, and Rosemary Smedile yes. Vote approved 5-0. APPROVAL OF MINUTES: James Xenakis made a MOTION, seconded by Mark Caggiano, to approve the Amended minutes of September 26, 2005. Vote approved 4-0-1. Donald Stewart abstained. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT: New Business Recognition The Board of Selectmen recognized three new Businesses and presented them with Certificates of Appreciation. Jack Kinsmen of Kinsmen Service Station of 145 Andover By Pass, and Jason Piscentini of Eatz Restaurant, 57 Water Street. Recognition of Town Employees/Committees Governor Mitt Romney recently honored Director of Veterans Services Edward Mitchell for exceptional service to veterans. The Board of Selectmen presented Edward Mitchell with a Certificate of Appreciation. On October 6, 2005 the Community Preservation Coalition will honor the Town's CPA Committee with a Pioneer Award for the Town's efforts to preserve open space. Felipe Schwarz and Linda Tremblay accepted a Certificate of Appreciation from the Board of Selectmen on behalf of their committee. Appointments Special Municipal Employee Thomas Licciardello made a MOTION, seconded by Mark Caggiano, to approve the appointment of Attorney Art Kreiger as a Special Municipal Employee for the Town of North Andover. Vote approved 5-0. Poet Laureate Committee At a previous meeting the Board authorized the creation of a committee to name annually a Town Poet Laureate. The following people are on the selection committee: Martha Salisbury, Robin Ellington, Blair Woodman, Gayle Heney, Barbara Taormina, Dena Bailey. James Xenakis made a MOTION, seconded by Mark Caggiano, to approve the above named people to the Selection Committee for a Poet Laureate. Vote approved 5-0. Board of Selectmen Minutes October 3, 2005 2 Police Officers Appointments Mark Caggiano made a MOTION, seconded by James Xenakis, to appoint the following police officers as lateral transfers. Thomas E. Donovan, from the Methuen Police Department and Katherine A. Knab, from the Hingham Police Department to the North Andover Police Department as patrol officers to take effect on October 24, 2005. Vote approved 5-0. Proclamation: October as Domestic Violence Awareness Month James Xenakis made a MOTION, seconded by Thomas Licciardello, to declare by proclamation that the Town recognizes October as Domestic Violence Awareness Month. Vote approved 5-0. LICENSING COMMISSIONERS: James Xenakis made a MOTION, seconded by Mark Caggiano, to move into Licensing. Vote approved 5-0. Mark Caggiano made a MOTION, seconded by Rosemary Smedile, to approve the following one-day licenses at the Stevens Estate, 723 Osgood Street. Perry Rehearsal Dinner, Friday, October 21, 2005, from 6:00— 10:00 PM, Beer and Wine Bar Clover Reception, Saturday, October 22, 2005, from 3:30—8:30 PM, Full Liquor Bar Cyr Reception, Sunday, October 23, 2005, from 1:00—6:00 PM, Full Liquor Bar Bere Retirement Party, Friday, October 28, 2005, from 7:30— 11:30 PM, Full Liquor Bar Belliveau Reception, Saturday, October 29, 2005, from 6:00— 11:00 PM, Full Liquor Bar PUBLIC HEARINGS LICENSING: Thomas Licciardello made a MOTION, seconded by James Xenakis, to open the Public Hearing. Vote approved 5-0. The Loft Steak and Chop House LLC d.b.a., James A. Dietz, Manager, 1120 Osgood Street, North Andover, is requesting to Alter the Premises. James Xenakis made a MOTION, seconded by Mark Caggiano, to grant permission and approve the request of the Loft Steak and Chop House to Alter the Premises. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Mark Caggiano, to close the Public Hearing. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Mark Caggiano, to move out of Licensing. Vote approved 5-0. OLD BUSINESS: Priority Development Grant Award The Massachusetts Housing Finance Agency recently awarded the Town a $40,000 Priority Development Funding Grant to assist the Town in our review and approval process of the 40R application for 1600 Osgood Street. The Board was asked to sign and accept the Grant. James Xenakis made a MOTION, seconded by Mark Caggiano, to accept and sign the PDF Grant. Vote approved 5-0. NEW BUSINESS: Sewer Rate Relief Fund The Town is eligible to receive $26,789 from the Commonwealth's Sewer Relief Fund in FY06. The funds are based on the permanent debt service on water pollution control projects. The Board was asked to sign the documents. Board of Selectmen Minutes October 3, 2005 3 Right of First Refusal, 605 Osgood Street The Town has been notified that land currently in Chapter 61 (classification and taxation of forest land) at 605 Osgood Street has a pending purchase and sale agreement. Under state law, the Town has 120 days from date of notice to exercise its right of first refusal. John Simons, Chair of the CPA said he would look into this matter and report back to the Board with his committee's findings and recommendations. TOWN MANAGER'S REPORT: As part of the Town's recent borrowing, the Town's two bond rating agencies issued reports maintaining our current rating. Standard of Poor reaffirmed the Town's rating of A+ and Moody's Investors Service reaffirmed the Town's rating of Al. Both agencies stressed that failure to maintain adequate reserves in outlying years could result in a downward rating adjustment and higher interest rates on future borrowing. Old Center Underground Utilities Project The first phase of construction began with the undergrounding of utilities in the Old Center. Construction will be on-going Monday thru Friday 7:00 AM to 3:30 PM weather permitting. Trash Tonnage Recycling Report Since the implementation of expanded recycling efforts from the Solid Waste Advisory Committee, there has been a measurable decline in trash taken to the Wheelabrator facility. At the current $142/ton tipping fee, this reduction has resulting in a savings of approximately $74,000. Veterans Days Observances Director of Veterans Services Ed Mitchell requested a parade permit to honor North Andover Veterans on Friday, November 11, 2005, beginning at 10:00 AM. James Xenakis made a MOTION, seconded by Thomas Licciardello, to approve the request for a parade on Veterans Day November 11, 2005. Vote approved 5-0. American Red Cross Salute to Veterans and their Families The Board of Selectmen is invited to a breakfast on Monday, November 7, 2005, at 7:00 AM at the Wyndham Hotel in Andover. The Board of Health announced that there would be additional Mosquito spraying at the High School and Middle School fields this week. The first application cost was $8,400 and was paid for by donations from Thomas Zahoruiko and Wheelabrator. Thank you notes will be sent. The Town Manager attended the ICMA conference in Minneapolis, MN and received an award for twenty- five years of service for local government.
