The fealty will provide tenancy for a currently vacant portion of Building 30 while providing employment for approximately 30 people and increasing Town tax revenues. Also,the Board finds that the Chapter 70 General Bylaw Special Permit,Exhibit F,List of Automatic Amusement Devices lists the names of the 25 automatic amusement devices to be installed in the 2°d floor SE corner of Building 30. The building is located within the Industrial 2 Zoning District. The construction of the proposed business will be entirely within the footprint of the existing building and will have sufficient parking to support all clientele. In accordance with Section 8.3.2(a)(iii)of the Zoning Bylaw, I am required to apply for a Site Plan Review Special Permit,as my proposed business is a new use (place of amusement)within the building not normally associated with the existing use(industrial manufacturing). However, for the reasons discussed further below, it is my contention that the new use will not have a significant impact both within the site and in relation to adjacent properties and streets, on pedestrian and vehicular traffic,public services and infrastructure,abutting properties,and community needs. As such,I am requesting a Waiver of Site Plan Review to allow Lazercraze to be constructed as proposed. 1) General Description of the Business: LaserCraze, a first-class laser tag family entertainment center is slated to move into the existing Lucent building. The goal of LaserCraze will be to provide clean, safe, fun family recreational entertainment to the residents of North Andover and the surrounding communities. The primary business of LaserCraze is laser tag for kids between the ages of six and up. In addition to the laser tag, the facility will include inflatable play structures that are geared to kids four to ten years old, coin operated games, and a pizza snack bar. Additional incidental activities will include birthday parties, high school and college oriented group functions, as well as corporate group functions. The business is slated to be open six days per week and expects to do 85%of its business on Saturdays and Sundays. The hours of operations are as follows: • Monday: Closed • Tuesday thru Thursday: 10:30am to 9:OOpm • Friday: 10:30am to 12 midnight • Saturday: l Oam to 12 midnight • Sunday l Oam to 7pm 2) Proposed Use: In speaking with the Inspector of Buildings,the use, a place of amusement, is allowed by Special Permit(ZBA)in the Industrial 2 Zoning District. I received a Special Permit from the ZBA on December 21,2006 to allow the use within the building. I have also w r presented before the Board of Selectman Licensing Commission and have been granted Common Victuallers,Automatic Amusement Devise(video and redemption games), and Entertainment Licenses. The project has also gone through a Technical Review Committee meeting and deemed satisfactory by the various Town Departments. The primary issues discussed involved the impact on traffic,parking, signage, internal pedestrian circulation, and noise. Town Staff was satisfied with the proposal and that it will not significantly impact abutting parcels,traffic along Rte. 125, or businesses within the building. I am currently working with Ozzy Properties to discuss appropriate internal and external signage and ways to improve security within the building. Although the proposal is a new use within the building,the business will not present a nuisance to the adjacent property given the proximity of the business (existing large building) to the abutting property lines or impact traffic circulation on the site. Any/all construction will be internal and any external signage will comply with the master signage plan approved by the ZBA. Further consideration was given to the impact of LaserCraze on other businesses within the building with regards to noise and people. As part of my construction plans, sound dampening measures will be installed to mitigate the level of sound. Internal pedestrian circulation will be controlled through the use of proper signage within the building. With regards to parking,the Inspector of Buildings confirmed that the site currently consists of adequate number of parking to handle the additional vehicular trips to the site and will not result in the addition of any new parking spaces. 3) Community Needs: LaserCraze will fill an important service and community recreational need for the route 125 corridor as it will both serve to provide a community recreational opportunity and function as part of the overall redevelopment of Osgood Landing, as well as the North Andover area. From an economic standpoint, LaserCraze will serve as a new source of tax revenue to the Town with potential new employment opportunities for the area. Specifically,LaserCraze projects to hire between 25 and 30 new employees on a full-time and part-time basis to staff the facility,most of whom will be local youths. I am an experienced operator of laser tag facilities,having operated two such facilities for an extended period of years both in Marlborough and Randolph,Massachusetts. Over the eight years of operation at the Randolph LazerZone facility, and six years of operation at the Marlborough facility,both operations have established a record of well managed, safe operations and have been a welcome addition to each of those communities.
