HomeMy WebLinkAbout2005-12-19 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES DECEMBER 19, 2005 CALL TO ORDER: James Xenakis called the meeting to order at 6:30 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: James Xenakis; Donald B. Stewart; Mark J.T. Caggiano; Thomas Licciardello; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. Rosemary Smedile was tardy. EXECUTIVE SESSION: James Xenakis made a MOTION, seconded by Thomas Licciardello, to move into Executive Session to discuss Pending Litigation, Negotiations with Union Employees, Negotiations with Non-Union Employees, and Real Estate Acquisition - Cullen Property. Vote approved 4-0. The Board of Selectmen was individually polled and each voted to move into Executive Session. Donald Stewart yes; James Xenakis yes; Mark Caggiano yes; Thomas Licciardello, yes. Vote approved 4-0. Rosemary Smedile arrived at 6:40 PM. APPROVAL OF MINUTES: James Xenakis made a MOTION, seconded by Mark Caggiano, to approve the minutes of Executive Session as written November 7, 2005, Open Session as written November 21, 2005, Open Session as written on December 5, 2005, and Executive Session as Amended on December 5, 2005. Vote approved 5-0. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT: Business Recognition: -The Board of Selectmen presented a Certificate of Appreciation to the owners of Lembo's Market for continuing to locate their business in North Andover. New Business Recognition: -The following new businesses were presented Certificates of Appreciation from the Board of Selectmen: Fresh City and Burtons Grill for locating their businesses in North Andover. Acceptance of Donation: -James Xenakis made a MOTION, seconded by Donald Stewart, to accept donations from Schneider Electric for the Fire Department in the amount of$1,000, and for the Police Department in the amount of$500. Vote approved 5-0. Dedication of Selectmen's Meeting Room Podium: The Board of Selectmen dedicated the podium to former town leader, Fred P. Oakes. Many family members were present to accept the honor. Lateral Transfer Request: Police Officer Jeffrey Sapienza is requesting a transfer to Lawrence Police Department. James Xenakis made a MOTION, seconded by Donald Stewart, to approve the lateral transfer of Officer Jeffrey Sapienza, effective date February 20, 2006. Vote approved 5-0. LICENSING COMMISSIONERS: James Xenakis made a MOTION, seconded by Thomas Licciardello, to move into Licensing. Vote approved 5-0. James Xenakis made a MOTION, seconded by Rosemary Smedile, to open the Public Hearing for the Beijing Restaurant transfer of liquor license to Millennium Eatery, Inc, 1250 Osgood Street. James Xenakis made a MOTION, seconded by Thomas Licciardello, to allow the transfer of all Alcoholic Beverage License from the Beijing Restaurant, Inc., d.b.a. to Millennium Eatery Inc., d.b.a. Beijing Restaurant. Vote approved 5-0. Board of Selectmen Minutes December 19, 2005 2 James Xenakis made a MOTION, seconded by Rosemary Smedile, to Amend the MOTION to pledge License to beneficiary of the Beijing Restaurant upon approval of ABC and sale date in January 2006. Vote approved 5-0. James Xenakis made a MOTION, seconded by Mark Caggiano, to close the Public Hearing. Vote approved 5-0. Note: James Xenakis excused himself from the meeting. 2006 License Renewals Licensing Chairman Donald Stewart recommended that the Board approve the renewal licenses but authorize the Chair of Licensing to withhold issuance of a license until such time as a few businesses come into compliance with town regulations. Stewart commended the Assistant Town Clerk Janet Eaton for her outstanding performance associated with license regulations. Thomas Licciardello made a MOTION, seconded by Mark Caggiano, to accept the following License renewals. Vote approved 4-0. Vote approved 5-0. OLD BUSINESS: Vehicle Use Policy The Board requested comments from division directors regarding this policy at their last meeting. The Town Manager summarized the policy, which attempts to provide for the same level of vehicular access that is currently provided to town employees while clarifying specific responsibilities for the use of town cars. James Xenakis changed wording under section C-6, from 25-miles to 10-miles. Mark Caggiano made a MOTION, seconded by James Xenakis, to adopt the Vehicle Use Policy as Amended. Vote approved 5-0. NEW BUSINESS: Fire Chief William Dolan requested the Board's approval of his recommended ambulance user rates for the calendar year 2006. James Xenakis wanted finance officials to present estimates of future profits based on the new rates and projection analysis done. FY07 Capital Budget The Town Manager presented his recommended FY07 Capital Budget. The CIP budget only included recommendations for projects that can be funded within the town policy of maintaining non-proposition 2'h excluded debt at 5% or less of net operating revenue. The Capital Budget Committee is currently reviewing larger projects that may require a proposition 2'h debt-exclusion to be funded. Board of Selectmen Meeting Schedule 1St Half of 2006 Mark Caggiano made a MOTION, seconded by Thomas Licciardello, to approve the Meeting Schedule presented by the Town Manger as follows: January 9, 23, February 13, 27, March 13, 27, April 10, 24, May 1, 8, 22, and June 12, 26. TOWN MANAGER'S REPORT: Deputy Fire Chief William Martineau has been accepted into the prestigious Executive Development Program offered by the Federal Emergency Management Agency's National Training Center in Emmitsburg, Maryland.
