Al IG 1 2 2014 Chairman, Board of Appeals FROM: Curt Bellavance, Director , BOARD OF APPEALS tl RE: 50 Martin Avenue DATE: August 11, 2014 The 50 Martin Avenue project has been before the Zoning Board on several occasions, both for discussion and as an application. Our office has met with the applicant several times to discuss the project as well. This office supports the request to modify the Special Permit. The applicant has requested to appear before the Board in. order to modify their existing approval. The current project was approved and contained the requirement that they convert the existing garage into living space. The "side effect" will result in the applicant constructing a new freestanding garage on the north side of the property, which they are allowed to construct according to the inspector of buildings. The applicant is requesting to modify the approved special permit to allow him to keep the current garage, rather than constructing a new garage. Again, our office supports this request. Scott Follansbee to modify the Special Permit that was issued for the above address- by the Zoning Board of Appeals on June 18, 2013. Specifically, Mr. Follansbee requests that the Board allow a minor modification of the Special Permit to allow the use of the original two car garage as a traditional garage, in lieu of converting the garage area to living space. As part of the allowed special permit, the original garage was to be used for living area. As the Board is aware, the newly constructed additionhas its own"attached garage. Mr: Follansbee was - intent on building a separate two gar garage structure adjacent to the property for use by the original unit occupant(s). The proposed modification would obviate the need to construct the additional structure to the right of the home. Please see the building elevation plan submitted with this request. The proposed modification has been discussed with the Office of Community Development. We have been told by Mr. Curt Bellavance that his office is in support of our request to the Board. All parties feel that the modification is preferable to the construction of an additional stand-alone two car garage. The Board should be in receipt of a letter in support of this modification from the office of Community Development. We would -ask that the Board- place- this- matter on- the agencla- for the Board's next scheduled- meeting. I grew up on Martin Ave, my mom still lives in the house I grew up in which is directly across the street from this property and my sister and her family are direct abutters to the right of this property. I would like to make the following comments regarding the proposed structure. According to the Zoning Bylaw this property is located in a Residential 4 District. 4.122 Residence 4 District 14. Residential Dwellings A. Dwelling types ^ a. One Family Dwelling. Two famil dwellings, by special permit from the Zoning Board. of Appeals in accordance with Sections 10.3 and 4.122.14.D of this Bylaw. ;onversions - The conversion of an existing one -family to a two-family dwelling, by special perr ing Board of Appeals in accordance with Sections 10.3 and 4.122.14.D of this Bylaw, provided ✓ersion from a one-familv to a two-familv dwellina meets the followina additional reouirementsI a conversion involves increasing the size of an existing structure, the expansion area ped 50% of the original building's gross floor area up to a maximum of 1500 s.f. The sl According to the permit application and plans submitted, the existing building is 2,722 sq ft, the proposed building is 2,273 sq ft. Not only is the second dwelling unit over the maximum allowed 1500 sq ft, but the size of the second dwelling equals an 83% expansion of the original building's gross' floor area. 0. No garage or carport shall face the street unless it is located at least 10 feet behind the front agade of the principal structure and in accordance with the dimensional setbacks outlined in Table 2 of this Bylaw. As shown on the plans submitted, the proposed garage appears to be only 27' behind the front fagade of the principal structure, not 10' that is required. . The principal building in a conversion to a two-family dwelling shall share a connected comm( ,all (or floor) for at least 75% of the wall's (or floor's) surface. D. Special Permit Granting Criteria for Two -Family Dwelling and One -Family to Two -Family or Multi- Family Conversions. a. The Zoning Board of Appeals may approve a special permit for a proposed use of a building, dwelling or structure provided by Section 4.122.14.A.b., 4.122.14.B or 4.122.14.0 upon finding that the application complies with the purposes of this Bylaw, and is consistent with the use of the site for the pose permitted within the Residential 4 District In making its decision, the Zoning Board shall co sider the following criteria in addition to those listed in Section 10.31:_ 1. Consistency with the North Andover Master Plan. 2. The degree to which the proposed use furthers the Town's interest in providing a range of housing types, where applicable. 3. The degree to which the application addresses the following design standards: i. Achieve compatibility with the established pattern of uses in the district. The Residential 4 District consists primarily of single-family dwellings near the Steven emorial Library Area and off of Massachusetts Avenue, and more compact—J neighborhoods with a mix of residential uses toward Waverly Road. New In 1981, the structure at 40142 Martin Ave was constructed. As you can see by the photos, this was similarly built as a two family on one lot of land. It is a monstrosity, and is completely out of character with the neighborhood. This is exactly what the neighborhood is trying to prevent from happening once again. This proposed structure absolutely is NOT consistent in size, structure and appearance with other homes in the immediate vicinity and does not compliment and reinforce the design features of the neighborhood. The neighborhood is lined with single family homes with house lengths of between 40' to 60', not two and three family structures taking up the entire buildable area of the lot. This proposed structure is over 137 feet in length along Martin Ave. NO other home in the neighborhood even comes close to this. Additionally, according to the Procedure & Requirements for an Application for a Special Permit, Section 10 A, Major Projects — Major projects are those, which involve one of the following whether existing or proposed: I. Five or more parking spaces, II. Three (3 or more dwelling units, III. 2000 square feet of building area ijor Projects shall require that in addition to the above features, Is and topographic information; flans must show detailed utilities According to the application for the special permit, the existing building is 2,722 sq ft and the proposed building is 2,273 sq ft for a total of nearly 5,000 sq ft. Would this not be considered a Major Project because the combined building area of the existing and proposed buildings are far greater than 2000 square feet. Therefore as stated on the Special Permit, Major Projects shall require that plans must show detailed utilities, soils and topographic information. Where is this information shown on the plans submitted? It would appear that this application is incomplete without this information. At the May 2006 Town Meeting, The Planning Board petitioned amending the Zoning Bylaw to state that two family dwellings would no longer be allowed by -right in the R4 district, but would require a special permit by the Zoning Board of Appeals. Both the Board of Selectmen and Planning Board supported this article and the amendment was unanimously approved by the residents of this town. This warrant article was written to preserve the integrity and beauty of this town and to prevent builders from turning single family neighborhoods into multi -family dwellings for the simple purpose of financial gain. Mr. Follansbee bought this property fully aware that it was in a Residential 4 District which allowed single family homes be build by -right. He partitioned the Zoning Board of Appeals last year with a vey similar plan and was told by at least one board member that the plan was not favorable in appearance and did not fit into the neighborhood. It was suggested by the board at that time to try to come up with a plan that would fit in better with the neighborhood. Now he is back in front of the Board with basically the same plan, he simply removed one garage stall from the original plans. It appears Mr. Follansbee has no desire to take the previous advice of the Zoning Board and be satisfied with the single family home he is living in, but is still looking to build the second house on this lot for the simple purpose of financial gain with no regard for how it would adversely effect the integrity of the neighborhood. The zoning bylaw was written to prevent this very situation from happening. We are hopeful that the Board will not overlook the many discrepancies mentioned above that the proposed plan shows from what the residents of this town are fighting so hard to maintain. I would encourage you to drive down Martin Ave. to see for yourself the single family homes which currently make up the neighborhood. We respectfully request that you uphold the requirements of the Zoning Bylaw and help us to protect the beauty and character of the neighborhood and deny this special permit. Thank you for your time.
