At that time I did not observe any siltation discharging into .the storm drainage system.. However, I will make site visits regularly to check for siltation on rainy days. Peter Conservation Administrator TAPImlb October 1, 1986 Ms. Tracy Peter Conservation Commission Town of North Andover 120 Main Street North Andover, MA 01845 Dear Tracy Several months ago, at my request, you came to the Colonnade to inspect the evidence of erosion from lots DIA and B1 onto the.Colonnade driveway. This condition has worsened since your visit. The access road to these two lots has recently been plowed, resulting in another location of erosion. This erosion is occurring lower in elevation on the site and is directly flowing down the slope of the driveway into the storm drain system. This is clearly visible both during rain and when dry. I'm not sure of the Conservation Commission's jurisdiction, as to whether or not there is a clear distinction between watershed and wetlands. But the storm drain system is depositing this mud at some point nearer the Lake. Would you please have the Conservation Commission evaluate this situation in an effort to alleviate the erosion problem. Thank you. Sincerely, Mar o ie A. Salisbury, Chairman Board of Selectmen Town of North Andover Town Hall 120 Main Street •• North Andover, MA 01845 Dear Mr. Salisbury On August 15, 1986 I inquired of the Building Inspector Charles Foster regarding the status of two pieces of property situated behind the Colonnade Condominiums on Great Pond Road known as Lots DIA and B1 (watershed properties). Mr. Foster told me that a building permit was.,.ks,sued -on these =properties to C. Lincoln Giles approximately 2-3 years ago and that these building permits had.not been renewed. At the 1985 Annual Town Meeting a moratorium was unanimously voted on new construction within the watershed. Under state law a building permit is alive as long as substatitial building is in progress. There has been no commencement of construction on these properties since the issuance of the building permits, and Mr. Giles has not renewed these building permits every six months as is, also, required by state law. It i1s, therefore, my understanding that C. Lincoln Giles cannot build on these properties until the moratorium has expired. He has, in fact, begun to plow an access road into these properties. We of the Colonnade Condominium Association want to be assured that any further development by C. Lincoln Giles will be done in accordance with the law and its processes. Also, Mr. Foster indicated to me that a building permit could be issued at the discretion of the Building Inspector. If this is true, The Colonnade Condominium Association requests A Charles A. Salisbury', Chairman Board of Selectmen Page 2 that we have direct input into the manner in which construction is carried out on these'properties. Access to these properties is a continuation of the Colonnade driveway. We question the ability of the existing drive- way to sustain heavy building equipment.'. In addition, this property is situated on a mountain top. The side of this mountain abuts the Colonnade garages. Tampering with the topography of this mountain may adversely effect the adjacent buildings. The Colonnade. Condominium Association would appreciate your attention to this matter in securing compliance of C. Lincoln Giles with state and town laws. Sincerely, Marjorie A.
