HomeMy WebLinkAbout2010-11-17 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES NOVEMBER 17, 2010 CALL TO ORDER: Chairman Daniel Lanen called the meeting to order at 5:30 PM at North Andover High School, Conference Room 1108. ATTENDANCE: The following were present: Daniel Lanen, Chairman; William F. Gordon, Clerk; Tracy Watson, Licensing Chairman; Rosemary Connelly Smedile, Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. APPROVAL OF MINUTES: William Gordon made a MOTION, second by Rosemary Smedile, to approve the attached Open Session Amended minutes of November 1, 2010. Vote approved 4-0. William Gordon made a MOTION, seconded by Tracy Watson, to approve the attached Executive Session minutes of October 4, 2010. Vote approved 4-0. LICENSING COMMISSIONERS: William Gordon made a MOTION, seconded by Daniel Lanen to move into Licensing. Vote approved 4-0. Application for Retail Alcoholic Beverage License— LaBottetga, LLC, 1820 Turnpike Street See attached application license and recommendations from various departments. William Gordon made a MOTION, seconded by Rosemary Smedile, to close the public hearing. Vote approved 4-0. Rosemary Smedile made a MOTION, seconded by William Gordon, to approve the alcoholic beverage license request for retail for LaBottetga LLC, 1820 Turnpike Street. Vote approved 4-0. William Gordon made a MOTION, seconded by Rosemary Smedile, to move out of Licensing. Vote approved 4-0. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT: Annual Santa Parade The town's annual Santa Parade will be held on Saturday, November 27, 2010 starting at 12:00 noon. The parade will proceed down Main Street to Elm Street to Water Street, from Water Street back to Main Street and continuing down to Sutton Street. Letter attached. CONSENT ITEMS: Annual Santa Parade Permit, November 27, 2010 The North Andover Festival Committee and the North Andover Police Association request an event permit to conduct a parade on November 27, 2010. Letter attached. Tracy Watson made a MOTION, seconded by William Gordon, to grant an event permit to the North Andover Festival Committee and the North Andover Police Association to conduct a parade on November 27, 2010, beginning at 12:00 noon as further describer in the letter of November 5, 2010. Vote approved 4-0. Board of Selectmen Meeting Schedule, 1St half of 2011. TABLED until next meeting. NOTE: Richard Nardella arrived at 6:20 p.m. Board of Selectmen Minutes November 17, 2010 2 Affordable Housing Resale. Community Development Director Curt Bellavance recommended that the Board not exercise its right of first refusal on the listed properties but instead authorize the Citizens Housing and Planning Association (CHAPA)to assist the Town in finding other owners who can maintain the affordable housing designation for these properties. Documents attached. Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Town not exercise its right of first refusal for the following properties: One Harvest Drive, Unit 303, Two Harvest Drive, Unit 105, 180 Chickering Road, Unit 204C, and to authorize CHAPA to find new owners who will maintain the unit's affordability designation. Vote approved 5-0. OLD BUSINESS: Preparation for Special Town Meeting The Board was asked to make a recommendation on Article 10 to amend the zoning bylaw. The Planning Board and the Finance Committee both have voted "favorable action" on this Article 10. Town Warrant Articles attached. Selectman William Gordon requested more information about the zoning. Rosemary Smedile made a MOTION, seconded by Tracy Watson, to recommend Favorable Action on Article 10. Amend Zoning Bylaw Section 16.5 Uses Subiect to a Special Permit Corridor Development Districts—Banks with Drive Through in CDD2 on Parcels Five (5)Acres or More. Vote approved 4-0-1. William Gordon abstained. NEW BUSINESS: Preparation for Tax Classification Hearing The Town Manager said there would be a public hearing on Property Tax Classification at their next meeting on November 29, 2010. The Chief Assessors Garrett Boles provided the Board with spreadsheets calculating preliminary information regarding tax values, tax levy and quartiles for the Board to review. Notice of Public Hearing, Letter from the Merrimack Valley Chamber of Commerce and Spreadsheets attached. TOWN MANAGER'S REPORT: The Town Manager received a letter from the MA highway division approving eligibility for Federal Aid HSIP funding of approximately$1,200,000 for North Andover Mass Highway project#606159, Intersection &Signal Improvements at Route 125 & Massachusetts Avenue. Letter attached. The Town Manager announced that the Police Department would be moving to their new facility and be opened for business on Monday, November 22, 2010. There will be a ribbon cutting ceremony on Saturday, December 11, 2010 at 11:00 a.m. and a formal open house in the spring. ADJOURNMENT: Tracy Watson made a MOTION, seconded by Rosemary Smedile, to recess Open Session at 6:45 p.m. and to continue at 7:00 p.m. with Special Town Meeting. Vote approved 5-0. Adele J.
