HomeMy WebLinkAbout2010-12-13 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES DECEMBER 13, 2010 CALL TO ORDER: Chairman Daniel Lanen called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Daniel Lanen, Chairman; Richard Nardella, Vice Chairman; William F. Gordon, Clerk; Tracy Watson, Licensing Chairman; Rosemary Connelly Smedile, Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. EXECUTIVE SESSION: Tracy Watson made a MOTION, seconded by Rosemary Smedile, to move into Executive Session to discuss potential litigation strategies and the chair shall so declare that the open session would have a detrimental effect on the Town's litigating position. Roll Call vote: William Gordon yes, Richard Nardella yes, Rosemary Smedile yes, Tracy Watson yes, and Daniel Lanen yes. Vote approved 5-0. Chairman Daniel Lanen declared that an open meeting may have a detrimental effect on the Town's litigation position and this matter will be discussed during Executive Session. PLEDGE OF ALLEGIANCE The Sargent School Cub Pack 86, Dens 7, 9 & 10 led the Selectmen in the Pledge of Allegiance. They met with the Town Manager to learn about the operations of town government. The Town Manager announced that he was changing the agenda to include the Town Manager's appointment to the Stevens Estate, to withdraw item VIIA Class II License for Richard Benson, Gate 4 Motorsports, Inc. and to postpone voting on a National Grid Easement. APPROVAL OF MINUTES: William Gordon made a MOTION, seconded by Richard Nardella, to approve the Open Session Minutes of November 29, 2010, as written. Tracy Watson made a comment with a friendly amendment. There was discussion and the Board asked to review them further and TABLE the minutes. William Gordon withdrew his Motion. William Gordon made a MOTION, to TABLE the Executive Session Minutes of November 17, 2010. COMMUNICATIONS,ANNOUNCEMENTS: New Business Recognition: The Board presented a certificate of appreciation to Converse Community Store, 115A Main Street for locating their business in North Andover. The Board presented a certificate of appreciation to Frederick's Pastries, 199 Main Street for locating their business in North Andover. Appointments: The appointments subcommittee is recommending that Mr. Douglas Saal be appointed to fill a vacancy on the Conservation Commission. The Board is requested to approve the appointment. Rosemary Smedile made a MOTION, seconded by William Gordon, to appoint Mr. Douglas Saal to the Conservation Commission. Vote approved 5-0. The Town Manager is recommending that the Board approve his appointment of Erin Flannery as the Director of the Stevens Estate. Ms. Flannery was interviewed by the appointment subcommittee and also recommended the appointment. Ms. Flannery start date will be January 10, 2011. Resume attached. Rosemary Smedile made a MOTION, seconded by William Gordon, to approve the Town Manager's appointment of Erin Flannery as the Director of the Stevens Estate. Vote approved 5-0. Board of Selectmen Minutes 2 CONSENT ITEMS: Acceptance of donation of conservation land; Frank DiNuccio Mr. DiNuccio has offered to donate to the Town 3.3 acres of land for conservation purposes. The Conservation Commission is recommending approval. The Board of Selectmen is asked to accept this land. Documentation attached. William Gordon made a MOTION, seconded by Rosemary Smedile, to accept the gift of 3.3 acres of land for conservation purposes and to sign the official documents for recording. Vote approved 5-0. Modification of Town Common Use Permit by Andy Beresford Mr. Beresford is requesting a modification to his permit to display items at the Town Common to include a white cross. Application attached. Rosemary Smedile made a MOTION, seconded by Tracy Watson, to approve the modification to display a white cross at the Town Common. Vote approved 5-0. Application for Town Common Use Permit by Karin Rhoton Ms. Rhoton is requesting a combination display/event permit on December 18, 2010 from approximately 11:00 a.m. to 3:00 p.m. A Live Nativity to celebrate Christmas and allow the community to donate items or donations to the Lazarus House and A Women's Concern. Application attached. Richard Nardella made a MOTION, seconded by Rosemary Smedile, to approve the use of Town Common on December 18, 2010 from 11:00 a.m. to 3:00 p.m. for a live nativity and music for carols. Vote approved 5-0. LICENSING COMMISSIONERS: Richard Nardella made a MOTION, seconded by Rosemary Smedile, to move into Licensing. Vote approved 5-0. Class II License for Richard Benson, Gate 4 Motorsports, Inc. Withdrawn Change of Manager, 99 Restaurants The 99 Restaurant at 267 Chickering Road is requesting to change the manager to Mr. Lenard Caffrey. Application attached. Richard Nardella made a MOTION, seconded by William Gordon, to approve the request by the 99 Restaurant at 267 Chickering Road to change the manager to Mr. Lenard Caffrey. Vote approved 5-0. License Annual Renewals The Board was requested to approve the annual renewals for licenses for establishments in town. Richard Nardella made a MOTION, seconded by Rosemary Smedile, to approve the annual renewal licenses as presented by the Town Clerk Joyce Bradshaw. Vote approved 5-0. Richard Nardella made a MOTION, seconded by William Gordon, to extend the service of alcohol until 1:00 a.m. and the closing until 2:00 a.m. for three establishments as follows: Orzo's Restaurant, China Blossom Restaurant and Camelot Club. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Daniel Lanen, to move out of Licensing. Vote approved 5-0. PUBLIC HEARING National Grid Pole Petitions National Grid is requesting permission for the (1) installation of Pole#726-3 at 601 Main Street Plan#9797038 and (2) Easement due to the additional modular classrooms built at the Kittridge School. School Committee Chairman Stan Limpert requested that the Board postpone their vote on the Easement until the School Committee votes on it at a future meeting. However, the Selectmen could vote on the installation of the pole at this time. William Gordon made a MOTION, seconded by Rosemary Smedile, to approve the installation of Pole#726-3 at 601 Main Street Plan#9797038. Vote approved 5-0 National Grid is requesting to locate underground utilities at the three railroad crossing in North Andover and the following three petitions are related to this. This work would be started in the spring of 2011. OLD BUSINESS: Amendment to Conservation Restriction from Boston Hill Development, LLC to Town of North Andover This development was converted from a residential multi-unit over 65 project to an assisted living project which would use considerably less land then the earlier project. A revised Conservation Restriction was approved by Town Meeting and the State Legislature. The Conservation Commission has approved it and the Board of Selectmen is requested to approve the revised conservation restriction. NEW BUSINESS: Waiver to Investment Policy Riverbank to Peoples United Treasurer Collector Jennifer Yarid is requesting a temporary waiver to the Town's investment policy to allow for the town to keep some of its fund in high interest bearing certificate of deposit. The Town Manager is recommending this temporary waiver also. Documentation attached. Richard Nardella made a MOTION, seconded by Rosemary Smedile, to approve the temporary waiver until March 24, 2011 and to continue monitoring the account. Vote approved 5-0. Steven Estate Director Compensation The Board was asked to review a proposed compensation plan that provides incentives for the director of the Stevens Estate to increase revenues at the estate. Proposal attached. Review of Non-monetary articles for 2012 Annual Town Meeting The Board was presented with a preliminary list of possible non-monetary articles for the upcoming annual town meeting. The Board was asked to comment and give direction on these articles. The Town Manager also asked if the Board had any additional articles to be added to this list. Documentation attached. Board of Selectmen Minutes 18 Town Manager's Recommended General Fund Capital Improvement Plan, FY12-16 Pursuant to the Town Charter the Town Manager Mark Rees presented the General Fund Capital Improvement Plan for FY12-16. The Board was asked to review the plan and they would have to vote on it at their next meeting in January 2011. Documents attached. TOWN MANAGER'S REPORT: With the recent increases in health insurance claims over the past year, town staff met with our provider Blue Cross/Blue Shield to ascertain why the claims have been increasing.The explanation was that a significant part of the claims related to about a dozen high cost medical conditions for individual employees or dependents. However, approximately 20%of our claims can be attributable preventable health problems such as lack of exercise, in appropriate level of care, stress related disorders, injury risk or tobacco use.To try to reduce those claims,the School Department and Municipal government have begun working with BC/BS to provide educational material and a 24 hour telephone health advisory line to our employees as to what different programs they can avail themselves to address their health related concerns. In addition, the North Andover Health Department and the School Nurses have agreed assist in establishing an employee wellness committee. A committee of five department managers appointed by the Town Manager has completed a preliminary review of 57 applications received for the Human Resources Director position. The y have selected 12 applicants for interviews. Interviews will start in the next few weeks, after which they will submit 3 to 5 candidates for the Town Manager's review and final selection. Selectmen are to gather on Wednesday, December 15, 2010 at 4:30 p.m. to prepare for the Selectmen's Holiday Breakfast on Thursday, December 16, 2010. PUBLIC COMMENT Donald Stewart of 52 Prospect Street commented on the Licensing Commissioner's vote concerning the request from the Beijing Restaurant allowing for extended hours on New Year's Eve. Stewart suggested the Board check with Legal Counsel regarding this vote.
