CALL TO ORDER: Chairman Tracy Watson called the meeting to order at 7:00 PM at Town Hall Meeting
Room.
ATTENDANCE: The following were present: Tracy Watson, Chairman; William F. Gordon, Clerk; Rosemary
Smedile, Licensing Chairman; Donald Stewart, Ray Santilli, Assistant Town Manager.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
William Gordon made a MOTION, seconded by Donald Stewart, to approve the Open Session Minutes of
December 5, 2011, as written. Vote approved 4-0.
William Gordon made a MOTION, seconded by Donald Stewart, to approve the Executive Session Minutes of
November 28, 2011. Vote approved 3-0-1, Tracy Watson abstained.
COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT:
CONSENT ITEMS:
Acceptance of State 911 Grant— Police Department
This State grant in the amount of$15,547 will be used for training dispatchers in the Communication Center.
Donald Stewart made a MOTION, seconded by William Gordon, to accept the State Grant in the amount of
$15,547 to be used for training dispatchers in the Communication Center. Vote approved 4-0.
Acceptance of State SAFE Grant—Fire Department
This State grant in the amount of$5,265 will be used to educate students in at schools about fire safety.
William Gordon made a MOTION, seconded by Rosemary Smedile, to accept this SAFE State grant in the
amount of$5,265 to be used to educate students in at schools about fire safety. Vote approved 4-0.
Filling of Vacancy— Departmental Assistant, Building Department
This current position will be vacant due to a retirement. The Board is requested to approve advertising and
filling the position.
Donald Stewart made a MOTION, seconded by Rosemary Smedile, to approve advertising and filling the
position of Department Assistant, for the Building Department. Vote approved 4-0.
LICENSING COMMISSIONERS:
William Gordon made a MOTION, seconded by Donald Stewart, to move into Licensing. Vote approved 4-0.
Establishments request to extend hours of New Year's Eve
The following three establishments are requesting to remain open until 2:00 a.m. on New Year's Eve: Orzo's,
China Blossom and Camelot.
William Gordon made a MOTION, seconded by Donald Stewart, to extend the hours until 2:00 a.m. on New
Year's Eve for the three establishments and if any other establishments considering extending their hours for
that evening, it would be contingent on submission to the Town Clerk's office and Police approval. Vote
approved 4-0.
Lottery Commission "Keno to Go" LaBottega Wine & Beer, 1820 Turnpike Street
The MA State Lottery Commission notified the Town of North Andover License Commissioners that the
following existing agent will be sent an application to sell the KENO To Go product:
La Bottega Wine & Beer, 1820 Turnpike Street, North Andover, MA 01845. The License Commissioner has
21 days to object.
Tracy Watson made a MOTION, seconded by Donald Stewart, not to object to the KENO To Go application for
La Bottega Wine & Beer, 1820 Turnpike Street, North Andover, MA 01845. Vote approved 4-0.

License Renewals for Calendar Year 2012
The Building Inspector and the Fire Chief have signed off on theirjoint inspections and all appropriate
paperwork regarding Worker's Compensation Insurance and Alcohol Liability Insurance has been filed with the
Town Clerk's office. Three establishments have been identified with an occupant load of 100 or more persons
as needing a Crowd Control Manager: China Blossom, Camelot and the VFW. A Crowd Control Manager has
been identified at all three locations.
Donald Stewart made a MOTION, seconded by Tracy Watson, to approve and renew the licensing for all the
establishments listed below including the Crowd Control Manager. Vote approved 4-0.

Donald Stewart asked the staff to check into the online TIP Certification process. The Town Clerk's office said
they would have an answer for him during one of the January meetings.
Donald Stewart made a MOTION, seconded by Tracy Watson, to move out of Licensing. Vote approved 4-0.
OLD BUSINESS:
"An Act Regulating State Primaries"
This was brought forward at the Board's last meeting. Board members and the Town Clerk spoke to State
Representatives and there are still no definite answers to determine if the state and federal primaries could be
merged on a particular date in June.
The Board did not make any recommendations on this issue.
2012 Annual Town Meeting —Clarification
The date of the 2012 Annual Town Meeting was voted by the Board of Selectmen to be on Tuesday, June 12,
2012 beginning at 7:00 PM at the North Andover High School. Town Counsel Thomas J. Urbelis and Kelli
Gunagen, Assistant Attorney General said that the proper process must be followed and suggested a
clarification. The Board was requested to vote a clarification.
William Gordon made a MOTION, seconded by Rosemary Smedile, to rescind the vote of September 26, 2011
to hold the Annual Town Meeting on Tuesday, June 12, 2012. Vote approved 4-0.
William Gordon made a MOTION, seconded by Rosemary Smedile, to vote to hold the 2012 Annual Town
Meeting on Monday, May 1, 2012. Town Bylaws Chapter 59-6 stating that the "Annual Town Meeting shall be
held on the first Monday in May at 7:00 p.m.) Vote approved 4-0.
William Gordon made a MOTION, seconded by Rosemary Smedile, to vote to delay the 2012 Annual Town
Meeting until Tuesday, June 12, 2012 at 7:00 p.m. at the North Andover High School. (Pursuant to
Massachusetts General Law Chapter 39 Section 9). Vote approved 4-0.

Town Clerk Joyce Bradshaw and Town Counsel Thomas Urbelis will be drafting articles make these changes.
FY12 Tax Classification —Final Vote
The Board discussed various options and shifts before setting the tax rate as to not burden the homeowner or
the businesses in town. They decided to keep the shift% at 1.31 with an estimated residential tax rate at
$13.92 and an estimated CIP tax rate at $19.16.
Rosemary Smedile made a MOTION, seconded by William Gordon, to adopt a Residential Factor of.9517.7
for the purposes of classifying the FY2012 North Andover Tax Rates. Vote approved 4-0.
The Board was asked to sign the Classification Tax Allocation by Tuesday for submission to the Department of
Revenue.
NEW BUSINESS:
Mutual Agreement with Town of Andover— Local Building Inspector
The Town of Andover and the Town of North Andover have drafted a temporary employment agreement for
sharing a building inspector, Brian Leathe. Town Counsel has reviewed the agreement and the Board is
asked to approve the mutual agreement.
Rosemary Smedile made a MOTION, seconded by Donald Stewart, to approve the mutual temporary
employment agreement with the Town of Andover sharing a building inspector, Brian Leathe. Vote approved
4-0.
Note: The Board wished everyone a Merry Christmas and Happy Holidays.

Rosemary Smedile made a MOTION, seconded by Donald Stewart, to adjourn the meeting at 8:00 p.m. Vote
approved 4-0.
