Liporto Richard M.Vaillancourt '� °o,�_���< �'� * Zoning Enforcement Ofcer �I& ACHU`� Gerald A.Brown DRAFT MINUTES Tuesday, June 9, 2009 at 7:30 p.m. 120 Main Street, North Andover, Massachusetts Members present: Albert Manzi, Ellen McIntyre, Richard Byers, Richard Vaillancourt. Associate Members: Thomas Ippolito, Daniel Braese, Michael Liporto. Also in attendance: Zoning Enforcement, Officer Gerald Brown. Excused absence: Joseph.LaGrasse (Manzi stated that he wanted the record to reflect that they hope Joe is feeling better soon). 1. Chairman Manzi called the meeting to order at 7:35 Pledge of Allegiance 2. COMMUNICATIONS a)Osgood Residences resolution on fees Chairman Manzi stated he would like to put off this matter at today's meeting. Manzi stated he is hoping to wrap this matter up on one of the next 2 meetings. Atty. Smolak submitted a memorandum to the board members in regards to the refund of fees. b)Orchard Village Definitive Subdivision Review Manzi stated that he has received some procedural reviews and also some communications on this. Manzi stated that he has forwarded this to the Town Counsel. Town counsel has had the opportunity to talk to Atty. Borenstein. Borenstein spoke on behalf of his client stating that there is a request for a pier review on the subdivision plan and also wanted the board members to know that money was put in an escrow account. Manzi stated that we should be getting some additional information and feedback regarding this project from Town Planner, Judy Tymon. Borenstein stated that the Orchard Village Projects lots will be sold to individual home owners. Borenstein also stated that they need the board's endorsements for the comprehensive permits and that no changes to the plan were made. Liporto Richard M.Vaillancourt '� °o,�_���< �'� * Zoning Enforcement Ofcer �I& ACHU`� Gerald A.Brown Manzi wanted the approval of board members to sign the Hancock agreement in order to move the project to different town departments such as the DPW, building, planning, etc. for technical review and approval. McIntyre made a motion to execute the agreement. Vailancourt second the motion. All were in favor. c)Gail Apkarian request to review June 18th Manzi stated that he had talked to Gail Apkarian and that he addressed and answered a procedural question and that she will be at the next meeting scheduled for June 18tH 3. CONTINUED HEARING a)Jeffco, Inc. Special Permit R-4 for premises at 46 Camden Street (Map 85, Parcel 110 Atty. Scalesi spoke on behalf of the applicant, stating that this is a very old house and that his client wants to raze the structure and build a new one that will face Concord Street rather then Camden Street. At the last meeting they had a few concerns on this project. Scalesi stated that the driveway was one concern and now they have a new plan with a better configuration of the driveway Scalesi stated that the other issue was trees and addition arborvitaes to be planted to give some additional shielding to abutters across the street. Scalesi stated the last issue was survey markers across the street. McIntyre spoke up and said that she appreciated very much that the plans were submitted in a timely manner. Manzi thought the changes made sense. Manzi requested if the board or abutters have comments. Zoning Enforcement Officer, Gerald Brown stated that he was in agreement with the plan. Byers made a motion to close the public hearing. Vaillancourt second the motion. All in favor to close public hearing. Vailancourt made a motion to approve the special permit with various conditions. Liporto Richard M.Vaillancourt '� °o,�_���< �'� * Zoning Enforcement Ofcer �I& ACHU`� Gerald A.Brown b) At 8:24 the meeting was called back to order to discuss Highland View Realty at 40-42 Highland View Avenue in regards to when the time would run out on this hearing and if it can still be heard on June 18tH According to Zoning Admin Asst, Mich Glennon they are within the time, but time will be running out in a few days (after the June 18TH meeting) and the board will have to act on this petition or sign a time constraint at that next meeting. Motion was made by Vaillancourt to continue the hearing in June. A second was made by Byers, but imposed with conditions to possibly call a special meeting. All were in favor. 4. Motion to adjourn was made by Byers. A second was called by Vaillancourt. All were in favor. Meeting Adjourned at 8:30. Page 3 of 3 June 9,2009
