Clerk Hollis Curtis Town Office Building 14-20 Bixby Avenue and 120 Main Street South side of Clarendon St . North Andover, Mass. Petition No. 40- ' 84 Dear Mr . Long: The Board of Appeals held a. public hearing on Monday evening, August 13, 1984 upon the application of Hollis Curtis . The hearing was advertised in the North Andover Citizen 'on July 26 and August 2, 1984 and all abutters were notified by regular mail . The following members were present and voting: Frank Serio, Jr . , Chairman; Alfred E. Frizelle, Esq. , Vice Chairman; Richard J. Trepanier , Esq. , Clerk; William J. Sullivan; and Augustine W. Nickerson. The petitioner seeks a variance from the provisions of Section 7, Paragraph 7. 1 and Table 2 of the Zoning By Law so as to permit relief from the minimum lot area requirement to allow the division of one lot into two lots on premises located at 14, 16, 18, and 20, Bixby Avenue, and the South side of �C.larendon Street , located in the Residential-4 (R-4) zoning district . Counsel for the petitioner testified that the parcel consists of 20, 100 + square feet and the petitioner proposes to divide the lot into two parcels, one consisting of, 12, 076 square feet, shown as Lot ,A on the plan with frontage on 'Bixby Avenue and the other con- Sdstin91­051­8, 0 eet , shown'' as Lot B wit frontage on Clarendon Street . There is an existing four-family dwelling on Lot' A, and the petitioner proposes to .construct, a two-family on Lot. B. The :' stru.ctures . shown i:n., ..tripes, on the plan. will ,be razed. The Board took the petition under advisement and rendered a decision at their regular meeting held on Monday evening, September 17, 1984 with Members Frizelle, Trepanier , Sullivan and Nickerson present and voting . Upon a motion made by Mr . Trepanier and seconded by Mr . Sullivan, the Board voted unanimously to grant the petition with the following conditions: 1 . Only a single family dwelling may be constructed on Lot B. 2. The buildings shown on the plan to be razed shall be razed prior to the issuance of a building permit . 3. There will be, a new driveway. off Bixby., Avenue to serve Lot A. In granting the variance, the Boardfindsthat Section 10. 4 of the Zoning By Law has been satisfied. In particular ,. the Board finds that said variance will not affect the zoning district in general since the district is an 'older neighborhood with several under- sized parcels . The Board further flinds' that desirable relief may be' granted -withoit nu> > i Eying or ,substantial'ly d.e-r--agat'ing from the intent or purpose of the Zoning By Law and without detriment to, the public good, but that said' relief is limited to a single family dwelling due to the parking situation in the particular neighborhood.
