The following members were present and voting: Chairman Frank Serio, Jr. , Vice Chairman, Alfred E. Frizelie , Esq. , Clerk, Augustine W. Nickerson, William J. Sullivan, and Raymond A. Vivenzio. The petitioners seek to prohibit Mr. Picariello from using R-2 zoned property to store his contractors ' equipment and vehicles . Motion made by Mr. Frize lle that decision of Building Inspector be reversed and Board finds : Property in question is in violation of Zoning Bylaw, Section 8. 1 Off-street Parking - sub paragraph 11, specifically the parking of commercail vehicles such as trucks, bulldozers , buckets and flat bed trailers in excess of the .limits of the Bylaws. Picarello, Forest Street , North Andover, MA 01845 Dear Mr. Picarello, On October 23, 1985 you and your engineer, John O'Connell, met with the NA CC to discuss the work which has been ,taking place on your property. This work is within .the buffer zonae of a wetland, therefore is subject to the interests of the Wetlands Protectiori'Act Regulations (M.G.L. Chapter 131, Section 40). The NACC is requiring that you file a Notice of Intent in order to comply with our Enforcement Order dated October 16,- 985 (see enclosed). This order was issued as a result of our site visit which identified violations of the Wetlands Protection Act. Specifically, we observed alterations and filling of land within the buffer zone and possibly weticbnd resource areas. As discussed., a filing of this Notice of Intent was to be in our office by November 1.3, 1985, or a progress report of such if not yet complete. Items the NACC would like to recieve on this filing are: a description of the previous and proposed work, a descrip— tion of the wetland resource areas on' the site., a.plan showing the proposed activities and the measures to mitigate the impact on the wetland areas,and an analysis o f'how the work meets.the pre formance standards of the wetland regulations.. May 21, 1985 1 5 Mr. Melvin Prohl 51 Towne Boad ; I3oxfordt Ma. 01921 ' Re: Picariello property on Forest Street North Andover ' Dear Mr. Prohl and other residents of Ardon Farm in Boxford; I have reviewed the Picakiello property with a concern for the issue raised in your letter of May 69 1985 gr I find the Picariellogs are working hard to realize an" American Dream", namely a home of their own on sereral acres devoted to t agriculture and animal husbandry, Trees are being felled and hauled to the mill or out for firewood, land is being leveled for pasture, a farm pond has been dugtloani is being hauled in for a gardenasdd lawn,,retaining walls are being built. �. This work is being done evenings, weekends and holidays. VA .17 quipment,heavy machinery and materials ars being hauled thorugh your area to do the work. While this activity and noise disturb the tranquility of Ardon Farms it is not a Zoning violation, nor is the site in violation as a contractors yard. Mr. Picariello normally keeps his equipment in Topsfield. Foster Inspector of Buildings Town of North Andover, MA 01845 RE: Petition to Enforce the Zoning By-Laws Dear Mr. Foster: We, the undersigned residents of Ardon Farm in Boxford, hereby petition you to take action against Mr. Philip Picariello of Forest Street, North Andover to enforce the zoning by-laws of the Town of North Andover. Since Mr. Picariello took title to the land on Forest Street in 1976, he has used the property which is in an R-2 residential zone as a contractor's storage lot, and he has also stripped soil from the property. These violations are covered in two letters which you sent to Mr. Picariello ask- ing him to cease and desist (copies of these two letters dated May 27, 1983 {; and January 31, 1984 respectively are attached) . �4 Early in 1984 Mr. Picariello was granted a.building permit and now lives ori the property. Loads of material continue to be trucked in and also continue to be trucked out. In addition, flat bed trailers, either empty or loaded with contractor's equipment, are frequently hauled through Ardon Farm to and from < job sites elsewhere. `i Since Mr. Picariello has not properly responded to the order in your letters, we petition you to now take more positive action to enforce the zoning by- laws. Secondly, we specifically request a ruling on the number and types l of contracting vehicles and equipment which can be parked on the property. The zoning by-laws allow four motor vehicles to be parked on a lot in a residential zone and two of the four vehicles may be commercial (if the commercial vehicles are over one ton, they must be either garaged or screened from sight) .
