Dear Mr. Long: Ahy appeal shall be filed within (20) days after the date of Ming of this Notice In the Office of the Town Clerk. April 15, 1983 F&W Realty Trust 1725 Osgood Street Petition No. 23-183 The Board of Appeals held a public hearing on Monday evening, April 11, 1983 upon the application of F&W Realty Trust. The hearing was advertised in the Lawrence Eagle Tribune on March 28 and April 4, 1983 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice Chairman; Richard J. Trepanier, Esq., Clerk: William J. Sullivan; and Augustine. W. Nickerson. The petitioner seeks a variance from the provisions of Section 7, Paragraph 7.3 and Table 2 of the Zoning By Law to allow the con- tinued existence of a foundation which does not meet the setback requirements of the Zoning By Law on premises located at 1725 Osgood Street. The petitioner testified that due to a misunderstanding of the Zoning By Law, the foundation was placed 24 feet from'the lot line. The parcel in question is located on a corner and the Zoning By Law states "Buildings on corner lots shall have the -required front setback from both streets except in Residence 4 District.where set; back from the side street shall be ;20 feet minimum." The parcel is located in an I -S district and the foundation was completed before the violation was discovered. Upon a motion made by Mr. Frizelle and seconded by Mr, Nickerson, the Board voted unanimously to grant the variance .as requested. The Board finds that the conditions set forth in Section 10.4 have been satisfied. In particular`, the Board finds that due to the slight deviation from the requirements of the Zonin g:'By Law,' a literal enforcement of the By Law would create a hardship to the petitioner. RealtyT� rust The problems of the above petition came about as TEL. 688-8102 A special permit for footings and foundation only was issued by the Building Department pending development of complete building plans. The petitioner obtained a copy of the dimensional requirements from our Zoning By—Law and proceeded to install the footings and foundation according to those dimensions for an Industrial—S District. At a later date, the petitioner was re— quired to submit an as—built foundation plan before applying for a building permit and I found that at that point, they were in violation of Section 7.31 which requires the front setback from both streets on a corner lot. This situation has arisen because of the fact that all of the dimensional requirements are not incorporated in Table 2. Very truly yours, CHARLES H.
