The following members were present: William J.Sullivan, Walter F. Soule,Raymond Vivenzio,Scott Karpinski, John Pallone,George Earley,Ellen McIntyre,Robert Ford, The hearing was advertised in the Lawrence Tribune on 12/29/98& 1/5/99 and all abutters were notified by regular mail. Upon a motion made by Raymond Vivenzio, and seconded by John Pallone,the Board voted to deny the applicants request for a variance and zoning relief to allow construction of homes in the sequence and number as outlined in the application as lots 1 through 92 Forest View Estates by the above and cited on the plan titled;Definitive Subdivision Plan for Forest View Estates,Salem Turnpike-Route 114,North Andover Mass.Mesiti Development Corporation; dated September 22, 1997;by MIIF Design Consultants,drawn by Frank C.Monterio Civil stamp number 36341. The petitioner could not prove that the application met the requirements for a variance as follows: 1. The Board found the deviation from the zoning by-law would cause an undue burden on the Town services.As such the denial was based on the Board seeing the granting of the application as a substantial detriment to the public good and would nullify the intent and purpose of the by-law,specifically the growth management by-law. 2. There was no evidence that indicated there was sufficient reasoning for hardship caused by unique conditions of the lot such as soil conditions,shape or topography of the land. 3. The applicant presented that there was a considerable cost borne by constructing a sewer line to the development. A required improvement to facilitate development does not constitute hardship for the purposes of the Zoning Board. The motion passed unanimously.The following members voted:Walter F. The requested variances and zoning relief would vary the Build-Out Schedule which the Planning Board was required to impose under Paragraph 4.2.1 (the Phased Development By- Law) and Paragraph 8.7.4 (the Growth Management By-Law). G:\RWUKEEP\FRSTV W.SHT Sheet 7A Reasons for Requested Relief Applicant: Mesiti-Moore's Falls, LLC Affected Land: 71.529 Acres, Turnpike Street Comprising 92 Lot Subdivision Named "Forest View Estates" 1. The Applicant believes his circumstances are exactly the same as those of the Applicant in the Variance Application granted on 5/20/94 by the Zoning Board of Appeals ("ZBA") in Petition Number 018-94 (the "Foxwood Subdivision") (said Petition 018-94 and the relief granted thereunder is referred to herein as the "Foxwood Variance"). 2. The Foxwood Subdivision is comprised of 49 single family residential lots, which under the Phase Development By-Law (Section 4.2) required a 4 year build-out. The Foxwood Variance granted by the ZBA in 1994 shortened the required 4 year build-out to a 2 year build- out under which 25 building permits were allowed in the first year, and 24 building permits were allowed in the second year. 3. The hardship associated with the Foxwood Subdivision was found by the ZBA in the shape and size of the lot and the topography of the land (the property being located on the side of a hill). The conclusions of the ZBA under the Foxwood Variance seemed to be that desirable relief in the form of a shortened build-out requirement of 2 years (rather than 4 years) would result in the subdivision being stabilized, built and brought to final completion in a shorter time frame which would therefore be less disruptive to the abutters, and to the new homeowners buying lots in the Foxwood Subdivision. 4. The Applicant (Mesiti-Moore's Falls, LLC) as owner of the Forest View Subdivision respectfully suggest that the same factors apply to Forest View Subdivision as affected the Foxwood Subdivision. The land area is substantially larger, and the number of lots in Forest View Subdivision is 91 buildable lots (and one playground lot), while Foxwood Subdivision involved 49 lots. 5. In view of the size differences between the two subdivision, the Applicant is requesting that the same 50% reduction in build-out length be allowed by variance. This would shorten the build-out from 8 years, down to 4 years. 6. The Applicant's lot places a hardship on Applicant owing to circumstances relating to the soil conditions, shape and topography of the lot, which especially affect the Applicant's lot but which does not generally affect the Zoning District in which Applicant's lot is located. 7. With respect to soil conditions, the Applicant has various outcroppings of ledge existing on the side of the Property. With respect to topography, the lot slopes downward significantly from the rear of the lot to Turnpike Street. 8. A literal enforcement of the provisions of the Zoning By-Law would involve a substantial hardship, financial and otherwise to the Applicant, which hardship (as noted above) is owing to circumstances relating to the soil conditions, shape or topography of the Property which especially affects the Property but does not generally affect the Zoning District in which the Property is located. The relief requested is desirable, in that it will allow the disturbed areas in the Forest View Estates Subdivision to be worked on an stabilized more quickly, with less chance for erosion (in the event of unforeseen events, all foreseen events having been designed for) which will be more beneficial to the new homeowners within the Subdivision, all without substantial detriment to the public good, and without nullifying or substantially derogating from the intent or purpose of the Zoning By-Law. Please see the attached charts for reference. Under the Growth Management Bylaw this subdivision is eligible for 11.4 building permits per year starting in April of 1998 and ending in April of 2005. The building permits are issued on a quarterly basis. This project also falls under the Phased Development Bylaw, which allows 15 building permits per year starting in April of 1998 and ending in April of 2004. The building permits are issued on an annual basis. As the Growth Management Bylaw is more stringent than the Phased Development Bylaw the Growth Management Schedule applies. Therefore this project is eligible for 11.4 building permits per year and will take a minimum of seven years to complete. The attached Growth Management Schedule must be signed, submitted to the Planning Board for final review, and recorded. As required by Condition 4(c)of the Planning Board's decision of April 13, 1998,the Proposed Construction/Erosion Control Schedule must be amended to conform to the seven-year buildout. The current schedule contemplates a six-year buildout. I have tentatively scheduled endorsement of plans for the November 17'h Planning Board Meeting however I must receive all of the required documents and revised plans as set forth in BOARD OF APPEALS 688-9541 BUILDING 688-9545 CONSERVATION 688-9530 HEALTH 688-9540 PLANNING 688-9535 Condition 4 of the Planning Board approval dated April 13, 1998 by the end of the day on November 10, 1998.
