The undersigned hereby, further covenants and agrees with the. Town of North Andover, upon approval of said DEFINITIVE plan by the Board: 0 1. To install utilities in accordance with the rules and regulations of the y Planning Board the Public Works Department#Department, the Highway .Sr, theurveyow Board of Health, and all general as well as zoning by-laws of said Town, as are applicable to the installation of utilities within the limits of ways and streets; 4 2. That, individual septic system y permits must be obtained prior to the issuance of a building permit from the Board of Health under the rules and regulations of Title "V" of the state sanitary code; and that the developer shall, prior to the sale of indivi- dual lots to individual owners, submit to the Board of Health percolation tests showing the suitability of said lots for the installation of subsurface disposal sy3tems for single family dwellings_,-, however..:auch restriction shall not prevent the mortgage of said lots or the sale to developers or home builders against whom this condition shall also remain applicable and enforceable until complied with; 5. That, no work shall be done in the subdivision until security in the form of a bond or covenant has been duly recorded and the plans are signed and recorded; 6. That, any changes made to the definitive plan by other town agencies or officials vl' shall be submitted to the Planning Board by the applicant; 7. That the recommendations of the Highway Surveyor's letter dated July 2, 1979 shall be adhered to as follows: a. all drainage pipe shall be R.C.P. with a minimum of two (2) feet of cover on pipe sizes eighteen (18) inches of cover and thirty (30) inches of cover on pipe sizes less than eighteen (18) inches. No metal or squashed pipe shall be allowed within the subdivision drainage system; b. two additional catch basins shall be located at approximately station 10+50 on Road B (Donna Dr.); c. manhole at station 19+00 and 20+00 on Road A (Mary Ann Dr.) shall be a catch basin; d. all drainage shall be tied into a continuous drainage easement throughout the entire subdivision; e. Cape Cod Berm to be required where and when deemed necessary, to be deter- mined in the field; where berm is required, the paved road width and gravel base shall be widened two feet in total to accommodate the berm base; f. no house drainage systems shall be allowed to drain into the street, all such drains, (if any), shall be incorporated into street dcainage with a permit being required and Town specification complied with; g, cul-de-sac shall be 100 foot radius with the required land area to be under ownership of the developer of the road network until such time as the:.road is extended; 8. That the hydrants (17) shall be located in accordance with the Fire Dept. 's letter dated June 19, 1979 and as marked on said plan, including an additional hydrant on lot 39 at the intersection of Road A and B; 9. That all water improvements shall be in accordance with the recommendations of the Board of Public Works letter dated July 2, 1979; 10. That a Notice of Intent shall be submitted by the applicant to the Conservation Commission pursuant to M.G.L. That the applicant shall obtain a Certificate of Compliance from the North Andover Conservation Commission with regard to any Order of Conditions issued by said Commission under M.G.L. Ch. 131 prior to the final release of any bond or covenant; 12. That a right-of-way shall be provided on either lot 16 or 17 to ensure Mr. Charles Label access to his property which abuts said subdivision; yr 13. That no work shall commence within the entire subdivision until detailed plans and specifications for a control structure at the so called :t Myers Pond" (which fronts lots 1, 2, 3, 4, 5, 6, 71 81 & 9) are furnished by the developer to the Conservation Commission which ensures that the elevation of the said pond is controlled and that the existing drainage conditions in said area are not aggravated; 14. That the development of said subdivision and the construction of structures shall not violate the drainage flow calculations computed by Frank C. Gelinas, Registered Professional Engineer, which were submitted to the Planning Board on July 6, 1979; 15. That approval of said subdivision encompasses pages 1 through 7 .and 1A through 7A inclusive of the Definitive Campbell Forest Subdivision Plan dated May 11, 1979• NORTH ANDOVER PLANNING BOARD i
