Dear Mr. Long:
The Board of Appeals held a public hearing on Monday, November 14,
1983 upon the application of Jose Bruqueta. The hearing was ad-
vertised in the North Andover Citizen on October 27 and November 3,
1983 and.all abutters were notified by regular mail. The following
members were present and voting: Frank Serio, Jr., Chairman; Richard
J. Trepanier, Esq., Clerk; William J. Sullivan; and Associate Members
Walter F. Soule and Raymond A. Vivenzio.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7.3 and Table 2 of the Zoning By Law so as to permit the
construction of a,garage which will not meet the side or rear setback
requirements on premises located at 25-27 Pleasant Street.
The petitioner testified that the proposed -location of the garage does
not interfere with other property in the neighborhood and, aesthetically,
the location as shown on the plan is the—best- 'placement ----of -the structure.
In addition, the proposed garage is located further from property lines
than other garages in the neighborhood. Denial of the variance would
create a detriment to the architectural harmony of the area.
The Board rendered its decision at a regular meeting held on Monday,
December 12, 1983 with the following members present and voting: Frank
Serio, Jr., Chairman; Richard J. Trepanier, Esq., Clerk; William J.
Sulli.van; and Associate Member Walter F. Soule.
Upon a motion made by Mr. Sullivan and seconded by Mr. Soule, the Board
voted unanimously to grant the variance as reggested. -

The principal points upon which I base my application are as follows:

Sec. I APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board. -Thete_.-forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is -made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters w.ithin three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list, notwithstanding that the land,of any such owner is located
in another city or town, the Planning Board of the city or town, and
the Planning Board of every abutting city or town.
* Every application shall be submitted.with an application charge cost
in the amount of $25.00. In addition, the petitioner shall be respon-
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mai.ling and publication, but
are not necessarily limited to these.

Dear Members:
First and foremost I want to apologize for
overlooking Section 7-7.3 of the land regulation of the
Town of North Andover. I must confess and recognize my
ignorance of the aforementioned regulation at the time
of the building project.
However, concerning my property specifically
I would like to take this opportunity to state that the -
application of this land regulation would be directly in
detriment to the esthetic and physical appearence of my
propiety and it will be breaking the architectural harmony
of the entire neighborhood block. Also the application of
the land regulation would result in a tremendous waste of
land which would not serve any good purpose. As it stands
presently, the location of the garage also does not inter-
fere with the other propieties. Therefore, I kindly and -
respectfully ask the Board to approve the building permit. -
