Dear Miss Sheridan: I enclose herewith a tentative form of letter for the Board of Health to write to Stanley Stefanowicz, concerning the two septic tank installations on his prop- erty, north of Great Pond Road. As I suggested to you, when this letter goes forward to Mr. Stefenowicz, you should be able to have for your files some evidence that he actually received it, even if it means your sending for him to come to your office, so that you may hand it to him personally. Cregg, Esq., communicated with this Board, relative to your application for building permits for houses which you planned to erect on two lots of land situated on the northerly side of Great Pond Road. From an examination of our records, it appears that certain permits were issued to you for the installation of private sewage disposal systems upon each of these lots sonle time ago; we understand that you have installed such systems in conformity with those permits. In view of this fact, this Bbard voted not to oppose your present appli— cation for building permits at this location, and you may so inform the Building Inspector. However, this action of the B -Pard is based upon the facts above recited, and is not to be taken by you as any indication that the Board will approve future applications which you may make for permission to erect structures or install sewage facilities at other locations on your land. The Board expressly reserves its right to consider each such application by you or your successors in title upon its own facts, and to refuse its permission for any such future structures or installations, if in its opinion the public water supply of the town of North Andover might be endangered thereby. Moreover, you are not to interpret the action taken by the Board upon your presently pending application as indicating the position which it may finally take, upon whether or not any further subdivision by you of your land lying to the north of Great Pond Road will fall within the provisions of the Subdivision Control Law of the Commonwealth. (#2. ) I Your attention is specirically directed to those provisions, as well as to the rules and regulations adopted by this Board, relative to building permits and to sewage disposal permits. I It would be most helpful if Inspector to observe any requests made or the Board of Health with reference June 19, 1954. to represent developnent. which is your Board would instruct the Building of him by either the Planning Board to the Stanleyville area. In connection with the new statute referred to in my letter to the Planning Board, I feel that I should call to your attention that until and unless the town adopts a new by"law authorizing the creation of a'"planning" board oll appeals, you must perfom the duties of such a board. G. L,, c. 410 § 81Z (as added by StAt,,1953, c. 674, § 7). Since those duties might well, in some instances become unduly.burdensome, I suggest that you sponsor an Article for the consideration of the next town meeting, which would allow you to establish an independent board to perform them. I enclose herewith i a tentative draft of such an article, for your study, Said § 81Z provides that the enabling by-law my provide that the existing "zoning" board of appeals should also hear appeals from the Planning 36ard, I think you may agree that this would be inadvisable for several reasons, I am sending a copy of this letter to the Planning Board, which might also have some interest in the establishment of the new appeal board, Ver7 truly yours, ARNOLD H. SALISBURY, June 19, 1954 North Andover Planning Board Town Building North Andover, Massachusetts Gentlemen: The North Andover Board of Health has asked me to represent its interests in'the matter of the so-called.Stanleyville real estate development at the northerly end of Lake Cochichewick. Recent surveys made at its request seem to indicate that the installation and maintenance of private sewage disposal systems In thig area, mnless supervised with the greatest of care,,might result in the c&ntamination of the lake, and the Board of Health is therefore most interested in being advised promptly of any contemplated construction so that it may take steps appropriate to the protection of the Townts water supply. . In my opinion, notwithstanding the fact that the Stanleyville lots have frontages along Great Pond Road, the development is a3lbiubdivision" within the meaning of the new Subdivision Control Law; I have discussed this matter with a member of your Board,, Ralph E. Finck, Esq., who is familiar with my . position . If your Board agrees.with it,, the problem of the Board of Health will be to a large extent solved, since (1) the Building Inspector should not issue further building permits in the 8tanleyville area until your Board has first examined and approved the Subdivision Plan,, (G. L. c. 41, § 812). and (2) your Board will consult with the Board of Health as to any possible injury to the public health before any such approval is given (G. L. c. 411, § 81U)4 - I should therefore appreciate your -letting me know, as Soon as possible, whether or not I may inform the Board of Health that YOU will notify the Building Inspector that in your opinion the pr*posed Stanleyville development is a subdivision within the new law,. so that he should grant no building permits applicable thereto without further clearance from you. The State Department of Public Healtho in.a,letter to the Torin dated August 20, 1948, stated that it had examined the area and fthe recent examination shows that the character of the soil at this site is not well adapted for the disposal of sewage in the ground.f It was of the opinion that 'the devel- opment of land for real estate purposeb within 250 feet of the pond in the area under consideration Is unadvisable, and con- tinues to recommend that for all land developed for housing purposes, suitable provision be made for the disposal of all sewage in a manner which will prevent pollution of this viater supply. The Department is of the opinion that before such ad- equate provision can be made for the disposal of sewage in this area, should any considerable number of houses be con- structed thereino it will be necessary for the town to provide a sewerage system to remove sewage from this area to a connect- ion with the existing sewerage system of the town.' In a letter to the Town dated August 20, 194ft the State Department of Public Health approved, with certain modifications, the plan of sewage disposal for a single house on the premises of Mr. and Mrs. N. Artimovich in the Stanleyville area. The modifications suggested by the Department were prefaced by the statement fIn view of the character of the soil at this site which is not well adapted to sewage disposal purposes........1 This office reported to your Public Works Department under date of December 29, 1948 a suggested system of collecting sewers for this area. It stated fAs a result of an examination of the area on December 3, 1946 we are of the opinion that the ground along Great Pond Road is not suitable for private sew- age disposal..,..., The lots in question have a frontage of 100 feet each on Great Pond Road, with depths ranging from 301 to 332 feet. * Copy of a letter to the property owner. North Andover Board of Health June 4. 1954 20 The land slopes steeply toward the pond, and the site of the houses on these two lots has been formed by cutting into the hillside. On the date of our examination the cellar walls of both houses had been constructed. The sewage disposal systems of both houses had been installed, and a description of them was given Mr, Bogren by the builder, Mr.Stefanski. Samples of soil from each lot were collected from excavations for rear porches, close to and at the same depth as the sewage disposal systems. The houses have 3 bedrooms, and are estimated to have five occupants each. The sewage disposal systems are said to be about 300 feet from the pond, and are located at the rear of the houses, at the foot of the embankment out into the hillside. The ground in which the sewage disposal systems are located is about 10 feet below the original ground surface. The soil samples did not look suitably permeable'for sub -surface sewage disposal. The lot #17 sample contained stones larger than lA" to the extent of 70% of its dry weight,, while the lot #18 sample was made up of , 80% of stones larger than 1/40. Sieve analyses of the material passing 1/4 ti sieve gave the following results. - Effective Uniformity Source Size - rm Coefficient Lot #17 0.11 6 M_ Lot #18 0.07 5:lk The lot #17 sample may be considered.fine in size -.the lot #18 sample, very fine. Each house is served by a 500 gallon septic tank, a size which is adequate. The -septic tank effluent is discharged to a dis- tributing manhole, from which 3 lines of leaching tile extend. a distance of 30 feet each, or a total length of 90 feet for each house. An area 10 feat x 30 feet was excavated to a depth 2 feet below the 4" bell and spigot tile pipe. Two feet of gravel such as is, used for roadways was then placed In the excavation, levelled, and the.tile pipe laid with open joints. The pipes�are therefore about -4 feet apart, After laying the; pipe, 2 feet of gravel was filled -above their bottom., and the ' levelled gravel covered with roofing paper. Ordinary excavated material was used to fill the balance of the excavation. The premises were viewed during'the wettest season pf the wettest spring on record. There was a small percolation of ground water into the cellar excavation on lot #17, but none in lot #18 - concrete cellar floors had not been laid. We believe both installations have one defect - failure to surround the leaching -tile pipe with graded stone to prevent clogging of the open joints by fine material in the surrounding gravel. We have talked with the Sanitary Fmgineering Division of the State Department of Public Health, and have been informed North Andover Board.of Health June 4,, 1954 that their approval of the system of disposal assumed that the leaching pipewould be surrounded with graded stone., as is customarily done with open -jointed drains. The length of leaching pipe is none too long, considering the fineness of the soil; we would prefer 125'. However, there is room to extend the pipes when required. In short, the useful life of the disposal system has been shortened by surrounding the tile pipe with gravel instead of graded stone. Greater length of pipe would obviousy increase the expected life of the system, All things considered, the systems should function satisfact- orily for some years. When the leaching pipe fails to dispose of the sewage flow, its length should be extended, and the present 90 feet relaid, in graded stone. No system of private sewage disposal into the ground will last indefinitely. Eventually any system will.become exhausted, and the poorer the soil, the sooner the exhaustion. Only periodic inspection by the municipality will insure that the extension Is made when necessary. In these cases on lots #17 and #18, the location of the disposal systems in the rear of the houses insures that any failure in operation will not go unobserved, as sewage would come to the ground surface close to the houses, beside the steep embankment, and would have to pass the house to escape the premises.
