Mr. Scanlon ill. Minutes of previous meeting accepted and signed. Current bills signed. LONGUEIL PROPERTY -The problem bf durping tree stumps and ether fil$ by the Highway Dept and the Tree Dept and others to fill a depression in the yard of John Longueil Forest St. Mr. Lafond, Tree Warden, said he had agreed to supply Mr. Longueil with fill, but was informed by his foreman that none had actually been put there by the Tree Dept. Mr. Cyr from Highway Dept. was late for the meeting and later commented that his department had agreed to put stumps and other road scrapings in at the request of Mr. Longueil. Board voted to allow the fill to remain, instructed Mr. Lon- gueil to finish covering it over and to cease all further dumping. PLUMBING FAILURE 65 Water St: Anthony Melillo, owner of property at 65 Water St. appeared at Board's request. Said he had been trying to get a plumber to do the work and didn't knot,* if it had been done. Said he was trying to sell the property and he felt the Board was wasting his time. Dr. Kay cautioned him that unless the pipe was fixed, the property would be condemmed. Board voted to have plumbing inspector make another inspection 4/4/78. GOULD LOT GREAT POND RD -Charles Gould explained to Board he had a lot of land on Great Pond Rd., perked in April 1976. He never presented the plans for the system and consequently no septic tank per was issued. Feels his lot should be considered under the old regulations and not the 1500 ft regulation of 11/1/77. Dr. Kay advised Mr. Gould that in view of the pending court case on Campion Hall, no discussion or decision could take place and that Mr. Gould would have to wait until completion of that case for a decision from this Board. GEORGE FARR, GRANVILLE LANE: Mr. Farr pro ested tha fact that he one ye ar validity cruse on percolations meant that hundreds of dollars he spent percolating lots on Granville Lane were wasted. Feeels theee is no great change in the land and that the valid date of the perks could be extended. Board voted to have Mr. Phillips spot check three or four of the lots to make sure conditions were about the same and if so, to extend the dates on the old perks. BEN OSGOOD, LOT 40 RALEIGH TAVERN RD: System installed without designs or installers permit. Covered over without inspection. Mr. Osgood to have his engineer draw up a set o s2- and: take -out the proper- permits. BEN OSGOOD, Lot 33 RALEIGH TAVERN RD: Mr. Osgood filled lot with stumps and debris causing water blockage and eventually odors from stagnant water. Mr. Osgood to submi set of plans for grading to all boards including, Conservation, Planning and Health. VARIANCE_REQUEST- LIf—Z`ForestSt:- System does not comply -with Town regulations for distance from wetland, but does comply with Title 5. Conservation Commission prefers to allow trees to stand rather than have owner fill in wet area. Board voted to allow system to be installed as per designs sub:ro tted. A. FORESTER: Discussed with Board land his family owned on Dale St. which falls in watershed. Was. told same as Mr. Gould that nothing could be discussed until the court case is completed. LOT 11 SALEM ST: Board voted that the damaged distribution box on this system would have to be replaced and not repaired as requested by installer. COTTONS, 1062 SALEM ST: Mr. Phillips reported that this system was in complete failure. Lot 9, Campbell Rd. -Nothing has been done on this lot to rectify violations. Board voted to notify installer, Geoffrey Speers, to appear at May meeting for hearing. Parcel 1, So.Bradford St. -Mrs. Hurley has failed to respond to letter of 1/10/78 instructing her to have extra pit installed. Board voted to have dye tests done. - Lot 40, Raleigh Tavern Lane -Ben Osgood failed to respond to letter of 1/10/78/ Board voted to have Mr. Osgood to April meeting. Lot 33, Raleigh Tavern Lane -Ben Osgood failed to respond to letter of 1/10/78. Board voted to have Mr. Osgood to April meeting. Lot 5, Appleton St. -Occupied in 1977 without final grading or any permits. Motion made by Mr. Scanlon, seconded by Mr. Caron to have home owner complete the grading by 5/30/78. Forest St., Paul Pappalardo-Occupied in 1977 without approval of system. No occupancy permit. Board voted to notify owner to have system excavated for inspection by 5/30/78. Lot 9, Ingalls St -Occupied in 1975 wil':hout record of inspections. Board voted to file system. Lot 6, Ingalls St -Occupied with occupancy pernit in 1977. Failed to go grading requested by Board of Health. Board voted to file system Lot 2, Salem St-Occuppied in 1977 with no record of inspections, no occupancy permit. Board voted to file system. Lot 10 Winter St -Occupied in 1975• Mr.Geli-nas refused to approve the system. No occupancy permit. Board voted to file system. Building Inspector Foster discussed with the Board the problem of people moving in without final inspections and occupancy permits. He suggested that this Board not wait for a request for final inspection, but conduct more inspections as the system are being installed. Planning Board and Percolations -Matter of Planning Board passing on sub -divisions when Board of Health had not witnessed preliminary perks was tabled until after town meeting so that it could be discussed with newly elected Planning Board. Article for Town Warrant -Mr. Phillips suggested article for sewering of Osgood St 'j up to and including Maggie's Board voted to table matter until final figures can be obtained from Public Works and then consider a special town meeting. Discussion of article for full time engineer was tabled until Board could discuss it further. Cottone System, 1062 Salem St. -Another complaint received 3/6/78. Inspected on 3/6/78 by Mr. Phillips. Effluent over flow in snow. Board voted to start legal proceedings against Mr. Cottone, because he had ignored his notice to come to a hearing in January. The complaint involves strong odors and poor drainage on this lot. Inspections madb by this Board confirm that the drain- way is clogged by stumps. The odor generated is probably from stagnant water. At our regular meeting January 9, 1978 this Board voted to order you to remove all stumps and debris from this lot. Very truly yours, R. George Caron Acting Chairman 1p;mj cc: Planning Board January 9, 1978 Regular Meeting Meeting convened at 6:30 P.M. All member present, Town Counsel present. Minutes of previous meeting accepted. Motion made by Dr. Kay and seconded by Mr. Scanlon to declare executive session for purpose of discussing court suit with Town Counsel. Executive session began at 6:35 PM. and ended at 7:30 P.M. Dr. Kay had to leave meeting and the chair was taken over by Mr. Caron. Regular meeting resumed at 7:40 P.M. HEARINGS ON INSTALLERS: William King, Methuen, Mass failed to appear for hearing as requested by certified mail. It was moved and seconded that his permits to install septic systems and to remove offal and pump out tanks not be renewed for 1978 until the system on Lot 2 Campbell Rd. be corrected. Present system must be dug up and replaced to conform with plans. Registered letter to Mr. King. Jeffrey Speers, installer for Lot 9 Campbell Rd., appeared as summoned. The installation problems on Lot 9 Cambell Rd will be further discussed by Mr. Speers and Mr. Phillips Attempts will be made to level lines and further reports will be made to Board. HURLEY HOME, SO.BRADFORD ST: Mr. Phillips reported that home built by Mrs. D orothy Hurley has been occupied by her without house being completed and system not approved. System consists of three seepage pits, two of which are filled with ground water and are below water table. It has been recommended to her that fourth pit be built above the water table and that the two pits below the water table be sealed off. Mrs. Hurley objected to further expenses. Motion made by Mr. Scanlon and seconded by Mr. Caron to send registered letter to Mrs. Hurley informing her that the fourth pit must be installed to conform with Title V before an occupancy permit could be issued. Mr. Phillips reported that all of the abobe homes had been occupied by the owners without receiving occupancy permits from the Building Inspector. Mr. Scanlon made a motion to send registered letter to Mr. Foster instructing him not to issue occupancy permits without final inspection approvals from this Board. Mr. Phillips stated that Mr. Foster has not issued any occupancy permits on these properties and that the people just move in before anyone knows about it. C9pies of all such violations are sent to Mr. Foster notifying him that the systems have failed inspections LOT 47 RALEIGH., TAVERN LANE: Permit for septic tank.expired in A -+gust, 1975. New system was installed with unapproved plans and an as built plan by Frank Gelinas was submitted in'late 1977 when a final inspection was requested. Board.voted to send registered letter to Mr. Osgood. CO DEE BUILDERS, LOT 1 & 2 TURNPIKE ST: No installers permit on -Lot 2i no designer certification submitted on Lots 1.& 2 As built plans must be redrawn. Registered letters to Co Dee. LOTS 3-6 WINTER ST: Installer Paul Walsh covered systems without approval. The violations are lack of stone depth and unlevel distribution boxes. Registered letter to Mr. Walsh to appear at next meeting Februay 6, 1978. LOT 1A LACEY ST: Board voted to write to Scott Properties requesting surveyor certification of swelling foundation and septic system. RALEIGH TAVERN COMPLAINT: Complaint received from Grant Emerick and other all residents of Raleigh Tavern Lane regarding effluent odors coming from vacant Lot 33 Lot contains stumps and fill clogging the drainage way. Board voted to send letter to Ben -Osgood requesting that all deris be removed in order to allow free water flow. Mr. Lamprey from Planning Board stated that his Board had already written to Mr. Osgood and had not received any reply. Letter to be registered. TELEPHONE 6854M Re: Raleigh Tavern South Dear Paul: I would like to bring your attention to the fact, that the drainage easement as shown on the plan running to and across the road at approx- imately station 3.0 is being filled in with stumps. This was a channeled drainage ditch and the filling is certainly in violation of what I con- sider numerous reasons for concern that I will go into at this time. This filling and encroachment on the drainage ditch has been'going on for some- time. I would recommend that we issue a cease and desist order on this filling until such time as we can get this matter resolved. Very truly yours, William A. We have, during the past several years, been assured by Mr. Benjamin Osgood that Lot 33A would be filled and landscaped according to a plan which: • Conforms to the Hjetlands Protection Act • Is approved by the Conservation Commission • Does not endanger any of the neighboring properties. To date, the resulting actions taken by Mr. Osgood do not con- form to any'of the proposed drawings which have been shown to us in the past.' -Therefore, we are concerned that the Wetlands Pro- tection Act may be being violated. Furthermore, there has occurred a destruction of trees and other vegatation on the properties of Mr. Libby, Mr. Muldoon and Mr. Perna during the efforts of Mr. Osgood to date. In -addition, serious.water drainage problems have occurred, continue to exist, and very possibly will expand further.endanger ing the properties in particular of Mr. Charlton, Mr. Dionne, Mr. Higgenbottom and Mr. Michaud. The water drainage problems also continue to cause the winter and spring flooding and icing of Raleigh Tavern Lane -North, thereby, endangering both motorists and pedestrians on that street. Completion.of the Lot 33A project was to have been accomplished at least two years prior to this date. Since we, by our actions, have not been able to bring about the proper and timely completion of. this project, we request: 77, ;t rr Commissioners: - 2 - October 12, 1977 That the Commission take the necessary steps to ensure compliance with the Wetlands Protection Act. Ensure that our properties are not endangered by a faulty plan. Ensure that prompt action (prior to the coming winter) be taken to rectify any existing conditions which are potentially dangerous to our properties and safety. In addition, we urge that any future requests by Mr. Osgood, and associated companies, for future developments in North Andover be denied until such time that Mr. Osgood has shown that he plans to deal with the Town of North Andover, its Agencies and Residents in good faith by the proper performance and completion of existing projects which he has already under- taken. Dear Mr. Osgood: A complaint has been received by this Board regarding conditions on Lot 33 Raleigh Tavern Lane. The complaint involves strong odors and poor drainage on this lot. Inspections madb by this Board confirm that the drain- way is clogged by stumps. The odor generated is probably from stagnant water.
