My first correspondence with Mr. Wheeler was a letter dated 9/06/95 that he sent to the Building Commissioner stating a faulty cover on an electrical service at Village Green Condominiums. On 9/07/95 I visited the location and discovered the cover was on, but not secured. After speaking with Mass. Electric, I found out that this box belonged to the. Condo Association. I then phoned Ms. Terry Nevans (Managing Trustee) and requested that she have the Electrician secure the cover with appropriate screws. This was done immediately. I reinspected on 9/21/95. My next encounter with Mr. Wheeler was a phone call on 10/03/95. His attitude was very condescending at that time. He wanted me to check every electrical service on every building in the complex. He could not give me a specific location. He continued to threaten lawsuits, it's my job, he pays my salary, etc. I notified my boss,the Building Commissioner, and we agreed to send Ms. Nevans (Managing Trustee) another letter requesting that all services be checked. See letter 10/17/95. My next exposure to Mr. Wheeler was a postcard he sent to the Town Manager berating me for thanking Ms.Nevans for taking care of the problem. Ms. Nevans engaged Juba Electrical,North Andover, and paid for inspections of all services, (see attached letter from Juba Electrical regarding results). She stated that Juba Electrical does all their electrical work. I investigated this and found that her son just changes light bulbs, cleans fixtures, etc., but does no wiring whatsoever. All electrical work is done by Juba Electrical. See Attached Permit. The Building Commissioner, Bob Nicetta, called a meeting with the Trustees (see attached minutes of the meeting). I consider this matter closed, as I did on 10/25/95, and I would welcome a Hearing by the Board at this time or anytime regarding my professionalism, competence, conduct, licenses, or any other matter. Attending: Thelma Medina, Chairperson,V.G. Board of Trustees; Teresa Nevans and Carol Seccareccio, Members, Board of Trustees; Robert Nicetta,Building Commissioner; and James DeCola,Electrical Inspector For record purposes, Mr. Nicetta informed those in attendance that a Mr. Clyde Wheeler, Resident, Village Green Condos,had registered a formal complaint with the State Board of Electrical Examiners regarding alleged electrical work performed at the condos without benefit of a Permit, etc., (copy of complaint on file). Teresa Nevans reported that Wheeler has complained to Mass. Electric, Bay State Gas, Licensing Board for C.P.A.'s , real estate brokers. He has accused her of stealing funds via kickbacks from the utilities. Ms. Nevans agrees that neither their Electrician nor Jim DeCola has done anything illegal. He alleged fraud by the condo accountant. i Mr. Jim Seccareccio is the person who changes the light bulbs which is entirely legal and does not require an Electrical Permit. He never touches the wiring. Juba Electrical or similar licensed electrician is hired for that purpose. It was noted that Carmine DiAdamo is presently the attorney for the condo association and, per Ms. Nevans, is in process of taking action on this matter. Bob Nicetta requested a letter from the Board of Trustees stating that they are knowledgeable of Wheeler's claim and that they are aware that Inspector DeCola is not under any suspicion of wrongdoing. A letter from Atty. DiAdamo attesting to the above and stating there is no problem with any work that has been inspected by our Electrical Inspector was also requested by Mr. Nicetta. The Board of Trustees representatives were afforded a copy of the Complaint as well as the Town Manager and Division Director. Jim DeCola, Electrical Inspector reiterated that it is a combination complaint, i.e.,they are performing work without a Permit and our Electrical Inspector is remiss because he has allowed this to happen. Terry Nevans suggested Mr. Wheeler probably should have been present. Mr. Nicetta, Building Commissioner, felt this may present a confrontational atmosphere and, therefore opted not to include him at this time. Mr.Nicetta does not wish to place the town or the Electrical Inspector in an embarrassing situation. It is vitally important that you be made aware that Mr. Wheeler has accumulated an extensive history of false accusations and misrepresentations filed indiscriminately against scores of professional people in all walks of life. This, unfortunately, is another in a long list of such attempts . Mark p Nevans, the subject of the enclosed complaint was engaged only in the routine changing of burned out flood light bulbs ,- i .e. screwing out the old one, and screwing in the new one. He has performed this function when needed for several years . At no time was . he ever engaged in the repair or function of any electrical device or apparatus. To think that this function would require the knowledge or approval of North Andover' s Inspector of Wires should reveal the extent of Mr. Wheeler' s problems . We have never had a single problem with Mr. DeCola' s services . We would be happy to show you the complete file on Mr. Wheeler at any time. My first correspondence with Mr. Wheeler was a letter dated 9/06/95 that he sent to the Building Commissioner stating a faulty cover on an electrical service at Village Green Condominiums. On 9/07/95 I visited the location and discovered the cover was on, but not secured. After speaking with Mass. Electric, I found out that this box belonged to the Condo Association. I then phoned Ms. Terry Nevans (Managing Trustee) and requested that she have the Electrician secure the cover with appropriate screws. This was done immediately. I reinspected on 9/21/95. My next encounter with Mr. Wheeler was a phone call on 10/03/95. His attitude was very condescending at that time. He wanted me to check every electrical service on every building in the complex. He could not give me a specific location. He continued to threaten lawsuits, it's my job, he pays my salary, etc. I notified my boss,the Building Commissioner, and we agreed to send Ms.Nevans (Managing Trustee) another letter requesting that all services be checked. See letter 10/17/95. My next exposure to Mr. Wheeler was a postcard he sent to the Town Manager berating me for thanking Ms. Nevans for taking care of the problem. Ms. Nevans engaged Juba Electrical,North Andover, and paid for inspections of all services, (see attached letter from Juba Electrical regarding results). She stated that Juba Electrical does all their electrical work. i I' Page -2- May 30, 1996 The next complaint from Mr. Wheeler was a postcard stating that Ms. Nevans hired her son to do the electrical work without a license or Permit. I investigated this and found that her son just changes light bulbs, cleans fixtures, etc., but does no wiring whatsoever. All electrical work is done by Juba Electrical. See Attached Permit. The Building Commissioner, Bob Nicetta, called a meeting with the Trustees (see attached minutes of the meeting). I consider this matter closed, as I did on 10/25/95, and I would welcome a Hearing by the Board at this time or anytime regarding my professionalism, competence, conduct, licenses, or any other matter. Teresa Nevans reported that Wheeler has complained to Mass. Electric, Bay State Gas, Licensing Board for C.P.A.'s , real estate brokers. He has accused her of stealing funds via kickbacks from the utilities. Ms. Nevans agrees that neither their Electrician nor Jim DeCola has done anything illegal. He alleged fraud by the condo accountant. Mr. Jim Seccareccio is the person who changes the light bulbs which is entirely legal and does not require an Electrical Permit. He never touches the wiring. Juba Electrical or similar licensed electrician is hired for that purpose. It was noted that Carmine DiAdamo is presently the attorney for the condo association and, per Ms. Nevans, is in process of taking action on this matter. Bob Nicetta requested a letter from the Board of Trustees stating that they are knowledgeable of Wheeler's claim and that they are aware that Inspector DeCola is not under any suspicion of wrongdoing. A letter from Atty. DiAdamo attesting to the above and stating there is no problem with any work that has been inspected by our Electrical Inspector was also requested ted b Mr. Nicetta. The Board of Trustees representatives were afforded a copy of the Complaint as well as the Town Manager and Division Director. Jim DeCola, Electrical Inspector reiterated that it is a combination complaint, i.e.,they are performing work without a Permit and our Electrical Inspector is remiss because he has allowed this to happen. Terry Nevans suggested Mr. Wheeler probably should have been present. Mr. Nicetta, Building Commissioner, felt this may present a confrontational atmosphere and, therefore opted not to include him at this time. November 14, 1995 Since some notices were delivered to selected unit owners only, unsigned, without benefit of introduction or explanation, it quickly became apparent that their intent was slander rather then truth. To counter these false accusations, I have prepared answers to each misleading statement so that the truth in its entirety will become known to everyone. On Thursday, October 26, 1995, a portion of the salary ledger was e Green n East has a given out to selected unit owners ONLY. Village variable payroll and ONLY my and Carol Seccareccio' s families were listed. The reason for this limited excerpt of salaries was a deliberate attempt to imply wrongdoing or misappropriation of funds regarding the aforementioned individuals . The figures given were inaccurate (attached please see the corrected copy of the rialary ledger, prepared by Paul Brown, CPA, highlighted by re to illustrate specific mistakes) . Listed below are the statements and/or questions from the notice distributed on November 10, 1995 , accompanied by the truthful responses to each and every one, and whereas the questions tended to be misleading half truths, my responses will be total, candid, and honest . The statements and or questions from the handout of November 10, 1995, as listed below are in regular type and my responses are in bold print. According to the information on the notice distributed on November 10th, "as the annual unit owners meeting approaches, there are plenty of issues that need to be discussed and decisions to be made . A few weeks ago, a portion of the ledger was distributed to all the unit owners . Some of you may not realize that there is a second ledger for the pool" . During the month of July, 1995 for example; Mark Nevans worked 57 hours a week at the pool for 5 weeks and was paid $570 . 00 a week, $402 .47 net, for 5 weeks totaling $2, 112 .35 . How is it possible that he earned all -this additional money and for what services? The Ledgers are not itemized. There are several questions/issues listed below which we .believe need immediate -attention: THE POOL WAS INCLUDED ON THE SHEETS THAT WERE DISTRIBUTED ON THURSDAY, OCTOBER 26TH. The earnings listed for 7/03/95, 7/10/95, 7/18/95, . 7/24/95, and 7/31/95 are not pool earnings. They are earnings for maintenance services provided for Village Green East, irrespective of pool earnings . Additional services provided by Mark Nevans were cleaning the gutters and repairing flood lights. Whether Mark Nevans or an outside person performed the lifeguard or maintenance duties, the costs would have been the same and in some cases, even higher. 1) Ledgers must be itemized for all transactions .; We need access to our information when we ask! Cindy Grenese and Pat Melanson asked to view all the books from the accountant, Paul Brown (incidentally, these requests became so frequent and demanding that the accountant asked that Cindy and Pat no longer contact him directly, but only through Terry Nevans, the Manager) . I obtained all the books from Paul, and at Cindy and Pat' s convenience, these books were given to each of them for their perusal. Included in these books was the ledger book, which gave descriptions for each and every check that has been written. 2) Quarterly reports must be issued by an outside accounting firm. Village Green Condominium Trust does have an outside accounting firm. We have a Certified Public Accountant, Mr. Paul Brown, who has been in our employ since October, 1986 . Paul Brown writes all the checks distributed for Village Green East. NOT ONE CHECK HAS EVER BEEN ISSUED WITHOUT HIS APPROVAL. 3) To ensure a system of checks and balances all checks must be authorized by more than one trustee. All checks are always signed by two trustees. 4) We need to review, and change when necessary, the bylaws pertaining to the authority of the Manager and trustees .
