An application for variance was filed with the Board by Julianna Hoch (Applicant) on March 21, 2014 The applicant has requested variances from the following sections of the 2006 Rules and Regulations of the Board: Section: Description: 29.2.3 Petitioner is proposing a seasonal "ice cream"window service. The window will be served by a deck with approximately four (4) steps. The petitioner is seeking relief from having to make the ice cream window accessible to persons who use wheelchairs. 25.1 Petitioner seeks variances for two (2) entrances at the front of the building. Each entrance serves a different tenant space. However, both tenant spaces on the first floor are served by the accessible ramp at the rear bf the building leading to a common area foyer and single user(unisex) accessible toilet room On April 16, 2014 the petitioners Architects submitted additional information regarding the jurisdiction. The partial application reveled that the tenant was spending over 30% of the assessed value of the space they occupy and additional variances were needed. 2-. The submittal was reviewed by the Board on Monday, April 7, 2014 3. After reviewing all materials submitted to the Board, the Board voted as follows: GRANT: the variance request for Section 29.2.3 and 25.1 as proposed in the application submitted, for the reason that impracticability (see definitions of impracticability in Section 5 of 521 CMR) has been proven in this case. In addition the Board is requesting information as to whether or not the second floor space is open to the public. Please provide that requested information no later than May 9, 2014 so that the Board can review at its may 12, 2014 meeting. Any person aggrieved by the above decision may request an adjudicatory hearing before the Board within 30 days of receipt of this decision by filing the attached request for an adjudicatory hearing. If after 30 days, a request for an adjudicatory hearing is not received, the above decision becomes a final decision and the appeal process is through Superior Court. NOTE: If the work being performed is reconstruction, renovation, addition, or alteration, compliance with this decision must be achieved by completion of the project and prior to final approval by the building department. After reviewing all materials submitted to the Board, the Board voted as follows: CONTINUE: the variance request for Section 29.2.3 so that the petitioner can provide the Board with a written analysis of the partial application formula for"work.by a tenant" under 521 CMR Sections 3.7 and 3.3.3. If it turns out that the spending exceeds 30% of the assessed value of the tenant space, and additional variances'are needed,•an 'amendment to the current case can be submitted no later than April 15, 2014 for the Board to review at its next meeting to be held on April 28, 2014.. PLEASE NOTE:All documentation (written and visual) verifying that the conditions of the variance have been met must be submitted to the AAB Office as soon as the required work is completed.
