TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS May 30 , 1984 Mr. Daniel Long, Town Clerk L&L North Andover Trust Town Office Building Corner of Turnpike and 120 :lain Street Peters Streets known as North Andover, Mass. 01845 Lot #67 Petition No. 24- 184 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, April 21, 1984 upon the application of L&L North Andover Trust. The hearing was advertised in the North Andover Citizen on April 26 and May 3, 1984 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr. , Chairman; Richard J. Trepanier, Esq. , Clerk; 11illiam J. Sullivan; and Associate lHembers Maurice S. Foulds and Raymond A. Vivenzio;' The petitioner seeks a Special Permit under-Section 9 , Paragraph 9 . 1 of the Zoning By Law so as to .permit the expansion of a non-conforming use within 100 feet of Turnpike Street (Route 114) on premises located on the corner of Turnpike and Peters Streets and known as Lot #67. Counsel for the petitioner testified that the Burger King Restaurant is located on the parcel and the reason for the petition is that the petitioner wishes to add to the existing building and the Zoning By Law requires a 100 foot setback from Route 114 . The existing building (-restaurant) was constructed prior to the enactment of this Zoning By Law, resulting in the request for a Special Permit to enlarge the non- conforming use . The proposed addition will not extend beyond the vestibule on the existing building, which was allowed by variance from the Board of Appeals . The addition will add approximately 37 seats to the rest- aurant and ample parking will be provided. One resident spoke in opposition to the petition. In granting the Special Permit, the Board finds that Section 10 . 31 of the Zoning By Law has been satisfied. In particular, the Board finds that: 1. The specific site , consisting of a number of small businesses located in a General Business (GB) zoning district, is an appropriate location for such a use and structure; 2. The use as developed will not adversely affect the neighborhood since the neighborhood is made up of businesses ; f 3. There will be no nuisance or serious hazard to vehicles or pedestrians; and 4. Adequate and appropriate facilities in the form of ample parking spaces will be provided for the proper operation of the proposed use.
