NOR;ii .;;OV�R •: _ APR 25 9 39 AM '83 'SSACM TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS April 20 , 1983 Mr. Daniel Long, Town Clerk Connie Cataudella Town Office Building 51 Brightwood Ave.. and 120 Main Street land on Highlandview Ave. North Andover , Mass. 01845 Petition No . 22-' 83 Dear Mr. Long; The Board of Appeals held a public hearing on Monday evening, April 11, 1983 upon the application of Connie Cataudella. The hearing was advertised in the North Andover Citizen on March 24 and 31, 1983 and all abutters were notified by regular mail . The following .members were present and voting: Frank Serio, Jr. , Chairman ; Alfred E. Frizelle�. Esq . ,: Vice Chairman; Richard J. Trepanier, Esq. , Clerk ; William J. Sullivan, and Augustine W. Nickerson. The petitioner seeks a variance from . the provisions of Section 7 , Paragraphs 7. 1, 7. 2 , 7. 3 and Table 2 of the Zoning By Law to per- mit the subdivision of land into two lots having less than the required area, frontage , and setbacks on premises located at 51 Brightwood Avenue and land on Highlandview Avenue . The petitioner testified through counsel that the property has frontage on both Brightwood Avenue and Highlandview Avenue. She proposes to subdivide the property into two lots . Proposed Lot A, which has frontage on Brightwood Avenue , would not have the required area, frontage , or setbacks . The petitioner's dwelling is located on Lot A. Proposed Lot B, which has frontage on Highlandview Avenue , would not have the proper area or frontage and is under a Purchase and Sale. Agreement. A single family dwelling is proposed for Lot B . Upon a motion made by Mr. Frizelle and seconded by Mr. Trepanier, the Board voted unanimously to grant the variance as requested for Lot A and grant the variance for Lot B with the condition that a single family dwelling by constructed on Lot B. REC Connie Cataudella 51 Brightwood Avenue T0 'snK Petition No. 22-183 Page 2 APR 25 9 39 '83 The Board finds that each of the provisions set forth in Section 10 . 4 of . the Zoning By Law have been satisfied. In particular, the Board finds that the size and shape of the lot constitutes a hard- ship to the petitioner and a literal enforcement of the Zoning By Law would involve a substantial hardship to the petitioner.
