North Andover, MA 01845 North Andover, MA 01845 Board of Health Decision In accordance with M.G.L. c. 111, §§ 127A and 127B, 105 CMR 400.000: State Sanitary Code, Chapter 1: General Administrative.Procedures and 105 CMR 410.000: State Sanitary Code, Chapter II; Minimum Standards of Fitness for Human Habitation, a hearing was held on November 19, 2011 at 7:15 PM in the North Andover Town Hall, 120 Main Street. The hearing was held in the matter of 7 Royal Crest Drive,Apt. 4; Board of Health Order Letter dated November 2,2015. Violations noted in regards to chronic dampness within the premise. Present at the meeting were the Board of Health members, Health Department staff and representatives from AMICO/Royal Crest Apartments and the tenants. All parties present had opportunity to address the Board of Health. After careful deliberation, and amendments to the original motion, the Board of Health unanimously voted the following; MOTION made by Mr.Fixler to maintain the order letter to correct the problems.Dr. MacMillan seconded the motion. Discussion ensued regarding the verbiage of the motion as Mr.Pease suggested. Page l of). They did not find any evidence of a leak or moisture intrusion from outdoors. We entered your apartment to inspect and remedy a mold situation that you reported to us, as any responsible owner would do. We did so in compliance with Massachusetts law. In short, based on the conditions in your apartment the owner does not have liability for the occurrence of mold in your apartment. Even so, solely as a customer service gesture we are willing to waive half of our standard lease termination liquidated damages of two months' rent. In exchange for this concession, however, we will expect you to execute a waiver of all claims against the owner, as we would expect this matter to be deemed fully settled upon granting the concession. Please let us know if this is acceptable. If so, we will have our attorney draft the necessary document. We weren't involved in that mold/chronic dampness situation. During this inspection we reported what we saw.We reported no visual mold at that time, however,There were signs of treatment and wood replacement. Concern Description: - Bathroom and second bedroom,Mold throughout. Visible mold growth through the walls and ceilings. This is the second incident of Chronic Dampness and Mold. The tenant was displaced for several weeks to a Hotel. Action Taken: e On Tuesday, October 27"',mold areas determined by Smith and Wessel were cleaned using industry standard solution and painted with mold inhibitor paint as recommended. On Tuesday,November 24th,a licensed remediation contractor(Golden Gate Services Inc.of 40 Warren St, Yd Fl, Charlestown, MA 02129) removed parts of ceiling and walls from bedroom and bathroom areas as discussed from Board of Health Order for inspection. On Tuesday,November 24,Royal Crest Service Manager Jason Cael, Health Inspector Michele Grant and Board Member Joseph McCarthy completed an inspection of unit 07-004. Michele Grant and Joseph McCarthy confirmed that the mold was not present on the back side of the unexposed drywall and there were no signs of moisture intrusion from the foundation or dampness that would cause mold to reoccur. Based on these findings Royal Crest was given verbal acknowledgement of being compliant but was instructed:not to occupy the unit until we received a Certificate of Compliance. On Tuesday,November 24, Golden Gate Services repaired inspection holes with greenboard applied new ceiling texture and paint to bedroom and bathroom hole inspected areas. We kindly request the Certificate of Compliance at your earliest convenience, as inspection of the apartment verified compliance with November 23`d, 2015 Order. He explained thatRoyal Crest only has an account w/one hotel and they didn't have any roomsavailable until the following night. He said there was no other hotel theycould set us up at. I agreed to have him set it up for Saturday night, and hesaid Pauline would call me with the details. When Pauline called she said theycouldn't get us in the hotel until Sunday night....different from what Kevin hadsaid. So now we are set up to stay at LaQuinta starting Sunday night. Afterthis all happened I made a call to the office to speak with Pauline. When Ihad originally spoken to her, and she was going to have Maintenance Managementcall me, we had discussed a $50 credit per day for meals that AIMCO would giveus, for the amount of time we are out of our apartment. The call l made to herwas to clarify what I had to do to ensure I got that. Needless to say, shenever called me back. Itis now Sunday afternoon, and we are in the process of moving to the hotel. Istill have no guarantee that I am getting a food credit because no one calledme back, again. We paid our rent on Saturday, and we can't even stay at home. Listed below are the dates we had issues with mold, and reported our concern to the office: September 2011 -Mold found in both bedrooms.We were displaced to a hotel for 2 weeks. Both back walls in the bedrooms had to be replaced. Bathroom fan has never worked properly. It has been replaced twice since we moved in.They claim mold in the bathroom is from improper use of the fan. However,the fan comes on with automatically with the light switch,so it has always been used. 04/18/2013& 12/17/2014 02/25/2013-black marks appeared throughout living room wall.They did moisture test, and then painted over marks. 01/02/2014-black marks appeared on living room walls again. Moisture test done,then painted over it. 2 02/26/2015-Spoke with Kevin Mosher regarding having no A/C covers, and concern of moisture appearing due to this. 03/16/2015-Black marks found around A/C in master bedroom because they never out covers on them. Maintenance came out to do moisture reading.They told me everything came back fine, and they painted the wall to cover the marks.Just like they did in living room a year prior. 09/14/2015-Elijah and I provided written notice due to concern of mold with our infant. About one week ago maintenance did a moisture and humidity test,they said everything was fine. I was sent an email from the Regional Manager,Jennifer West,stating that the mold found in the unit was due to improper use of the bathroom fan.They claimed to have found no mold in the guest bedroom. 10/30/2015-Elijah had board of health out.They found mold in both bathroom and guest bedroom. In short, based on the conditions in your apartment the owner does not have liability for the occurrence of mold in your apartment. Even so, solely as a customer service gesture we are willing to waive half of our standard lease termination liquidated damages of two months' rent. Listed below are the dates we had issues with mold, and reported our concern to the office: September 2011 -Mold found in both bedrooms.We were displaced to a hotel for 2 weeks. Both back walls in the bedrooms had to be replaced. Bathroom fan has never worked properly. It has been replaced twice since we moved in.They claim mold in the bathroom is from improper use of the fan. However,the fan comes on with automatically with the light switch,so it has always been used. 04/18/2013& 12/17/2014 02/25/2013-black marks appeared throughout living room wall.They did moisture test,and then painted over marks. 01/02/2014-black marks appeared on living room walls again. Moisture test done,then painted over it. 02/26/2015-Spoke with Kevin Mosher regarding having no A/C covers, and concern of moisture appearing due to this. 03/16/2015-Black marks found around A/C in master bedroom because they never out covers on them. Maintenance came out to do moisture reading.They told me everything came back fine,and they painted the wall to cover the marks.Just like they did in living room a year prior. 09/14/2015-Elijah and I provided written notice due to concern of mold with our infant. About one week ago maintenance did a moisture and humidity test,they said everything was fine. I was sent an email from the Regional Manager,Jennifer West, stating that the mold found in the unit was due to improper use of the bathroom fan.They claimed to have found no mold in the guest bedroom. 10/30/2015-Elijah had board of health out.They found mold in both bathroom and guest bedroom. However;moisture readings taken in those locations showed. that the materials were in an air dry condition.(less than 18%WME) and thus, not generally conducive to contig-ued mold growth. Moisture levels throughout'Unit 07-004 were all less than 10% WME. In the . bathroom, the visible mold on the doors seemed to where wet towels,were hung. Often in bathrooms, if during showers the exhaust fan is not operated, the humidity may cause conditions conducive to mold growth, especially in locations such as towel closets where air flow is restricted. In the secondary bedroom, there was minor staining that appears to be mold at a corner of perimeter and interior wall. The resident had contact the Management office at 3:30 pm on Tuesday, October 27th to report the issue. To ensure we were addressing the concerns appropriately we contracted Smith and Wessel Associates to perform a moisture assessment on Wednesday, October 281h throughout the apartment to ensure the matter was handled appropriately. I have attached the report from Smith and Wessel who indicated the drywall was in an air dry condition. Because there was no sign of leak or standing water they recommended cleaning the surface and painting the areas, which was completed on Wednesday afternoon. We would like to ensure we handle the matter appropriately with the Board of Health. In your recent inspection on Friday could you please identify if there were areas of increased moisture or standing water that were located in the apartment that we need to address?
