FINDING OF FACTS Property owners provided a reciprocal easement agreement(REA)between Bradstreet and its neighbor to the north,the 58-64 Main Street Realty Trust. DECISION The proposed changes are deemed to be Insubstantial and do not alter either the intent or the conditions of the original Special Permit. The changes do not require a vote of the Planning Board. CONDITIONS The Interim Town Planner's finding of Insubstantial Change is conditioned on the following: 1) This Decision and the revised Plans(sheets SKI and SK.2)dated 11/5/2015 and 1/25/16 shall become part of the record and the changes will be reflected on the final as-built drawings which will be reviewed and approved by the Planning Department. 2) The Applicant shall get the appropriate approval from the Fire Department in terms of fire truck access to the site.A letter acknowledging this approval must be submitted to the Planning Department by the North Andover Fire Department. 3) A copy of the recorded easement shall be provided to the Planning Department. I believe you have previously heard about the following, but if not I apologize for all concerned. Basically, on behalf of Bradstreet, I have been working and have succeeded in reaching a mutually agreed-upon reciprocal easement agreement between Bradstreet and its neighbor to the north, The 58-64 Main Street Realty Trust. The intention is to combine the two separate driveway entrances on Main St., into one unified driveway entrance, to service both properties. In addition to the visual enhancements, the thinking was that eliminating an extra curb cut along Main Street could only be a good thing. The attached Easement has plan sketches detailing everything, so I would ask you to review the easement and its attachments. 'The Trust hereby grants to Bradstreet,its successors and assigns,the nonexclusive right and easement in perpetuity in common with others to use for vehicular and pedestrian traffic a portion of the Shared Entranceway designated on the Easement Plan as "Access Easement SB"',together with the right and easement in perpetuity to construct,maintain,repair-and replace, the Shared Entranceway in, under and on that portion of the Trust Property consisting of said Access Easement '13',at Bradstreet's sole expense and subject to all of the terms and conditions contained in this Agreement. .2e (I3) Easement Rights iii.the Landscaped Islands. The Owners, and their tenants, lessees, agents, guests, invitees,licensees and family members, shall have full, free and uninterrupted use of the.Easement Area for the purposes named herein and shall have all rights and privileges reasonably necessary to the exercise of this Easement; provided, However,that the Owners shall take reasonable steps to minimize,any . damage to the Lots, or inconvenience to any specific Owner,as a result of the Owners' exercise of such rights and privileges. Except to the extent expressly provided herein;this Easement shall not be construed to, nor does it or is it intended to create,any easement, license,privilege or right of any nature whatsoever in the general public or hi any party other than the Owners and their respective tenants,lessees, agents, guests„ invitees, licensees and family members. In no case shall either Owner be entitled to park in either Owner's parking spaces,other-than when a customer or guest ofa business or r4+identitil_ tenant on such other Owner's Lot. 4. No Owner shall take any action with respect to the Easement Area that would. interfere or be inconsistent with the use of the Easement Area by the Owners forthe purposes named herein. Except as may be necessary in connection with the maintenance,repair and/or replacement of the Shared Entranceway,no walls, fences, barriers or other obstructions shall be erected or allowed to remain within the Casement Area so as to interfere with the free.flow of vehic-alar and pedestrian traffic to and from the.Lots. Parking of vehicles within the Easement Area is prolvbited, except for such temporary parking as;may be reasonably necessary in connection with the loading or unloading of vehicles. 5. Bradstreet agrees to maintain the Shared Entranceway in a commercially reasonable state of repair. All costs associated with the maintenance,repair-and replacement of the Shared Entranceway shall be borne by Bradstreet, All determinations re'garding,the need for and extent of any maintenance,repair or replacement of the Shared Entranceway, and other rriatters-pertaining to this Easement, shall be made by Bradstreet. Each Owner shall permit suGh portions of the Owner's Lot as are located aclj scent to the Easement.Area to be used as may be reasonably necessary on a temporary basis solely iia connection with the maintenance, repair or replacement of the Shared Entranceway, including,without Iitnitation, for the temporary storage of materials and equipment, _3 - 6, If any portion of the Shared Entranceway is damaged or destroyed through the act Of one Owner, or any of such Owner's tenants, lessees, agents, guests, invitees, licensees or fiali ly members, so as to deprive the other Owners of the full use and enjoyment of the Shared Entranceway, then the Owner responsible for such damage shall be responsible for the cast and expense to rebuild and repair the Shared Entranceway to as good condition as existed prior to such damage or destruction,without cost to the or such other Owner. 7. All provisions of this Easement,including the benefits and burdens, shall touch, concern and run with the land and shall be binding upon and inure to the benefit of the Owners and their respective successors,transferees, assigns;heirs and.personal representatives. 8. The obligations and'liabilities of the Owners hereunder shall apply only with respect to the period during which each Owner owns an interest in a Lot. When an Owner ceases to own an interest in a Lot,the obligations and liabilities thereafter accruing(but not any accrued. and unperformed obligations and liabilities) shall be the obligations and liabilities of the successor, transferee or assign in ownership or interest of such Owfter. The transfbrri g: Owner, however,shall remain liable for all accrued and unperformed obligations and liabilities. 9. No restriction,condition, obligation or provision of this Easement shall.be deemed to have been abrogated or waived by reason of any failure or failures to enforce the same. 4 10. Notwithstanding that all or any portion of the Lets and/or the Easement Area may now or hereafter be owned by the same individual or entity, the easements and rights herein granted and the covenants hereby imposed upon the Lot shall not be deemed to be extinguished by merger or otherwise and the same shall be perpetual and shall not be extinguished, Except by an instrument duly executed by all Owners. 11. This Easement shall not be modified or amended except by an instrument duly executed by all Owners, which instrument shall be recorded at the Registry of Deeds. 12.
