HomeMy WebLinkAbout1974-03-11Monday - March 11, 197A 1 Hearing The BOARD OF APPEALS held its regular meeting on Monday, March 11, 197~ at 7:30 P.M. in the Town Office Building meeting room. The following members were present' and voting: Frank Serio, Jr., Chairman; Dr. Eugene Beliveau, Clerk; Louis DiFruscio, and Associate Members Alfred Frizelle, Esq. and James Noble, Jr. Member William Salemme was present but not sitting on the hearing. There were 15 people present. HEARING: John J. Good Dr. Beliveau read the legal notice in the appeal of John J. Good who requested a variation of Sec. 6.3 & Table 2 of the Zoning By-Law so as to permit an addition to an existing dwelling which would be closer to the side lot line than is allowed by the Zoning By-Law on the premises located at the northerly side of Farnum Street, at the corner of Summer Street and known as 62 Farnum Street. Mr. Good appeared in his own behalf and explained that the addition could not be placed in therear because it would be directly over the septic tank; on the other side of the house is a drop-off where he allowed the town to cut a culvert. This is the only side that the addition could be placed on and it would be only 13 feet from the sideline and 30 feet is required so that it is necessary to seek a variance. Building Inspector Foster explained that the house is located in this particular spot because part of the lot is very wet and unsuitable for building, so that there is a hardship. Chairman Serio read a letter from the immediate abutter on the side of the pro- posed addition, ~r~' andFms. Herbert W. Gray, Jr., which stated that they en- thusiastically support the requested variance. Mr. Grey's house is approx. 39 feet from the lot line. There were no abutters present and no one else spoke. Mr. DiFruscio made a motion to grant the variance. Dr. Beliveau said he would rather take the matter under advisement and Mr. DiFruscio changed the motion to take it under advisement; ~r. Beliveau seconded the motion and the vote was unar~ous. CHESTNUT ESTATESTRUST: (Member Salemme sitting on this petition). A hearing had been held on the petition of Chestnut Estate Trust on December 10, 1973 but because additional information and plans were requested by the Board, a new hearing was called for this evening. However, due to a technical error, it was found that a legal point had been overlooked on the petition and the Board unanimously agreed that the.petitioner submit a new application for a public hearing to be held on March 28, 197~. March 11, 197& - cont. YVONNEGIARD: The Board discussed the Giard petition for which a hearing was held on February llth. The Board noted that the petition was in the names of Yvonne Giard and Louis ~lbois and only one of the applicants had signed the application form. Mr. Giard was contacted by telephone~and soon thereafter came to the meeting. He informed the Board that Mr. Dubois would come to the office the following day to sign the form. Mr. Salemme made a motion to Grant the variance pending Mr. Dubois' signature on the application; Mr. DiFruscio seconded the motion and the vote was 4 members in favor and Member Frizelle abstaining. AR6"HDIOOESE PETITION: Chairman Serio informed the people present at the meeting ~that the Board ' will make a decision on the petition of the Archdioces of Boston on Thursday evening, March 2~, 197~. EARTH RE~OVAL P~MITS: Gilbert Rea submitted a written request to renew his earth removal permit. The Building Inspector will inspect the premises and submit a report to the Board at the April 8th meeting. Robert Watson telephoned his request for renewal of his earth removal permit to the secretly earlier in the day. The Building Inspector will also inspect this operation and submit a report on April 8th. The meeting adjourned at 8:30 P.M. (Frank Serio Jrt)~ Chairman Secretary
