These projects seem to be constantly beset with details that cause delay:however, we feel now that construction will start within a few days. If construction moves ahead without a snag, we could be on line by July 30. Frankly, I've never seen a 2-3 week sewer project take 3 weeks. I feel confidant however, that we will be on line sometime in August. With the reality of the situation in mind, we request that the Board "hang in" with us until we get hooked up. The Board should be aware that we need to start construction of our second building, ASAP, in order to get our new tennant in place by January 1st. We know that a building permit will not be forthcoming until we are on line with the sewer, so the hookup is priority -one with us. Thank you again for the past co-operation. The original permit for this work was submitted on October 27, 1982 and was voided on December 30, 1982. Jefferson Realty Trust is developing a parcel of land at the intersection of Route 114 and Mill Road on which they have constructed an office building. The construction of the office building was contingent upon its being tied into municipal sewerage. The installation of the sewer line has not been accomplished because the sewer pump station has not been completely constructed. However, its completion is imminent. As soon as the permit is reinstated, my client intends to construct the sewer line and tie into the pump station. I have enclosed a copy of the original permit application, a copy of the letter from the North Andover Board of Health authorizing use of a sewer holding tank until construction of the sewer pump station, correspondence from the Department of Environmental Quality Engineering authorizing utilization of a sewer holding tank until construction of the sewer pump station, and the Orders of Conditions issued by the North Andover Conservation Commission for the installation of the sewer line. Dear Mr. Galvagna: I have requested that the construction lender for Jefferson Park, Rhode Is_and Hospital Trust National Bank, provide you with a letter indicating a withhold -..-,g of $10,000 ($5,000.00) each, for the two orders of conditions relative to our project. For your files, I have included a copy of the agreement we have with the North Andover Board of Health, which essentially operates to assure the town that they have protective control of their interests regarding our connection to an approved sewer. I believe the letter from the bank will provide the same type of protection nor your interests. WP expect to start construction in the area subject to the orders I condition in mid July, contingent on your approval of the bond arrangement, as we'll as an on-site inspection of wetland protective measures. We are looking forward to finally getting underway with the construction of a project which, I believe, will be noteworthy in terms of quality and design as well as proceeding in a spirit of co-operation and teamwork with State and Municipal officials. The Department is also in receipt of a submittal dated January 5, 1983 from T&M Engineering Associates, Salem, Massachusetts, representing Jefferson Trust, requesting approval for a "holding tank" installation. Accompanying the submittal is a plan consisting of one sheet which is titled: Temporary Septic/Holding Tank Sewerage For Jefferson Trust Route 114/Mill Road North Andover Engineer: Kaminski, Gelinas and Associates, Inc. Date: October 18, 1982 Addenda: October 21, 1982 Scale: 1" = 30' The plan proposes to dispose of 600 gallons per day of sanitary waste by means of a 1500 gallon concrete septic tank which discharges to a 5000 gallon concrete holding tank with off-site disposal at the Greater Lawrence Sanitary District wastewater treatment facility in North Andover. The "holding tank" will be equipped with both audio and visual alarms set at the 2/3 elevation level. A private sewer line and pumping station, that will service the office building, is under construction but work has been currently suspended due to weather conditions and will be resumed in the spring. Additionally, the applicant, Jefferson Trust has posted a bond in the amount of $55,000 with the Town of North Andover to assure that a sewer connection is effected not later than June, 1983. North Andover Board of Health January 11, 1983 Page 2 An engineer of the Department has reviewed the plan and makes the following comments: The 1500.gallon septic tank located prior to the 5000 gallon "holding tank" will serve no useful purpose, will only accumulate solid buildup and is not readily accessible (no manhole to grade) for cleanout. It is the opinion of the Department that the .plan has been prepared in accordance with standard engineering practice. It is the further opinion of the Department that strict enforcement of Title 5 of the State Environmental Code would cause manifest injustice to the applicant and the applicant has proved that the same degree of environmental protection required under Title 5 can be achieved with- out strict application of the provisions of Title 5. The Department hereby approves the installation of a "holding tank" to service the subject site with the following conditions: 1. No septic tank shall be installed prior to the holding tank. 2. A dry sewer line, from the facility to the property line be installed concurrently with the "holding tank" in order to facilitate the proposed sewer connection. 3. A sewer connection will be effected within thirty (30) days of Completion of the municipal sewer extension but in no case later than June 30, 1983 without prior written approval of both the Department and the North Andover Board of Health.
