The hearing was duly advertised in the North Andover Citizen on April 25 and May 2, 1985 and all. -abutters. -were -notified by regular mail. -The public hearing was continued til June 10, 1985 and again until June 26, 1985. The following members were present on each occa- sion and when the Board rendered its decision on June 26, 1985: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice -Chair- man; Augustine W. Nickerson, William J. Sullivan, .and Walter F. Soule. The Petition seeks a variation of Section 7, Paragraph 7.3, and Table 2 of the Zoning By -Law so as to permit relief from the side setback requirement to allow the construction of an addition on the premises located at 768 Waverly Road. The Petitioner failed to appear at the May 13, June 10, and June 26, 1985 hearings to press his petition. Upon a motion made by Mr. Frizelle and seconded by Mr. Soule, the Board voted unanimously to deny the variance as requested. The Board found that the Petitioner received adequate notice of each meeting and failed to press his Petition. The Board finds that the Petitioner failed to satisfy the requirements of Section 10.4 of the Zoning By -Law.
