'e OL O yla A . 10 r �9SSACN 15(' y TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition #88-89 AMENDED DECISION The Board of Appeals held a public hearing on Tuesday evening, January 9, 1990 and a meeting for discussion on February 13, 1990 upon the application of Dennis Cote' requesting a Special Permit from the requirements of Section 5.5, Paragraph 2 of the Zoning Bylaw so as to permit removal of 22,000 cu. yds. of earth off Lot 25 Coventry Lane in order to put in foundation and driveway and grade to 2-1 slope. The following members were present and voting at the January 9th meeting; William Sullivan, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule, Raymond Vivenzio and Louis Rissin. The following members were present and voting at the February 13th meeting; Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, Walter Soule, and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on November 22, 1989 and on November 30, 1989 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit as requested subject to the following conditions: 1. All erosion controls shall be in place on-site and off-site and approved by the Building Inspector prior to any earth removal from Lot 25 Coventry Lane. 2. Daily street cleaning where necessary. 3. Information reports to Building Inspector as to where the fill is going, in advance of removal. 4. Post a $2,000 bond for Lot 25 with the Town Treasurer for street cleaning on Coventry Lane, and on-site restoration. 5. We understand that the Town of North Andover has given them until June 14 to complete all site work on lots 25 and 26. They and their site excavator, Mr. Robert Slombo, have been working very hard since February 1990 to complete this work, and they have also been very co- operative with all of the residents. We feel that the June deadline has become unrealistic due to the unusual weather conditions everyone has had to endure, this has been the wettest spring in many years. Work on these lots has been drastically delayed because of the rain. We would like to see these houses completed as they will add to our neighbor- hood. In addition our street cannot be completed (finish coat of asphalt) until all homes are complete. It is in our best interests that we assist Mr. & Mrs. Cote and Mr. Manzi in completing their homes. We ask that you, the members of the Zoning Board of Appeals, be understanding of their plight and allow them to continue the excavation work. If we the residents of the street can understand and bear with the situation, we hope that all of you can find the generousity and understanding to allow them to complete their homes. Board of Appeals MEMORANDUM TO ; NORTH ANDOVER ZONING BOARD OF APPEALS_ FROM ; RICHARD DOUCETTE, CONSERVATION ADMINISTRATOR ``► DATE : DECEMBER 12, 1989 RE : EXCAVATION AT LOTS 25, 26 COVENTRY LANE I have been asked by Mr. Richard Barrett for my opinion on his proposal to removed several thousand cubic yards of soil from lots 25 and 26 Coventry Lane. The Conservation Commission has no jurisdiction of this project under the Wetlands Protection Act. This Office, and the Conservation Commission, does have the statutory responsibility over all natural resources in the Town under Chapter 40 Section 8C of the General Laws. The removal of soil from these lots may be beneficial since it will remove a very long steep slope that could be prone to future erosion. It is these types of slopes that have been a continuous problem in this subdivision. I realize that such excavation and trucking will be a disruption to the neighborhood. Conditions can be placed on this project to protect both the environment and the neighborhood. I would recommend (as a minimum) the following: All erosion and sedimentation measures possible must be well maintained. These should include 'terracing' of the slopes during removal, diversion ditches, hay bales along the bottom of the slope and at all terraces and siltation basins along the bottom of the slope. * The excavation should be restricted to hours and days that will cause the least disruption to the neighborhood. * The street should be swept daily. All catch basins should be maintained by the applicant during excavation. * No excavation or transportation of soil should be allowed during, or shortly after, a rainstorm. The contractor should be busy maintaining the erosion control measures. The slopes are likely to be unstable and difficult to work at these times. The street will be more muddy if work is allowed at these times. +� All trucks should be covered during transportation to minimize dust. Back-up alarms on trucks and excavators can be disconnected to minimize disruption of the neighborhood but this does create a hazard for workers. +� After excavation, the remaining exposed soil should be covered with a minimum of 4" of good loam and seeded. A tree planing scheme acceptable to the Town Planner should be implemented.
