NELSON, DIRECTOR J Mr. Daniel Long, Town Hall 120 Main Street North Andover, MA Dear Mr. Long: Town Clerk 01845 September 15, 1988 Re: 9 Waverley Road Site Plan Review through the Special Permit Process The North Andover Planning Board held a public hearing on Thursday evening, August 18, 1988, in the Town Hall, Selectmen's Meeting Room upon the application of C&D Realty Trust, 9 Waverley Road, North Andover, MA. The hearing was duly advertised in the North Andover Citizen on July 21, and July 28, 1988. The following members were present:. George Perna, Vice -Chairman; John Simons, Clerk; Erich Nitzsche and Michael Leary. Paul Hedstrom, Chairman arrived at 8:40 p.m. John Simons read the legal notice to open the public hearing. The petitioner, Douglas SPecial Permit under Section North Andover Zoning Bylaw. on an existing structure and Road. The applicant has bee continued use of a non-confo special permit. Small , of C&D Realty Trust, seeks a 8.3 (Site Plan Review) of the Theapplication is for the alteration related site improvements at 9 Waverley before the Board of Appeals for the ming structure and was granted a Erich Nitzsche question if the plan meets the requirements of Site Plan Review. The Town Planner, Scott Stocking said the plan meets the requirements. Peter Voisine, an abutter, commented on the improvements. Douglas Small stated the uses of the structure being a barber shop, an insurance company and storage for his business and truck. A motion was made by Erich Nitzsche to close the public hearing and take the matter under advisement. The motion was seconded by Michael Leary and voted unanimously by those present. Page 2: Due to the lack of a quorum on September 8, 1988, the meeting was rescheduled for September 13, 1988. On September 13, 1988, the North Andover Planning Board held a meeting with the following.members present and voting: Paul Hedstrom, Chairman; George Perna, Vice -Chairman, John Simons, Clerk; E.fich Nitzsche and Michael Leary. Following a brief discussion on landscaping in front of the building, along the street, the Planning Board amended the draft decision. On a motion by George Perna to -accept the draft decision as amended and conditionally approve the Site Plan. The motion was seconded by Erich Nitzsche and voted unanimously by the Board. The specific site is an appropriate location for such a use, structure, or condition; B. The use as developed and conditioned in this decision will not adversely affect the surrounding neighborhood; C. There will be no nuisance or serious hazard to vehicles or pedestrians; D. Adequate and appropriate facilities will be provided for the proper operation of the proposed use; E. The Special Permit application before us is in harmony with the general purpose and intent of this Bylaw. The Planning Board makes the findings as required under Section 0.35 that the site plan generally complies with Town Bylaw requirements but still requires additional conditions to fully comply with the purposes and intent of the Zoning Bylaw. Therefore, in order to fully comply with the approvals necessary to construct the facility as specified in this special permit before us, the Planning Board hereby grants a special permit to the applicant provided the following conditions ae met: I. Conditions to be met prior to the plans be endorsed by the Board and recorded with the Registry of Deeds Office: 1. A landscaping plan shall show appropriate landscaping materials located adjacent to the side yard property lines. Z. A No Parking sign shall be placed in the sidewalk in the island between the two driveways in front of this lot. 3. Parking spaces shall be marked on the pavement in front of the _structure. The spaces shall be 10' wide. . 4. Wheel stops be placed in thrI:ark.i.ng spaces as conditioned in the Board of Appeals decision. 5. No storage or trash dumpster =,hall be placed outside of the structure. 6.
