Andover, MA 01845 ** * ************************* 't OF NORTH{ q� gnffD t� �SSACHUSEt TOWN OF NORTH ANDOVER MASSACHUSETTS (BOARD OF APPEALS Petition #10-89 DECISION The Board of Appeals held a public hearing on Tuesday evening, August 9, 1988 upon the application of C & D Realty Trust requesting a Special Permit from the require- ments of Section 9, Paragraph 9.1 of the Zoning ByLaws so as to permit continued use of a non -conforming structure on the premises located at 9 Waverly Road. The following members were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, William Sullivan, Anna O'Connor, and Louis Rissin. The hearing was advertised in the North Andover Citizen on July 21 and July 28, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Nickerson and seconded by Mr. Rissin, the Board voted, unanimously, to GRANT the Special Permit as requested subject to the condition that concrete wheel stops be put in the parking lot. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning ByLaws and the granting of this Special Permit will not derogate from the intent and purpose of the Zoning ByLaws. Stocking, Planner DATE: July 25, 1988 RE: C&D Realty Trust 9 Waverley Road - Special Permit 9.1 120 Mi lin Sircct North Andover, Massachusetts 0 184 ((i 1 7) 685-4775 Staff has directed the applicant to file with you for a Special Permit to alter a non -conforming structure on a non -conforming lot of record. Staff was made aware that the applicant improved the structure without a Special Permit from this Board and Site Plan Review by the Planning Board upon his request for a Certificate of Occupancy. Therefore, both the non -conforming use issue and Site Plan Review are running concurrently, and the applicant will appear before the Planning Board on August 18th. Upon review of the file and a site visit, Staff has the following recommendations should the Board see fit to grant the Special Permit. 1. That the curb adjacent to the land of Bahrawy to make a curb cut 20' wide. 2. Plant three street trees in the sidewalk in accordance with DPW Requirements. 3. Supply landscaping adjacent to land of Bahrawy in the form of shurbs and a tree. 4. Place concrete wheel stops in the parking spaces to prevent cars from striking the building and provide a walkway to the doors.
