The hearing was advertised in the Nort-h Andover Citizen on January 9, and 16, 1986 and all abutters were notified by certified mail. The following members were present and voting: Michael P. Roberts, Chairman; Paul A. Hedstrom, Vice Chairman; John A. James, Jr., Clerk; John J. Burke and Erich W. Nitzsche. The petitioner seeks a Special Permit under Section 4.133(d) of the Zoning Bylaw so as to permit the construction of dikes and retention basins within 100 feet of a tributary in the Watershed District. The land is located on the south side of Dale Street and known as Coventry Lane and Orchard Path located within the Watershed and Residential 2 Zoning District. .The petitioner's representative, Scott Moorehead of Beta International, made the following comments: 1) Special Permit is requested for drainage and construction of dikes and retention basins and will disturb the land within 100 feet of a wetland tributary in the Watershed;' 2) The location of the drainage outfalls and the dike construction have been staked on the ground; 3) The following items have been submitted: a) a construction and conservation schedule for the work to be performed within the watershed; b) a copy of the construction notes and details indicating erosion controls methods to be used; c) existing and proposed grades are shown on Grading Plan -2, dated July, 1985, revised November 8, 1985, and December 19, 1985 to be used. Upon a motion by John A. James, Jr. and seconded by John J. Burke to take the matter under advisement and close the public hearing, the board voted unanimously. Upon a motion made byJohn J. Burke and seconded by Erich W. Nitzsche, the Planning Board (Michael P. Roberts, Paul A. Hedstrom, John J. Burke and Erich W. Nitzsche) unanimously voted at their February 27, 1986 meeting: to Grant the petition to allow the construction of dikes and rete.ntion basins as shown on plan entitled Grading Plan -2 Coventry Estates, dated July 1985, revised 11/8/85 and revised 12/19/85 subject to the following^: 1) Only the proposed construction of dikes and retention basins shown on the above referenced plan shall be allowed, under this permit. Any changes meeting the intent of the said plan and bylaw, and determined to leave less of an impact on the Lakes Watershed must be approved by the Planning Board prior to implementation in the field. 2) Construction shall coincide with the following required mitigating measures: a) minimize the disturbance of soils from the property; b) provide permanent siltation control in the form of loam and seed or bark mulch; c) provide rubbish removal and sanitary facilities for contractor and crew during construction; d) prevent the use of fertilizer on grassed areas in the 100 foot buffer zones to the tributary. 3) Provide the Planning Board with a written list of all builders and contractors involved during .this phase of construction. 4) Security in the amount of $20,000 shall be retained to ensure the Town that the erosion control program is effective as determined by the Planning Board. The Board shall retain the authority to enforce the bond if precautionary measures are determined inefficient. 5) Decision to be recorded at the Registry of Deeds and original forwarded to the Planning Board. 6) The applicant shall comply with the North Andover Conservation Commission's Orders of Conditions dated February 21, 1986, DEQF File No. 242-324. 7) A certified letter from a RLS and PE shall be submitted verifying that all work is in compliance with the plan. At that time a site visit will be scheduled prior to release of funds being held. In granting this Special PermiL, the Planning Board finds pursuant to Section 10.31 - Conditions for Approval of Special Permits of the Zoning Bylaw, that the following conditions are met: 1) The specific site is an appropriate location for the creation of a detention basin and proposed dike and associated appurtanent structures. The plan provides the necessary drainage structures to prevent increase in runoff at the appropriate locations while minimizing land disturbance in the watershed. 2) The use of dikes and retention basins will not adversely affect the surrounding residential neighborhood or watershed district. The plans proposed erosion and sedimentation controls, and the Planning Boards imposed conditions minimize any impact to the Lakes watershed. 3) In compliance with conditional approval, there will be no nuisance or serious detrimental hazard to vehicles or pedestrians. 4) Adequate and appropriate facilities will be provided on the site to service the proper and efficient operation of the proposed uses. Town water and sewer will be provided. 5) Based on site visits, public hearing process, and review by other Town Boards, the dike and retention basin is considered to be in harmony with the general purpose and intent of this bylaw. That the record owners of the subject land forthwith execute and record a "covenant running with the land", or otherwise provide security for the coln- struction of ways and the installation of municipal services within said sub- division, all as provided by G.L. c. 41, S. 81-U. 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. 3. That, as reguixed by the North Andover Board of Health in its report to this Board, no building or other structure shall be built or placed upon Lots No. as shown on said Plan withost, the prior consent of said Board of Health. 4.
