From our discussions, you are requesting to install a fence around the entire perimeter of your property. The fence will be installed more or less immediately on or adjacent to the staked boundary limits of the property and outside of the existing drainage easement. As you are aware, an isolated wetland resource area jurisdictional pursuant to the North Andover Wetlands Protection Bylaw is located within your property boundaries. 'This protected resource area is also surrounded by a 25' No -disturbance zone and a 50' No -Build zone. The Conservation Department has found that since the installation of a fence in the specified location is minor in nature and is proposed outside of the local regulated 25 -foot No -Disturbance Zone and outside of the existing drainage easement, the installation of a fence can be allowed without a filing with the North Andover Conservation Commission (NACC). However, please be aware that any other activity proposed within 100 feet of this wetland resource area may be subject to a filing with the NACC as required under the North Andover Wetlands Protection Bylaw (Chapter 178 Code of North Andover). Please feel free to contact me at any time should you have any further questions or concerns in this regard.
