Dear Paul: At your request, I inspected the foundation excavation at the above site on May 11, 2006. You have removed the existing building foundation, approximately 2 feet of topsoil and organic material, and have excavated 1 to 2 feet into the underlying natural grade which consists of medium dense silty sand. The building footprint has been partially filled with 12 inches of 1 1/2 inch stone. The modular buildings to be erected are wood framed wall bearing structures with interior bearing walls between each of the units. Footings for the bearing walls should be a minimum of 24 inches wide and bear on the undisturbed natural grade. You may place a maximum of 8 inches of 1 %2 inch stone on the natural grade to stabilize the footing bearing. Stone should be compacted by 3 passes of a vibratory roller or hand operated plate compactor. The Board finds that owing to the pre -zoning 19`b century mixture of business and residences along lower Main Street, the circumstances relating to the shape of this land, and especially affecting this land and structure but not affecting the zoning district in general, a literal enforcement of the provisions of this Bylaw will involve substantial hardship, financial or otherwise, to the petitioner, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of 7.3 of the North Andover Zoning Bylaw. The Board finds that this relief will not derogate from the intent of the Bylaw because the proposed 7 -unit residential structure will have closer conformity to the requirements of 7.3 than the existing 7 -unit residential structure. Also, the Board finds that the applicant has satisfied the provisions of Section 9, Paragraph 9.1 of the zoning bylaw and that the specific site has been an appropriate location for this use, that the current use and the proposed use, as developed, will not adversely affect the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The Board finds that the proposed 7 -unit use is in harmony with the general purpose and intent of this Bylaw, and that the proposed structure will be farther from the lot lines than the existing 7 -unit residential structure. The proposed structure will allow 17 parking spaces, 3 more than the required 14 parking spaces and 4 more than now exist. The Board finds that this proposed structure is less detrimental than the existing structure to the neighborhood. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all applicable local, state, and federal building codes and regulations, prior to the issuance of a building permit as required by the Building Commissioner. Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of the grant, it shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2) year period from the date on which the Special Permit was granted unless substantial use or construction has commenced, it shall lapse and may be re-established only after notice, and a new hearing.
