Box 531, North Andover, MA 0.1345 THE BOARD: Shall mean The Planning Board of the Town of North Andover, MA.(120 Main Street, North Andover, MA) THE RULES: Shall mean the Rules and Regulations Governing The ' Subdivision of Land - North Andover, MA issued by said Board and as amended through this date. THE PLAN: Shall mean Sheets one. through 3 of the Definitive Plan of - 'Cranberry Lane for Flintlock Realty Trust prepared by DiPrete, Marchionda & Assoc., Inc. dated February ' 1986, revised 4/22/86 (siltation details), 4/25/86 (sewer & water cons.) and as revised to accommodate Conditions of Approval. Said subdivision contains 6 lots. 1. The applicant shall fully comply with. the North Andover Conservation Commission Orders of Conditions dated June 9, 1986, D.E.Q.E. File No. 242-350 as required under Chapter 131, Wetlands Protection Act and the local Wetlands regulations. Any subsequent changes requiredmay be cause for reconsideration of the subdivision under M.G.L. Chapter 41. 2. Due to the waiver request under Section IV, A, 4 Dead End Streets, for the length of the cul-de-sac the limited paved width of the roadway shall be 22 feet in accordance with the definition of minor streets. 3. Tree clearing within the proposed town right-of-way shall be minimized to 3 to 6 feet maximum on either side of the roadway pavement, not to the full 50 foot width. The Planning Board shall require the design of a landscaped circle in the center of the proposed cul-de-sac by keeping as much of the existing vegetation: 4. As agreed upon by the Planning Board, the developer shall Contract with a Landscape Architect to prepare a plan linking the development to the Old Center and supervising the completion of said work which occurs at the entrance of the site to the Old Center. All dwellings shall be compatible with existing colonial architecture of the Old Center. A covenant running with the deed should include this provision. 5. The developer shall have a Registered Arborist, as agreed upon, to supervise tree cutting close to the roadway. The Arborist shall be present on site during roadway clearing and prepara.tion for.construction. Tree cutting shall be minimized throughout the project. A Planning Board representative, in accordance with the Landscape Architect and Arborist, shall explicitly specify on plan trees that are to be retained such as the large pines at the rear of site. 6. `'No work shall commence prior to the issuance and recording of side. line variance from the Board of Appeals for the existing historical barn on Lot #6. A covenant shall be provided in the deed that the barn will not be razed as noted on plan. 7. In accordance with the letter of agreement dated June 4, 1986 from the applicants representative, a row of planting in the buffer easement on Lot #1 will be extended into Lot #1 by the addition of 10 hemlock trees 8 to 10 feet in height. 8. In accordance with the Highway Surveyors Recommendations: - The developer maybe required to provide additional drainage facilities based on its observation of conditions in the field; Off site drainage shall require a street opening permit and bond from the Highway Department; Drainage from the subdivision shall be constructed in the Easterly side of Osgood Street and extended northerly to the intersection of Massachusetts Ave. to minimize tree cutting. f 9. In accordance with the Board of Public Works: a) The water main on Cranberry Lane shall be 8" class 52 ductile iron cement tine pipe installed 10 feet right of the centerline of the road with 5 feet of cover below the finish grade from the existing water main on Osgood Street to station 7 + 60. b) A 12" x 8" tapping sleeve and gate valve (Mueller or equal) shall be provided at the existing water main on Osgood Street. c) Eddy breakflange hydrants to North Andover specifications are to be installed at station 3 + 90 and 7 + 60. d) All hydrant branches shall be provided with six inch Mueller or equal gate valves (open left). e) All gate valves shall comply.with AWWA specifications L500 52T and will be supplied with a 100 lb. sliding type gate box marked "WATER". iF f) All water mains shall pass leakage and pressure tests performed t in accordance with Section 13 of the AWWA standard C600 and shall be chlorinated in accordance AWWA C601 "Standard Procedure for Disinfecting Water Mains." g) The sewer main shall be 8" polyvinyl chloride (PVC) SDR 35 pipe installed in the centerline of the road. h) A sewer manhole shall be added to station 3 + 50 to maintain alignment in the centerline of the road. i) Precase manholes shall conform to ASTM designation C478 and shall meet the following additional requirements, the wall thickness shall be not less than 5 inches, sections shall have tongue and groove joints with an approved bitumastic gasket. Pipe connections shall be of the rubber boot with stainless steel band or approved equal. Manhole frames and covers shall be cast iron lettered "SEWER" and shall be eight inches high. j) All sewers must pass low pressure air tests with a maximum allowable leakage rate of 0.0015 cubic feet per square foot of internal pipe surface. k) All sewers shall be tested for abnormal deflection due to installation and backfill methods, with a maximum allowable V 1 . I I deflection of 5 percent. 10. Lot numbers shall be posted during construction and permanent house numbers posted prior to occupancy. 11. No open burning is allowed except by permit from the Fire Department. 12. Prior to occupancy, the subdivision shal,.l provide adequate access to each residence by having had the binder coat applied. 13. In accordance with the Tree Warden, all requirements of the Subdivision Control Laws pertaining to 'Street Trees' shall be enforced. Security in the amount of $3,200 be retained for this purpose. .14. The Planning Board will require security in the amount of $18,000 or $3,000 per lot to cover erosion control measures during construction. If erosion measures are deemed inadequate to provide for the necessary control, the Planning Board will exercise the security to stabilize the problem area. 15. Security in the amount of $5,250 shall be posted with the Planning Board to ensure satisfactory submittal of final as -built and acceptance plans to be recorded at the North Essex Registry of Deeds after review and approval by the Planning Board and Highway Surveyor. Said plans shall be accompanied by a Certificate of Compliance from a Registered Professional Engineer certifying that the grade on all lots and streets have been established in compliance with the definitive plans and that said grade have been established so as not to create adverse drainage patterns onto adjoining lots and/or streets (note on recorded plan). 16. There shall be no driveway constructed at catch basins or stone bound locations in accordance with Rules and Regulations (note on record plan.) 17. The developer shall present to the Board prior to any construction activity, satisfactory documentation regarding earth removal schedule and hours of heavy construction traffic. A list of contractors working in the subdivision shall be forwarded to the Board for their files. This list shall be updated on a monthly basis at the responsiblity of the developer. 18. The owner/applicant/developer shall be aware of the fact that approval of this subdivision under the Board's Rules will not relieve said parties of the responsibility to other property owners upon whose land may be affected by indirect or direct development storm water discharge. 19.
