Mr. Towle concern is that the drainage pipe is causing a "hump" in the driveway and the pavement is broken up in this area. Also, due to the elevation of the top of the 12" concrete pipe, he feels the driveway approach is too steep. In researching this project, Meadowood Road is currently a private way, in fad in 1994 Town meeting provided an unfavorable recommendation for roadway acceptance. Julie Parrino has researched available bond money and has found that there is outstanding bond money associated with this subdivision. She is in the process of determining total dollar amounts and the process involved in obtaining these funds. - I discussed three options with Mr. Towle: 1) Do Nothing This is a private way with an existing 12" concrete pipe that was install M, in accordance with an approved definitive subdivision plan. There is a small pocket of wetland replication area associated with this piping that could possibly require a wetland filing. This project dates back over 10 years with various Town officials with no change to the approved design plan. 2) Resurface the Driveway For a fee of approximately $35001 could excavate out a portion of the driveway, regrade the base, and resurface the driveway with 3" of asphalt. The steep transition from the edge of travel way to the pipe location would still exist, but it would improve the existing condition. 3) Replace the existing drainage pipe/resurface portion of driveway I could replace the existing 12" concrete pipe with 12" high-density plastic pipe. This would result in decreasing the driveway height at the pipe crossing by approximately 3". This would ease the transition from the edge of travel way to the pipe crossing. I would then need to resurface the driveway in the same manner as Option #2. With this option I would look to classify the project as "Roadway Maintenance" to avoid having to file with the Conservation Commission (due to small abutting wetland replication area). I have briefly spoke to Alison McKay about this and will need to conduct a field visit with her if this project progresses to receive her opinion. Assuming a wetland filing is not needed, this option would cost approximately $7,000 to complete. My recommendation: If bond monies are available and the wetland filing is not necessary, then I would recommend Option #3. By copy of this e-mail I would ask that Julie and Alison provide input into the bond money and wetland issues respectively. If bond money is not available, then my budget would take a large hit with either Option 2 or Option 3. Finally, Mr. Towle asked that I copy him on my correspondence and recommendations. I will provide him a hard copy of this e-mail once all parties have reviewed the outlined options. I have actually talked to him over the last two years and have tried to address his concern. He has a pipe at the end of his driveway that was installed when the subdivision was built. The pipe is just for drainage and allows street drainage to flow through it. The pipe, as installed, creates a big hump (speed bump) in his driveway. Jim Towle has been trying for 8 years to address this issue. In the beginning, the developer said they would look into it. Nothing ever got done and the developer claimed the Town required the pipe. Jim has tried working with several different people over at DPW to address the problem. The Town claims they are not responsible for the problem. This subdivision has not been accepted. l guess it was on the warrant for acceptance years ago but at the Selectman's meeting, Jim Towle objected and brought this problem up. John Leeman felt it should be addressed and I guess the subdivision never got accepted. Mr.. Towle feels as though he has been trying for years to address this problem and is very angry and feels he may have to sue the Town. He wants the pipe either replaced with a 12" corrugated pipe to decrease the bump or have the driveway regraded to address the bump. I have not been able to find documentation relative to the pipe. I have a plan that shows the pipe which I would assume was designed by the engineers to be put in place. Replacement of the pipe would obviously cost money and may require a Conservation filing as there is an 18 s.f. replication area next to it. It is actually a small hole collecting drainage and Mr.. Towle claims it is clogged with leaves. I have talked extensively with DPW about the issue and they have informed me that they feel the Town is, not responsible for the problem. I have tried to understand Mr. Towle's issues and I have made it clear that the Town does not want to accept the responsibility of addressing the problem. There may be bond money left for this subdivision. The entity that developed it no longer exists although it comprised on Tom Laudani and Stanley Davis. I doubt, if the bond was other than cash, is still in effect. I will try to look into this further. Mr. Towle feels if bond money exists the Town should use it to address the problem. You will be getting a letter and a call from Mr. Towle. I have tried my best to be sympathetic but I do not feel at this point, from what I know, that I can help him. I just wanted to give you a little history before you get an earful. He claims he has talked to several Town Managers in the past so I believe it is an issue that is not going away anytime soon. If anyone has any more input on the history and how we further deal with it or not deal with it please let me know. Thanks so much.
