It appears that his biggest issue is that the Animal Control, Sue Notham, does not have the power that he feels she needs. I encouraged him to contact Sue when the dog is actually off its property. I would believe at that point Sue could pick him up and then work with the neighbor on additional controls. Obviously, this has been going on for years between these neighbors. As for the interior issues, I will request a copy of the report from the Police Dept. for information. As they did not call the health dept. in on this one, I can only assume that the officer, though he may have felt it was filthy, knew that it may be the owner's choice to live that way. As this is only a theory, I will still check this out. Mr. Eisen is basically frustrated. I encouraged him to take a proactive approach if he truly feels the animal control rules are inadequate. He also understands that the health office walks a fine line on the rules regarding how a person lives within their own home. I told him I would contact him again if I had anything further to discuss. Susan -----Original Message ----- From: Johnson, Adele Sent: Wednesday, September 08, 2004 4:28 PM To: Sawyer, Susan; Rees, Mark 9/10/2004 Page 2 of 2 Cc: Dellechiaie, Pamela Subject: resident complaint Hi Susan & Mark, Mr. Jerry Eisen of 138 Old Cart Way, 978-725-3423 came to see the Town Manager to put in a complaint about his neighbor Tom O'Brien at 141 Old Cart Way. Mr. O'Brien has a Golden Retriever that is left loose at all hours of the night and sometimes weeks without supervision. The dog was loose today and went after Mr. Eisen's dog and Police Officer Whittaker was at the house today to try and confine the dog. The house was wide open and the owner could not be found. While Officer Whittaker was in the house he observed feces and urine all over the house. I believe that this is a BOH issue. Sue Northam the animal control officer is well aware of this and is unable to do anything but give warnings. Mr. Eisen would also like to meet with the Town Manager in order to give Sue more authority in these matters. Sue or Pam, Please call Mr. Eisen tomorrow morning if possible to find out more information. Thanks, Adele J.
