As you may recall, the proposed work includes: 1. Adding a circuit and GFCI receptacle in each of forty 40 dwelling unit bathrooms, and 2. Adding an electric range outlet in each of .eight (8) unit kitchens.' This element of the work also includes the installation of a new feeder to the existing unit panelboard. You recently discussed the work with Mr. Carl Neunaber of my office, and advised that you would not issue a permit for the work as currently depicted on the contract documents. We understand your concern to be an existing violation of the working space at the existing dwelling unit panelboards. We believe the work should be permitted as allowed by 527 CMR 12.00, the Massachusetts Electrical code, Rule 3; which reads: "Additions or modifications to an existing installation shall be made in accordance with this Code without bringing the remaining part of the installation into compliance with the requirements of this Code. The installation shall not create a violation of this Code, nor shall it increase the magnitude of an existing violation" In this instance, the issue is an existing working space violation at the existing panelboards located in the dwelling unit kitchens. The panelboards are located .above the kitchen counter, and below the upper kitchen cabinets; a common installation in this vintage construction. The location of the existing panelboards does not allow compliance with recent or current editions of 527 CMR 12.00 110.26(A), Working Space which in effect requires a clear space for 36 inches in front of the panel, 30 inches wide, from the floor to the ceiling As you know, the working space described above is obstructed by the existing kitchen cabinets. However, the working space violation is an existing violation. ' The addition of the electric range receptacle outlet is in response to Public Housing Notice 2012-15from the Commonwealth of Massachusetts Department of Housing and Community Development (DHCD). The notice provides that public housing in which residents on oxygen therapy reside should be provided with electric cooking appliances rather than natural gas appliances, due to the risk of fire and serious bodily injury or death should the oxygen cause a fire ignited by the open .flame of the gas range -top burners. The addition of the electric range receptacle outlet will allow the NAHA to replace the gas ranges with electric ranges in selected dwelling units and safely accommodate residents. who may be on oxygen therapy, in response to the:notice from DHCD. 32 Prince nce Strreet, Da nverrs; Kk on923 Tet. Therefore, the proposed work does not increase the magnitude of the existing clear space violation at each panelboard. Also please note that 527 CMR 12.00 paragraph 110.26(A) requires the described working space only for "equipment... likely to require examination, adjustment, servicing or maintenance while energized... " If the work is permitted, we will require that the following warning label be installed at each dwelling unit panelboard: WARNING DO NOT WORK ON THS EQUIPMENT ENERGIZED! EQUIPMENT DISCONNECTING MEANS LOCATED IN BUILDING BASEMENT Such a warning label will eliminate the likelihood that the panelboard will be serviced while energized, eliminating the clear space requirement. We believe the work will create a safer installation for the residents at Fountain Drive. We respectfully request that the permit for this work issue under the provisions of 527 CMR 12.00, 2014 Massachusetts Electrical Code, Rule 3, or that the application for permit be rejected in writing stating the reasons for the rejection so that the determination can be appealed to the Board of Electricians' Appeals in accordance with M.&L. c. 143 :§3P. Nangle January 28, 2014 Fr: Peter Murphy- Electrical Inspector Re: Fountain Drive, Unit #2, North Andover MA Permit # 12078 Dear Mr. Nangle, Your permit application for Unit #2, Fountain Drive was received and processed on January 6, 2014. The permit was not formally issued as the permit fees were not paid due to the fact that the total scope of the work was not known at that time. As a courtesy, an inspection of the above address was conducted on January 7, 2014 and was not approved. The reason for failure was because the scope of work for that unit is in violation of 527 CMR 12:00. 527 CMR States: Rule 3 — Additions or modifications to existing installation shall be made in accordance with this code without bringing the remaining part of the installation into compliance with the requirements of this code. The installation shall not create a violation of this code, nor shall it increase the magnitude of the existine violation. The inspection done on January 7, 2014 is indicative of the work to be done at the rest of the units (40 total) at this location. The existing circuit breaker panel in Unit #2 is not compliant with today's standards but was at the time of the initial installation. The failure to comply concerns working -space in front, above, and below dedicated panel space(s) as addressed in NEC 2014, 110.24, 110.25, and 110.26. The location of the panel in Unit #2 (and remaining units) between the counter top and cabinet above and that the stove is directly in front of the panel will create a violation of the aforementioned code. The current panel location(s) will increase the magnitude of the existing violation if the breaker panel will be reefed with 70 amp 3 wire or additional circuits for bathroom GFIC outlets are taken from these panels. Installation of warning label(s) as represented in your letter does not address the code violation(s) and would not be sufficient to rectify the violation(s). Such a warning label will not prevent potential hazards due to the location(s) of the panels. In closing, I will require the panels to be relocated by addressing dedicated space issues as per NEC 2014, 110.24, 110.25, and 110.26. By doing this you will be able to accomplish the summary of work stated in your project manual documents.
